INFORMATION HAND BOOK UNDER SECTION 4(1) OF THE RIGHT
TO INFORMATION ACT, 2005
1. Introduction
The Right to Information Act, 2005 (Central Act 22 of 2005) has been enacted to
provide for setting out a practical regime for citizens to secure access to information
regarding the functions of Public Authorities. This will promote transparency and
accountability in the working of every Public Authority. This publication is made
with reference to Section 4(1) of the Right to Information Act. It seeks to clarify the
duties and obligations of public authorities concerned with electoral administration.
Additional Information relating to electoral rolls, past election history, including
candidates, votes polled is available at ceoandhra.nic.in and eci.gov.in
The organization of the information in this Hand Book is given chapter-wise in the
index.

1.5. Procedure and Fee Structure for getting information
(a) Every application for obtaining information Under sub-section (1) of the
section 6 of the Act shall be accompanied by an application fee by way of cash
or by Demand Draft or by bankers' cheque payable to the Assistant Secretary or
any other duly authorised officer of the Public Authority, against proper receipt
at the following rates:-
(c) In respect of public authorities other than those covered above - Rs.10/-
per application;
The application fee and the cost ordered to be charged for providing
information by the Accounts Officer or any other Authorised Officer of
the Public Authority shall be remitted to the following Head of Account:
(b) For providing Information under Sub-section (1) or Sub section (5) of Section
7, a fee shall be charged, by way of cash or demand draft or bankers cheque,
payable to the Assistant Secretary or any other duly authorized Officer of the
Public Authority against proper receipt, at the following rates:-

A) Priced material :
(i) Material in printed or text form (in A4 or A3 size paper) Rs.2/- per each
page per copy;
(ii) Material in printed or text form in larger than A4 or A3 size paper Actual
cost thereof;
(vi) For inspection of records - no fee for the first hour; and a fee of rupees
five of each subsequent hour (or fraction thereof);
(vii) Material to be sent by post - the actual postal charges in addition charge
payable as per these rules;
Persons below the poverty line are exempted from the payment of application fee
mentioned in para 1.5 (a) for seeking information under the Right to Information Act,
2005. The list of persons below the poverty line as approved by the Gram Panchayat
and Local Bodies will be the basis for claiming the concessions and the certified
extract of the list will be sufficient to avail this concession.

2. PARTICULARS OF ORGANISATION OF OFFICE OF CHIEF
ELECTORAL OFFICER INCLUDING FUNCTIONS AND DUTIES
Under Article 324 of the Constitution the superintendence, direction and control of the
preparation of the electoral rolls for, and the conduct of, all elections to the Parliament
and to the Legislative of every State and the elections to the offices of President &
Vice-President are vested in the Election Commission of India. The Election
Commission of India consists of the Chief Election Commissioner and two Election
Commissioners with headquarters at New Delhi. At the State level, the election work
is supervised subject to the superintendence, direction and control of the Election
Commission, by the Chief Electoral Officer (appointed by the Election Commission)
and the officers and staff working under him. Normally the Chief Electoral Officer is
appointed from All India Services in the cadre of Principal Secretary to Government
& above. Chief Electoral Officer is designated as Chief Electoral Officer and Ex
Officio Prl. Secretary to Government, G.A (Elections) Dept. The administration at the
district level is headed by the District Election Officers (DEOs) (generally the
Collectors and District Magistrates; in the case of Hyderabad, the Commissioner
GHMC), Electoral Registration Officers (EROs) & AEROs (for preparation &
maintenance of electoral rolls) (generally officers in the level of Sub-Divisional
Magistrates), Returning Officers (ROs) & AROs (for conduct of elections) and other
officials (like Presiding and Polling officers) appointed for the conduct of elections.

