      Introduction – This provides information regarding the approach to the topic of this book

      Chapter 1 Comparing Executive Departments/Agency Decisions to the law and the Constitution

      This chapter is about the decisions made by the Executive Departments and agencies in relation to laws passed by Congress and the Constitution. Decisions made are subject to review by Congress but more often than not this review does not take place or the appearance projected suggests this to be true. Comparisons will be made about executive department activities as they relate to the Constitution is the primary focus. Congress cannot generate laws which violate the Constitution.

      Chapter 2 Constitutional Authority of Congress – The Constitutional Authority of Congress is clearly identified in the Constitution. Discussion about this authority compared to its actions is the focus of this chapter

      Chapter 3 Constitutional Authority of the President – The authority of the President is clearly defined within the Constitution and yet our judicial system has interfered with this authority. Understanding the authority of the President presented in this chapter will let readers truly know what this authority represents regardless of court actions.

      Chapter 4 Constitutional Authority of the Judicial System - The judicial system is a check on the function and decisions by Congress and the Executive Department. It is meant to enforce the law not create new ones through their decisions.

      Chapter 5 Comparing congressional legislation to the Constitution – Legislative actions by Congress must comply with the Constitution. Laws passed by Congress involving subjects not granted to it by legislation signed by the President must be limited to these authorities.

      Chapter 6 Comparing political party policy to the Constitution – Political philosophy and party policy must not contradict the rights of citizens identified in the Constitution and when this takes place the action must be fought in the judicial system.

      Conclusion - This is a summary of the conclusions drawn from the information presented in the chapters of this book.

      Chapter 1 Comparing Executive Departments/Agency Decisions to the law and the Constitution

      Many decisions are made by executive departments and the agencies within them but the real question is whether these decisions comply with the laws they are to enforce and the Constitution. Decisions come in the form of rules and regulations but at this point there appears to be little if any oversight by Congress with regard to these actions. The volume of rules and regulations that have been generated over the last several years is unprecedented and needs to be examined by Congress as an equal branch of government. Part of the problem from reviewing some legislative actions is the vague language contained within them. This is the fault of those serving us in the Senate and the House of Representatives. While I agree that these departments and agencies need to have some options the present environment is too loose and only Congress can change it.

      Another part of the problem is the political culture in both the Congress and the Executive Department. It appears that both branches of the government want to have it their way regardless of whether their decisions comply with the Constitution or the will of the people. The culture of compliance seems to be missing in both of these branches. First and foremost Congress has specific authority and that authority is not being initiated when it comes to ensuring the Executive Department and agencies comply with the laws passed by Congress and /or limiting their actions to the authority granted to them by our Constitution.
