1: Nonimmigrant Visas
USCIS data shows that as of 2014, there are about one million international students in the US under the two nonimmigrant student visas F-1 and M-1.
It is of great benefit to the US if it can retain the ever-increasing number of students from many parts of the world who have, or are in the process of attaining, qualifications that are very valuable to the US. Hi-tech expertise and entrepreneurial spirit is sought after in a country which strives to be at the forefront of innovation. It is a proven fact that immigrants are more likely to start a new business or become inventors than those born in the US.
This chapter will introduce you to 5 nonimmigrant visas that can allow you to legally undertake your activities in the US. E-2 visa is only for citizens of a treaty country.
Caution
In order to avoid problems relating to your immigration status at any time, either when you begin seeking a visa or at a future date, do not commence work. You must obtain an Employment Authorisation Document (EUD) before commencing any form of employment.
F-1/OPT Optional Practical Training
Your area of study
Your eligibility will differ depending on the business you start and the study programme you are undertaking.
F-1 students can start a business that is directly related to their area of study, provided that they are not on an English language course. It is important to note that the work you do must be largely associated with the area of your study programme. You can avail of OPT while you are at school or after you graduate (or a combination of both.)
Various durations
F-1 students may enjoy OPT status for up to 12 months.
If they extend their education by way of pursuing another higher degree level they can obtain an extra 12 months. Some of these students may also apply for a 17 month extension after their OPT periods provided their study is in the qualifying Science, Technology, Engineering or Mathematics (STEM) areas.
If you meet these criteria you can seek an OPT visa.
Employment periods
You can have full time practical training for a period of 12 months whilst you are an undergraduate, graduate or after you graduate. While school is in session, you are not allowed to work for more than 20 hours per week prior to completing the OPT. Outside of the periods that school is not in session, such as vacation time, you can indulge in full time work.
Certain skills
If you graduate with a qualified Science, Technology, Engineering or Mathematics (STEM) degree, and are currently in an approved post-completion OPT period based on a designated STEM degree you may apply for a 17-month STEM extension of your post-completion OPT.
STEM degree
For a STEM degree to qualify, it must appear on the STEM Designated Degree Program List. If you want to apply for a STEM extension, you must file for an extension of your EAD with USCIS before your current OPT work authorization expires. This should be done 90 days before the expiration of your OPT.
Here’s how you apply for F-1 OPT
30 day deadline
When you receive a recommendation for post-completion OPT from your Designated School Official (DSO) to pursue OPT you have 30 days in which to apply. You seek an employment authorization document (EAD) with USCIS.
End date
This can be done up to 90 days prior, but not later than 60 days, to your program end-date of your EAD with USCIS before your current OPT work authorization expires. USCIS recommends that you file 90 days before the expiration of your OPT.
H-1B Specialty Occupation
The H-1B is one of the most popular work visas in the United States. Employers in the US usually prefer to hire a foreign national under the H-1B visa as it has a fast processing time. If you intend to start a business in the US and work in it, this visa option is also open to you if you meet the criteria. These are; that it is an occupation that normally requires a bachelor’s degree or higher in a related field of study. You must have at least a bachelor’s degree or equivalent in a field related to the position. You will also have to have a sponsoring US employer to assist in the process.
The period of time allowed to you at the outset is 3 years. This can be extended to a maximum of 6