The Office of the Chief Electoral Officer carries out the following duties.
3. Functions and duties
(i) Conduct of elections/bye-elections to
• the 294 Assembly Constituencies in Andhra Pradesh Legislative
Assembly
• the 78 out of 90 constituencies of various types in the AP Legislative
Council. The balance 12 are nominated by the Governor. The 78
comprise as under:
31 are elected by the members of AP Legislative Assembly
31 elected by the members of the Local Authorities specified under
fourth schedule in the Representation of People Act, 1950.
8 members are elected by the Graduates Constituencies
8 members are elected by the eligible Teachers in Teachers
Constituencies.
• the 42 Lok Sabha seats allocated to Andhra Pradesh
Note: These above three elections are direct elections where the electorate of the
Constituencies directly participate.
• the 18 Rajya Sabha seats allocated to Andhra Pradesh
• the office of the President of India
• the office of the Vice-President of India
Notes: i) The above three elections are indirect elections with the electorate
comprising elected representatives in Parliament and in Andhra Pradesh
Legislative Assembly.
ii) It is the duty of all officers involved in election work to ensure that the
elections are conducted in a free and fair manner and in accordance with all
relevant Acts, Rules as well as executive directions of the Election
Commission of India.

4 (c ) Structure at the District level
All District Election Officers, Returning Officers and Assistant Returning Officers
are notified by Election Commission of India in consultation with the State
Government.

4 (d) Below the district level, except the Senior Assistants (Elections) the regular
revenue/local body staff look after routine election related work. Special
Deputy Tahsildars and Clerical staff are appointed in taluk offices for special
items of work and also for conduct of elections.
The working hours for all offices are from 10.30 hours to 17.00 hours with half an hour
lunch break between 13.00 hours to 14.00 hours on all working days.
Applications/petitions under the Right to Information Act/Rules should be submitted
during this time.
The representations / grievances relating to the subject of elections and electoral rolls
from the citizens of Andhra Pradesh are received in the Office of the Chief Electoral
Officer and also in the offices of the District Election Officers and Electoral
Registration Officers during working hours on all working days.
7 Nature of duties
The electoral roll for each Assembly Constituency and Council Constituency is
prepared and revised by an Electoral Registration Officer who shall be an officer of
Government or of a local authority as the Election Commission may, in consultation
with the Government of the State in which the constituency is situated, designate or
nominate in this behalf.

For Assembly Constituencies :
(ii) Preparation and issue of Electoral Photo Identity Cards and Photo
Electoral Rolls.
For each district in a State, other than a Union territory, the Election Commission of
India in consultation with the Government of that State, designates a District Election
Officer. The District Election Officer shall co-ordinate and supervise, under the
superintendence, direction and control of the Chief Electoral Officer, all work in the
district or in the area within his jurisdiction in connection with the preparation,
revision and correction of the electoral rolls for all Parliamentary, Assembly and
Council constituencies within the district. The District Election Officer shall also
perform such other functions as may be entrusted to him by the Election Commission
and the Chief Electoral Officer. The District Election Officer also undertakes the
following duties:

(i) Functioning as appellate authority for certain decisions taken by Electoral
Registration Officer in regard to claims and objections
For every constituency, for every election to fill a seat or seats in the Lok Sabha,
Legislative Assembly, Council of State etc., the Election Commission in consultation
with the Government of the State, designates a Returning Officer who shall be an
officer of Government or of a Local Authority.
The Returning Officer is primarily responsible for the conduct of elections from his
constituency. His functions (as well as those of the District Election Officer) are:

• Handing over a copy of instructions for lodging account of Election
Expenses and Register, etc.
• Allotment of symbols;
• Meetings / contact with candidates, political parties to ensure free, fair and
smooth elections and enforcement of model code of conduct;
• Ensuring the presence of polling parties for the conduct of poll and supply of
ballot papers and other election materials;
• Transport and storage of ballot boxes after poll under security arrangements
• Declaration of result

