    Antonio Serrano, a seafarer, was hired by Gallant Maritime Services, Inc and Marlow Navigation Co., Ltd.

    , giving Serrano a position as a Chief Officer reciving US 1,400.00 as basic salary. The contract duration was 12 months or one year. When Serrano departed to start his work, he was constrained to accept a downgraded employment for the position of Second Officer with the assurance that he will be made Chief Officer by the end of April 1998. However, he wasnt made into Chief Officer and he refused to retain his Second Officer position. His employment contract should be one year, starting from March 19, 1998 to March 19, 1999. But after 2 months and 7 days of working, he left and returned home. He filed a complaint to the Labor Arbiter against respondents for constructive dismissal and claim for what is due to him.
