DISMAS CHARITIES, INC., et al., Defendants. / ORDER DENYING PLAINTIFFS MOTION TO COMPEL PRODUCTION OF DOCUMENTS AND ELECTRONICALLY STORED INFORMATION Presently pending before the Court is the Plaintiffs Motion to Compel Production of Documents and Electronically Stored Information (DE # 110). The Defendants have filed a Response (DE # 112). No Reply was filed, and the deadline has passed. The motion, directed at various non-parties, seeks the production of documents entered into the SENTRY SYSTEM. As noted by the Defendants, however, the subpoenas do not appear to have been properly issued and served, and were issued well after the close of discovery (DE # 98), without leave of Court. Thus, the subpoenas will not be enforced. Moreover, it appears from various filings made by the Plaintiff that he ultimately received the documents he requested in the subpoenas (DE ## 114, 115, 118), and therefore, the motion is moot. Therefore, it is hereby ORDERED AND ADJUDGED that the Motion to Compel (DE # 110) is DENIED . DONE AND ORDERED in chambers, in Miami, Florida, on March 27, 2013.