(e) Assistant Returning Officer
The Election Commission may appoint one or more Assistant Returning Officers to
assist any Returning Officer in the performance of his functions. Every Assistant
Returning Officer shall, subject to the control of the Returning Officer, be competent
to perform all or any of the functions of the Returning Officer. However the Assistant
Returning Officer cannot perform any of the functions of the Returning Officer
relating to scrutiny of nominations unless the Returning Officer is unavoidably
prevented from performing the said function.
The District Election Officer shall appoint a presiding officer for each polling station
and such polling officer or officers as he thinks necessary but he shall not appoint any
person who has been employed by or on behalf of, or has been otherwise working for,
a candidate in or about the election. A polling officer shall, if so directed by the
presiding officer, perform all or any of the functions of a presiding officer. If the
presiding officer, owing to illness or other unavoidable cause, is obliged to absent
himself from the polling station, his functions shall be performed by such polling
officer as has been previously authorized by the district election officer to perform
such functions during any such absence.
The general duty of the presiding officer at a polling station is to maintain order and to
ensure that the poll is fairly taken. He enjoys full legal power to control the
proceedings in the polling station under his charge. The duty of the polling officers at a
polling station is to assist the presiding officer in the performance of his functions. The
polling party generally consists of a Presiding Officer and, at a single election, 3
polling officers if the number of electors attached to a polling station is 1200 or less
and 4 polling officers if the number of electors is more than 1200. At a simultaneous
election, the polling party consists of a Presiding Officer and 5 Polling Officers.

(g) Chief Electoral Officer
In accordance with the provisions of the Representation of the People Act, 1950, for
each State, an officer of Government is designated in consultation with that
Government by the Election Commission of India as the Chief Electoral Officer. The
Chief Electoral Officer will supervise under the superintendence, direction and
control of the Election Commission of India, supervise the preparation, revision and
correction of all electoral rolls in that State. The Chief Electoral Officer of each State
shall also subject to the superintendence, direction and control of the Election
Commission, supervise the conduct of all elections in the State held under the
Representation of the People Act, 1951.
He also functions as the appellate authority for certain decisions of the Electoral
Registration Officers /District Election Officer.

3. PROCEDURE FOLLOWED IN DECISION-MAKING PROCESS
INCLUDING CHANNELS OF SUPERVISION AND ACCOUNTABILITY &
THE NORMS SET FOR DISCHARGE OF FUNCTIONS
The discharge of functions and duties mentioned above, are governed by the various
election laws rules & orders contained in the Manual of Election Law (2 Volumes) and
the various Handbooks listed in chapter 16.
The major areas of decision-making relevant to the public and the norms followed in
those areas are set out below. The channels of supervision and enforcing
accountability generally follow the hierarchy specified in the organizational structure
set out in chapter 2.
1) Should have completed 18 years as on the qualifying date – 1st January of that
year
4) Should not be of unsound mind (If he/she is of unsound mind and stands
declared by a competent court then not eligible to be register as voter)
5) Should not have been disqualified from voting under provisions of any law
relating to corrupt practices and other offences in connection with election i.e.,
171E, 171F of IPC & Section 8A(1), 125, 135, 136(2)(a) of Representation of
People Act, 1951
(1) Name should find place in the correct part of the electoral roll
(2) Name should not be included in the electoral roll in same/ any other part, of
same/any other constituency within the territory of India

(3) Right to vote is not exercisable if the elector is confined in a prison (under a
sentence of imprisonment or transportation or otherwise) or in the lawful
custody of the police except for those under preventive detention.
(4) They should not be subject to any disqualifications under applicable laws.
Service voters can be enrolled in the place where they would have been ordinarily
resident had they not been in service i.e., place of permanent address. They can
exercise their franchise either through postal ballot or proxy method. Their
application for inclusion in the relevant part of the roll and also information regarding
appointment of proxy voter, should be forwarded to CEO/DEO/ERO through proper
channel (the Head of their Department).
The relevant forms are available with the Service Heads. If no intimation regarding
the appointment of proxy is received by the Returning Officer latest by the last date of
filing nominations, prior to the conduct of elections, postal ballot will be
automatically sent to them.
i) The ECI has permitted proxy voting for the Classified Service Voters,
viz. Army, Navy, Air Force and Para Military Forces. The proxy should
be a registered elector of the same constituency.
ii) Wives of such service voters are not entitled for this facility.
iii) The Classified Service Voter (CSV) will be identified by the voters CSV
against their names in the last part of the Electoral Roll.
iv) A sub-list of such CSVs will be sent to the polling station concerned.
v) For the person voting as a proxy, indelible ink should be marked in the
left middle finger. A proxy voter can cast two votes - one his or her own
vote against his or her own identity and another for the person for whom
he/she is appointed as proxy.

