Chelsea and Westminster Hospital NHS Foundation Trust 369 Fulham Road LONDON SW10 9NH 30th June 2008

Dear Dr Branson I am writing to you in the hope that you see fit to intervene to resolve certain issues regarding Virgin Healthcare for whom I used to work. I enclose documents that illustrate how Virgin Healthcare are setting out to undermine the ethos of the NHS by: Paying GPs to refer NHS patients to Virgin-employed private therapists (without making it clear to the local PCT or their patients). This is strictly against GMC regulations Accessing confidential NHS patient details to send them marketing materials Accessing documents from the local PCT that they should not have. Coercing one of your colleagues in the NHS, Dr Peter Crouch, into agreeing with these plans because of his financial difficulties (the document says that Virgin expect little emotional resistance to their plans as a result.) There are more issues than this and you may be aware that there is a web site outlining my issues www.branson-pickle.com In addition to the enclosed documents I also have tape recordings of Will Whitehorn and Josh Bayliss at Virgin intimidating and bullying me from taking my concerns to the media. I am threatened with being sued, not being given a good job reference etc. I am also told that I shouldnt take my concerns to my MP as he couldnt be trusted which is shameful behaviour.

You may be aware that Richard Taylor MP asked in the House of Commons for a meeting with Alan Johnson at the DoH to discus my alarming concerns. The DoH seems surprisingly reluctant to respond to Mr Taylors request. When I worked at Virgin Healthcare I understood that you were involved in board meetings with this business. I will assume that you were unaware of the behaviour of Virgin in these matters, as I cannot believe that you would train so hard for so long only to conspire to undermine the NHS like this. I ask that you intervene as a matter of urgency with your father to put a stop to these matters as they clearly represent a threat to the health and safety of patients. It cannot be right that a GP colleague of yours is put under such pressure to collude with practices that are so contrary to the well being of his patients. I hope you feel you have a duty as and NHS Doctor and as someone with the means to intervene at Virgin and that you are able to respond with some alacrity as Virgin Healthcare continue to negotiate with hundreds of doctors across the UK whilst really deceiving them as to their true intentions. If you would like to contact me to discuss these matters you can do so at a time of your convenience. Please be aware that I think these practices are clearly bringing the medical profession into disrepute and it is the interests of all concerned that they are settled with some urgency. I will not overwhelm you with documents but I enclose a Team Meeting minute where management discuss how to find a away around GMC and BMA restrictions on advertising to NHS patients and the discussion of how Peter Crouch, the GP at the centre of the first Virgin clinic was in financial distress and hence would show little emotional resistance to Virgin Healthcares plans. I can produce other documents and tape recordings as you request. I am not a vengeful ex-employee of your fathers, I raised my concerns about these issues on my third day working at Virgin Healthcare and as a result I was accused of something for which I felt obliged to offer my resignation only for that accusation to be later withdrawn. My mother worked as a GP all her life so for me this is a matter of principle as I hope it is for you. Yours John Spencer
