Requirements for the use of portable tanks.

(a) General requirements. No person may offer a hazardous material for transportation in a portable tank except as authorized by this subchapter. (1) Except as otherwise provided in this subpart, no person may use a portable tank for the transportation of a hazardous material unless it meets the re uirements of this subchapter. (!) No person may fill and offer for transportation a portable tank when the prescribed periodic test or inspection under subpart " of part 1#$ of this subchapter has become due until the test or inspection has been successfully completed. %his re uirement does not apply to any portable tank filled prior to the test or inspection due date. (&) 'hen a portable tank is used as a car(o tank motor vehicle, it must conform to all the re uirements prescribed for car(o tank motor vehicles. ()ee *1+&.&&.) (b) Substitute packagings. , particular )pecification portable tank may be substituted for another portable tank as follows(1) ,n ./ or 0N portable tank may be used whenever an ./ or 0N portable tank havin( less strin(ent re uirements is authorized provided the portable tank meets or exceeds the re uirements for pressure1relief devices, bottom outlets and any other special provisions specified in *1+!.1$!(c)(+)(vi) of this subchapter. (!) 'here a )pecification ./1$1 or ./1$! portable tank is prescribed, a 0N portable tank or )pecification 21 portable tank otherwise conformin( to the special commodity re uirements of *1+!.1$!(c)(+) of this subchapter for the material to be transported may be used. (&) , 34% )pecification 21 portable tank may be used whenever a 34% )pecification 25, 2+, or 5$ portable tank is authorized. , 34% )pecification 5$ portable tank may be used whenever a 34% )pecification 25 or 2+ portable tank is authorized. , hi(her inte(rity tank used instead of a specified portable tank must meet the same desi(n profile6 for example, a 34% )pecification 21 portable tank must be lined if used instead of a lined 34% )pecification 5$ portable tank. (7) , portable tank authorized by the %ransport 8anada %3" 9e(ulations (.:9, see *1+1.+ of this subchapter) may be used provided it conforms to the applicable re uirements in *1+1.1! of this subchapter. (c) Grandfather provisions for portable tanks;(1) Continued use of Specification 56 and 57 portable tanks. 8ontinued use of an existin( portable tank constructed to 34% )pecification 25 or 2+ is authorized only for a portable tank constructed before 4ctober 1, 1<<5. , stainless steel portable tank internally lined with polyethylene that was constructed on or before 4ctober 1, 1<<5, and that meets all re uirements of 34% )pecification 2+ except for bein( e uipped with a polypropylene dischar(e ball valve and polypropylene secondary dischar(e openin( closure, may be marked as a )pecification 2+ portable tank and used in accordance with the provisions of this section. (!) , 34% )pecification 21, ./ 1$1, or ./ 1$! portable tank may not be manufactured after =anuary 1, !$$&6 however, such tanks may continue to be used for the transportation of a hazardous material provided they meet the re uirements of this subchapter, includin( the specification re uirements and the re uirements of this subchapter for the transportation of the particular hazardous material accordin( to the % codes in effect on )eptember &$, !$$1 or the new % codes in *1+!.1$!(c)(+)(i), and provided the portable tanks conform to the periodic inspection and tests specified for the particular portable tank in subpart " of part 1#$ of this subchapter. ,fter =anuary 1, !$$&, all newly manufactured portable tanks must conform to the re uirements for the desi(n, construction and approval of 0N portable tanks as specified in **1+#.!+&, 1+#.!+7, 1+#.!+2, 1+#.!+5, 1+#.!++ and part 1#$, subpart ", of this subchapter. (&) , 34% )pecification portable tank manufactured prior to =anuary 1, 1<<! that is e uipped with a non1reclosin( pressure relief device may continue in service for the hazardous materials for which it is authorized. Except for a 34% )pecification 25 or 2+ portable tank, a 34% )pecification portable tank manufactured after =anuary 1, 1<<!, used for materials meetin( the definition for 3ivision 5.1 li uids, >ackin( "roup . or .., 8lass ! (ases, or 8lass & or 7 li uids, must be e uipped with a reclosin( pressure relief valve havin( ade uately sized ventin( capacity unless otherwise specified in this subchapter (see **1+#.!+2(f)(1) and 1+#.!++ of this subchapter). (7) ,ny portable tank container constructed prior to /ay 12, 1<2$, complyin( with the re uirements of either the ,)/E 8ode for 0nfired >ressure ?essels, 1<75 Edition, or the ,>. ,)/E 8ode for 0nfired >ressure ?essels, 1<7& Edition, may be used for the transportation of li uefied compressed (as, provided it fulfills all the re uirements of the part and specifications for the particular (as or (ases to be transported. )uch portable tanks must be marked @.88 )pecification 21AB on the plate re uired by the specification, except as modified by any or all of the followin((i) >ortable tanks desi(ned and constructed in accordance with >ars. 015#, 015<, or 01!$1 of the ,)/E 8ode, 1<7& and 1<75 editions, may be used. >ortable tanks desi(ned and constructed in accordance with >ar. 015# or >ar. 01 5< may be re1rated at a workin( pressure !2 percent in excess of the desi(n pressure for which the portable tank was ori(inally constructed. .f the portable tank is re1rated, the re1rated pressure must be marked on the plate as follows- @9e1rated workin( pressure;psi(B. (ii) Coadin( and unloadin( accessories, valves, pipin(, fittin(s, safety and (au(in( devices, do not have to comply with the re uirements for the particular location on the portable tank. (2) ,ny .88 )pecification 2$ portable tank fulfillin( the re uirements of that specification may be continued in service for transportation of a li uefied petroleum (as if it is retested every five years in accordance with the re uirements in *1#$.5$2 of this subchapter. 