(iv) Voting by postal ballot paper
Facility of voting by Postal Ballot Paper is available to following categories of voters.
Under rule 18 of the conduct of Elections Rules:
A. For voters at an election in a Parliamentary or Assembly Constituency
i) Special voters
ii) Service Voters
iii) Voters on Election Duty
iv) Electors subjected to preventive detention
B. For voters at an election in a Council Constituency
i) Voters on election duty
ii) Electors subject to preventive detention
iii) Electors in whole or specified parts of the constituency as directed by the
Election Commission in this behalf under clause (b) of rule 68.
Applicants for postal ballot should apply in Form 12 to the Returning Officer at least
10 days before actual date of the poll for postal ballot paper.
For Service Voters, the Postal Ballot Papers will be despatched within 48 hours from
the withdrawal of candidature to their destination.
C. For an election by nominating members
i) Elections subject to preventive detention and
ii) All elections as directed by the Election Commission in this behalf under
clause (a) of Rule 68.

C. Mode of publication of electoral roll, claims and objections and polling
stations.
(i) During the period for filing claims and objections during the revision period the
Electoral Registration Officer causes to be published in all designated locations
on a daily basis, the following:
Consolidated list of Forms 8A received for transposition in Form 11A for public
inspection and raising of objections.
(ii) The draft as well as the final electoral rolls are published in EROs’ and AEROs’
offices and designated centres (mostly polling stations, post offices etc) during
summary revision. Draft rolls are usually published in November and final
rolls in January/February - in order to facilitate inspection by public. The same
is done during the period notified for the purpose during intensive revision. The
supplementaries created during continuous revision, if any, also will be
published along with the draft publication.
(iii) 2 copies (one hard and one soft copy) of the draft as well as the final electoral
rolls will be given to all recognized political parties by the Electoral
Registration Officer during the revision process.
The Returning Officer will also furnishes the recognised political parties with the list
of polling stations in English and the local language before every election.

(iv) Each contesting candidate shall be given a copy of the latest electoral roll by the
Returning Officer, once the list of contesting candidates is finalized.
(v) The electoral rolls of all assembly constituencies are updated during last
summary revision are also available in the website www.ceoandhra.nic.in.
They are available in the formats - Polling Station wise pdf format and search
facility format.
A certified copy of an entry of the name of person/persons in the current Electoral Roll
will be issued by the Electoral Registration Officers concerned on request made by the
individual. For the copies of the Electoral Roll which relates to previous years, the
individual should apply to Chief Electoral Officer and he will issue orders to the
Electoral Registration Officers concerned to give the extracts of previous Electoral
Rolls after obtaining it from the State Archives Tarnaka, Hyderabad.The individual on
payment of prescribed fee, collects the extract of the previous years’ Electoral Rolls.
(vii) The copies of the Electoral Rolls available with the Electoral Registration
Officers. They may be obtained on demand by the public / political parties on
payment of the fees as detailed below:

After the inclusion of name in the Electoral Roll of the concerned Assembly
Constituency, the elector will be eligible for issue of Photo Identity Card. For the first
time, provided other formalities are completed, the card will be issued free of cost.
E. Conduct of elections
The Election Commission may appoint one or more persons, officer of Government or
a Local Authority to assist any Returning Officer in the performance of his functions.
It should be the general duty of the Returning Officer at any election to do all such acts
and things as may be necessary for effectively conducting the election in the manner
provided by the Act and Rules or orders made there under.

