The National Labor Relations Board, by a three-member panel, has considered objections to an election held May 29, 2013, and the Regional Directors report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 10 votes for and 5 votes against the Petitioner, with no challenged ballots. The Board has reviewed the record in light of the exceptions and brief, has adopted the Regional Directors findings and recommendations,1 and finds that a certification of representative should be issued.

In the absence of exceptions, we adopt pro forma the Regional Directors recommendation to overrule Employers Objections 2, 4, and 5.

CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for International Association of Machinists and Aerospace Workers, District Lodge 15, and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit:

All full-time and regular part-time technicians, service advisors, parts department countermen and parts department drivers employed by the Employer at its 79 Cedar Swamp Road and 24 Garveys Point Road locations, but excluding all sales employees, office clericals, porters, lot attendants, car washers, parts department managers, service department assistant managers, guards and supervisors as defined in the Act.