(i) Qualifications and Disqualifications for Election
• makes and subscribes before some person authorized in that behalf by the
Election Commission of India as Oath or affirmation according to the form set
out for the purpose in the 3rd Schedule.
• To contest for a seat in the Council of States, he / she should not be less than 30
years of age and, for the Lok Sabha not less than 25 years of age.
• A person shall not be qualified to be chosen to fill a seat in the House of the
People unless, in the case of a seat reserved for the Scheduled Castes /
Scheduled Tribes in any State, he / she is a member of any of the Scheduled
Castes or of any of the Scheduled Tribes as the case may be, whether of that
State or of any other State, and
• Is an elector for any Parliamentary Constituency, and in the case of any other
seat (i.e. a seat which is not reserved), he / she is an elector for any
Parliamentary Constituency.

• In the case of any other seat (i.e. a seat which is not reserved), he / she is an
elector for any Assembly Constituency in that State.
• A person shall be disqualified for being chosen as, and for being a member of
either House of Parliament:-
a) if he / she holds any office of profit under the Government of India or the
Government of any State, other than an office declared by Parliament by law
not to disqualify its holder;
The provisions for qualification and disqualification for membership of the State
Legislature are similar except that the Office of Profit should have been so declared by
law by the State Legislature instead of the Parliament as not disqualifying its holder.

4. ELECTION OF PRESIDENT / VICE PRESIDENT
(c) unless he / she is qualified for election as a member of the House of the People
(d) unless he / she does not held any office of profit under the Government of India
or the Government of any State or under any local or other authority subject to
the control of any of the said Governments.
Explanation – A person shall not be deemed to hold any office of profit by reason only
that he / she is the President or the Vice-President of the Union or the Governor of any
State or is either for the Union or for any State.
Election as Vice-President
The qualifications for election as Vice-President are the same as for the President
except that the Vice-President should be qualified for election as a member of the
Council of States (instead of the House of the People).

5. DISQUALIFICATIONS FOR MEMBERS OF PARLIAMENT AND
STATE LEGISLATURES
“Disqualified” means disqualified for being chosen as, and being, a member of either
House of Parliament or of the Legislative Assembly or Legislative Council of a State.
Disqualification on conviction for certain offences
According to Section 8 of the Representation of the People Act, 1951,
(1) a person convicted of an offence punishable under –
(a) Indian Penal Code
Section 153A Offence of promoting enmity between different
groups on ground of religion, race, place of birth,
residence, language, etc. and doing acts prejudicial
to maintenance of harmony or
Section 171E Offence of bribery or
Section 171F Offence of undue influence or personation at an
election or
Sub-section (1) or (2) of Offences relating to rape or
Section 376 or 376A or
376B or 376C or 376D
Section 498A Offence of cruelty by husband or relative of a
husband or
Sub-section (2) or (3) of Offence of making statement creating or
Section 505 promoting enmity, hatred or ill-will between
classes or offence relating to such statement in any
place of worship or in any assembly engaged in the
performance of religious worship or religious
ceremonies; or
(b) The Protection of Civil Which provides for punishment for the
Rights Act, 1955 preaching and practice of “untouchability” and for
the enforcement of any disability arising there
from; or
(c) Section 11 of the Offence of importing or exporting prohibited
Customs Act, 1962 goods; or
(d) Sections 10 to 12 of the Offence of being a member of an association
Unlawful Activities declared unlawful I offence relating to
(Prevention) Act, 1967 contravention of an order made in respect of a
notified place; or

(e) The Foreign Exchange
(Regulation) Act, 1973; or
(f) The Narcotics Drugs and
Psycho tropic Substances
Act, 1985; or
(g) The Terrorists and
Disruptive Activities
(Prevention) Act, 1987

Section 2 Offence of insulting the Indian National Flag or
the Constitution of India or
Section 3 Offence of preventing singing of National Anthem
shall be disqualified for a period of 6 years from
the date of such conviction. (The quantum of
punishment is immaterial).
(2) A person convicted for the contravention of :-
(a) any law providing for the prevention of hoarding or profiteering; or
(b) any law relating to the adulteration of the food or drugs; or
(c) any provisions of the Dowry Prohibition Act, 1961; or
(d) any provisions of the Commission of Sati (Prevention) Act, 1987

and sentenced to imprisonment for not less than 6 months, shall be disqualified from
the date of such conviction and shall continue to be disqualified for a further period of
6 years since his release.
(3) A person convicted of any offence and sentenced to imprisonment for not less
than 2 years (other than an offence referred to in subsection (1) or sub-section (2)
above), shall be disqualified from the date of such conviction and shall continue to be
disqualified for a further period of 6 years since his release.
According to Section 8A of the Act, the case of every person found guilty of a corrupt
practice by an order under Section 99 of the Representation of the People Act, 1951
(made by the High Court at the conclusion of the trial of an Election Petition in case
where a charge is made in an Election Petition of any corrupt practice having been
committed at an election), shall be submitted, as soon as may be, after such order takes
effect, by such authority as the Central Government may specify in this behalf, to the
President for determination of the question as to whether such person shall be
disqualified and if so, for what period. Provided that the period for which any person
may be disqualified shall in no case exceed 6 years from the date on which the order
made in relation to him under Section 99 takes effect.

(The Central Government has specified :-
(a) in relation to an election to the House of the People or the Council of States, the
Secretary-General of the House of the People or the Council of States, as the
case may be, and
Before giving his decision on any question indicated above, the President / Governor
shall obtain the opinion of the Election Commission and shall act according to such
opinion.
According to Section 9 of the Act, a person who having held an office under the
Government of India or under the Government of any State has been dismissed for
corruption or for disloyalty to the State shall be disqualified for a period of 5 years
from the date of such dismissal. For this purpose, a certificate issued by the Election
Commission to the effect that a person having held office under the Government of
India or under the Government of any State has or has not been dismissed for
corruption or for disloyalty to the State shall be conclusive proof of that fact. Provided
that no certificate to the effect that a person has been dismissed for corruption or for
disloyalty to the State shall be issued unless an opportunity of being heard has been
given to the said person.

Disqualification for Government contracts, etc.
According to Section 9A of the Act, a person shall be disqualified if, and so long as,
there subsists a contract entered into by him in the course of his trade or business with
the appropriate Government for the supply of goods to, or for the execution of any
works undertaken by, that Government.
According to Section 10 of the Act, a person shall be disqualified if, and so long as, he
is a managing agent, manager or secretary of any company or corporation (other than a
co-operative society) in the capital of which the appropriate Government has not less
than 25% share.
According to Section 10A of the Act, if the Election Commission is satisfied that a
person :-
(a) has failed to lodge an account of election expenses within the time and in the
manner required by or under the Act, and
(b) has no good reason or justification for the failure, the Election Commission
shall, by order published in the Official Gazette, declare him to be disqualified
and any such person shall be disqualified for a period of 3 years from the date of
the order.
According to Section 77 of the Representation of Peoples Act 1951- read with Rule 90
of the Conduct of Election Rules 1961.

(1) every candidate in an election shall, either by himself or by his election agent,
keep a separate and correct account of all expenditure in connection with the
election incurred or authorized by him or by his election agent between the date
on which he has been nominated and the date of declaration of the result
thereof, both dates inclusive.
(2) The account shall contain particulars such as expenditure incurred on vehicles,
meetings, publicity, etc.,
(3) The total of the said expenditure shall not exceed ceiling limit of Rs.25 lakhs in
the case of Parliament and Rs.10 lakhs in the case of Legislative Assembly.

6. NOMINATION OF CANDIDATES
For nomination, a candidate has to make deposit as indicated below:-

Refund of deposit:
Under section 158 of the Representation of Peoples Act 1951, the deposit amount will
be returned if the candidate receives more than one-sixth of the total number of valid
votes polled.
Proposers in nomination form:
Under Section 33 of the Representation of the People Act, 1951, in respect of
candidates set up by recognized political parties, it should be subscribed by the elector
of the constituency as proposer.
In the case of candidate not set up by recognized political party, it should be subscribed
by 10 electors of this constituency as proposer.
Documents to be submitted along with nomination:
1. Affidavit (Stamp paper value Rs.20/-)
(Details about conviction, cases pending in courts)
2. Affidavit in Form 26
3. Form A & B in case of recognized and registered political parties.
4. Certified copy of Electoral Roll if he is a voter of another constituency
Registration of new political party:
New political party can be registered with the Election Commission of India under
Section 29A of the Representation of the People Act, 1951 in the prescribed proforma.
The proposal should be sent to the Secretary, Election Commission of India,
Nirvachan Sadan, Ashoka Road, New Delhi 110 001.
Election Petition
Under Chapter II of Part II of the Representation of Peoples Act 1951, any election can
be called in question only through any Election Petition which should be filed before
the High Court within 45 days from the date of declaration of results.

7. DUTIES OF DISTRICT ELECTION OFFICERS /
RETURNING OFFICERS
(i) Duties of DEOs with relation to elections
(1) Selection (and, at the appropriate time, setting up) of polling stations, with prior
approval of the Election Commission.
(2) Formation of polling parties and appointment of Presiding Officer and Polling
Officers for each polling station;
(3) Imparting intensive training to the polling personnel (including those on
reserve duty)
(4) Building awareness about the use and working of Electronic Voting machine
among the general public, political parties, candidates and media
(5) Printing of postal ballot papers for service voters and their dispatch to the
service voters
(6) Scrutiny of accounts of election expenses of contesting candidates and
submission of returns to the Commission
(7) Safe custody of all voting machines, election papers and election materials after
the completion of election and during the period specified for the purpose
(ii) Outlines of duties of a Returning Officer
(1) drawing up, well in advance, a programme and plan of detailed
arrangements for the poll;
(2) procurement of voting machines and all election materials in sufficient
quantity
(3) issue of public notice of election in Form 1 of the Conduct of Elections Rules,
1961 on the day on which the notification calling the election is issued
(4) receiving of nomination papers, security deposits, etc.
(5) administration of oath or affirmation to candidates after they have filed their
nomination papers
(6) dissemination of information contained in the affidavits filed by the candidates
(7) scrutiny of nomination paper

(8) recording of reasons in brief for rejecting any nomination paper
(9) receipt of notices for withdrawal of candidature
(10) allotment of symbols to contesting candidates
(11) preparation and publication of notice of nominations, list of validly nominated
candidates and list of contesting candidates
(12) assessing the requirements of (i) ballot papers for use in the balloting units of
the voting machines (ii) postal ballot papers for service voters and voters on
election duty, etc and (iii) tendered ballot papers and arranging the printing and
supply thereof;
(13) preparing the lists of classified service voters who have appointed proxy voters
(14) establishing contact with the contesting candidates and political parties to
ensure free, fair and smooth election
(15) convening of meeting to discuss common problems relating to conduct of
election, review of law and order situation, enforcement of code of conduct for
political parties, etc;
(16) preparation and commissioning of voting machines about one week in advance
before the date of poll
(17) transport arrangements for voting machines and election materials
(18) dispatch of polling materials for the conduct of poll and supply of voting
machines, tendered ballot papers
(19) effective supervision of the poll
(20) appointment of counting staff
(21) transport and storage of voting machines after the poll, under strict security
arrangements
(22) fixing of date, time and place of counting and actual counting of votes
(23) declaration of result
(24) transportation of all voting machines, election papers and election materials
after declaration of results, to the District Election Officer for safe custody
(25) overall supervision of election work

20. DELIMITATION COMIISSION, 2002.
1. Constitution of the Commission:
An Act was passed by the Parliament called “The Delimitation Act, 2002 (No.33 of
2002)” and the same was published in the Extraordinary Gazette dated 4.6.2002.
Pursuant to the above Act, the Central Government constituted a Commission called
“Delimitation Commission”.
The Delimitation Commission was constituted with Mr. Justice Kuldip Singh, retired
Judge of the Supreme Court of India as the Chairman; Election Commissioner as
Member and the State Election Commission as Ex-officio Member for the
delimitation of constituencies.
The Delimitation Commission commenced functioning with effect from 16.7.2002.
It has requested all the States/Union Territories to send the Population Data and Maps
of the State/District/Mandals/Municipalities on the basis of 2001 Census. The
Commission has also sent a list of 10 persons nominated as Associate Members. Out
of the ten five are Members of Parliament nominated by the Speaker of the Lok Sabha
and five are Members of A.P.Legislative Assembly nominated by the Speaker of the
Andhra Pradesh Legislative Assembly. The following are the particulars of the

II. Objective of the Constitution of the Commission:
The objective of the constituting the Delimitation Commission is to readjust the
division of each State into territorial Constituencies for the purpose of elections to the
Parliament and the Assembly constituencies as per the Census Data of 2001 in the
State and to fix the number of seats to be reserved for the SCs and the STs of the State.

The Commission so constituted shall determine its own procedure in the performance
of its functions and have all the powers of a civil court under Code of Civil Procedure,
1908 while trying a suit, in respect of the following matters:
1. Summoning and enforcing the attendance of witnesses.
2. requiring the production of any document; and
3. requisitioning any public record from any court or office.
IV. Methodology:
After readjustment of division of the State into territorial Constituencies, the
Delimitation Commission shall --
a) publish its proposals for the delimitation of constituencies, together
with the dissenting proposals, if any, of any Associate Member who desires
publication thereof, in the Gazette of India and in the official Gazette of all the
States concerned and also in such other manner as it thinks fit;
b) Specify the date on or after which the proposals shall be further considered by it;
c) Consider all objections and suggestions which may have been received by it
before the date so specified, and for the purpose of such consideration, hold one
or more public sittings at such place or places in each State as it thinks fit; and
thereafter by one or more orders determine the delimitation of Parliamentary
Constituencies and the delimitation of Assembly Constituencies of each State.
V. Data Collection:
As far as Andhra Pradesh is concerned, information has been gathered in full from 22
districts and from the Municipal Corporation of Hyderabad, (representing Hyderabad
district) and on receipt of the same, the Commission has formulated the Draft Working
Paper for the division of the State into Assembly and Parliamentary Constituencies on
the basis of 2001 Census Data.
VI. MEETINGS.
The Delimitation Commission held number of meetings between 2005 and 2007 with
Associate Members and with the concerned officers and discussed the draft working
paper circulated by the Commission. Subsequently, on the basis of the discussions, a
draft final paper was prepared along with dissent proposals submitted by the Associate
Members and published in the Extraordinary Gazette at New Delhi and also
republished the same in the A.P.State Gazette extraordinary on 22.1.2007.
On the basis of the objections and suggestions received for the draft final paper, the

Commission held public meetings at Tirupati, Visakhapatnam and Hyderabad on 6th,
8th and 9th & 10th March, 2007 respectively. After completion of the public hearings
and a final meeting with Associate Members, the final notification was published in
the extraordinary gazette at New Delhi and also in the extraordinary gazette in Andhra
Pradesh on 31st May, 2007.
VII. SUMMARY:
The number of seats remains the same at 294 Assembly seats and 42 Parliamentary
seats. The number of seats in the Assembly for SCs has increased from 39 to 48 and
the number of ST seats has increased from 15 to 19. The number of seats for SCs in
Parliament from Andhra Pradesh has increased from 6 to 7. The number of seats for
STs in the Parliament from Andhra Pradesh State continues to be 3.
The following is district wise statement of the existing and proposed, ACs and
reserved seats for SCs and STs.

21. OTHER GENERAL INFORMATION
Under Article 324 of the Constitution of India, the Election Commission of India
vested with powers the superintendence, direction and control of the preparation of
Electoral rolls as well as conduct of elections to Parliament and Legislature of every
State and to the offices of President and Vice-President of India.