0se of existin( portable tanks is authorized. New construction is not authorized. (d) Determination of an authorized portable tank. >rior to fillin( and offerin( a portable tank for transportation, the shipper must ensure that the portable tank conforms to the authorized specification and meets the applicable re uirements in this subchapter for the hazardous material. %he shipper must ensure that the /,'>, desi(n pressure or test pressure of the portable tank, as applicable, is appropriate for the hazardous material bein( transported. 3etermination of the applicable pressure must take into account the maximum pressure used to load or unload the hazardous material, the vapor pressure, static head and sur(e pressures of the hazardous material and the temperatures that the hazardous material will experience durin( transportation. (e) !ternal inspection prior to filling. Each portable tank must be (iven a complete external inspection prior to fillin(. ,ny unsafe condition must be corrected prior to its bein( filled and offered for transportation. %he external inspection shall include a visual inspection of-

(1) %he shell, pipin(, valves and other appurtenances for corroded areas, dents, defects in welds and other defects such as missin(, dama(ed, or leakin( (askets6 (!) ,ll flan(ed connections or blank flan(es for missin( or loose nuts and bolts6 (&) ,ll emer(ency devices for corrosion, distortion, or any dama(e or defect that could prevent their normal operation6 (7) ,ll re uired markin(s on the tank for le(ibility6 and (2) ,ny device for ti(htenin( manhole covers to ensure such devices are operative and ade uate to prevent leaka(e at the manhole cover. (f) "oading requirements. (1) , hazardous material may not be loaded into a portable tank if the hazardous material would(i) 3ama(e the portable tank6 (ii) 9eact with the portable tank6 or (iii) 4therwise compromise its product retention capability. (!) , hazardous material may not be loaded in a 34% )pecification 21, 34% )pecification 5$, an ./ or 0N portable tank unless the portable tank has a pressure relief device that provides total relievin( capacity meetin( the re uirements of this subchapter. (&) Except durin( a pressure test, a portable tank may not be subDected to a pressure (reater than its marked maximum allowable workin( pressure or, when appropriate, its marked desi(n pressure. (7) , portable tank may not be loaded to a (ross mass (reater than the maximum allowable (ross mass specified on its identification plate. (2) Except for a non1flowable solid or a li uid with a viscosity of !,5#$ centistokes (millimeters s uared per second) or (reater at !$ E8 (5# EF), an ./ or 0N portable tank, or compartment thereof, havin( a volume (reater than +,2$$ C (1,<#$ (allons) may not be loaded to a fillin( density of more than !$G and less than #$G by volume. %his fillin( restriction does not apply if a portable tank is divided by partitions or sur(e plates into compartments of not more than +,2$$ C (1,<#$ (allons) capacity6 this portable tank must not be offered for transportation in an ulla(e condition liable to produce an unacceptable hydraulic force due to sur(e. (5) %he outa(e for a portable tank may not be less than !G at a temperature of 2$ E8 (1!! EF) unless otherwise specified in this subchapter. For 0N portable tanks, the applicable maximum fillin( limits apply as specified accordin( to the assi(ned %> codes in 8olumn (+) of the *1+!.1$1 %able of this subchapter except when transported domestically. (+) Each tell1tale indicator or pressure (au(e located in the space between a fran(ible disc and a safety relief valve mounted in series must be checked after the tank is filled and prior to transportation to ensure that the fran(ible disc is leak free. ,ny leaka(e throu(h the fran(ible disc must be corrected prior to offerin( the tank for transportation. (#) 3urin( fillin(, the temperature of the hazardous materials shall not exceed the limits of the desi(n temperature ran(e of the portable tank. (<) %he maximum mass of li uefied compressed (as per liter ((allon) of shell capacity (k(HC or lbs.H(al.) may not exceed the density of the li uefied compressed (as at 2$ E8 (1!! EF). %he portable tank must not be li uid full at 5$ E8 (17$ EF). (() #dditional requirements for specific modal transport. .n addition to other applicable re uirements, the followin( apply(1) , portable tank containin( a hazardous material may not be loaded onto a hi(hway or rail transport vehicle unless loaded entirely within the horizontal outline of the vehicle, without overhan( or proDection of any part of the tank assembly. (!) ,n ./ or 0N portable tank used for the transportation of flammable li uids by rail may not be fitted with non1 reclosin( pressure relief devices except in series with reclosin( pressure relief valves. (&) , portable tank or )pecification 1$5, or 11$, multi1unit tank car containin( a hazardous material may not be offered for transportation aboard a passen(er vessel unless(i) %he vessel is operatin( under a chan(e to its character of vessel certification as defined in *1+1.# of this subchapter6 and (ii) %he material is permitted to be transported aboard a passen(er vessel in the *1+!.1$1 %able of this subchapter. (h) #dditional general commodit$%specific requirements. .n addition to other applicable re uirements, the followin( re uirements apply(1) Each uninsulated portable tank used for the transportation of a li uefied compressed (as must have an exterior surface finish that is si(nificantly reflective, such as a li(ht1reflectin( color if painted, or a bri(ht reflective metal or other material if unpainted. (!) .f a hazardous material is bein( transported in a molten state, the portable tank must be thermally insulated with suitable insulation material of sufficient thickness that the overall thermal conductance is not more than $.$#$ :tu per hour per s uare foot per de(ree Fahrenheit differential. (&) No person may offer a li uid hazardous material of 8lass &, >" . or .., or >" ... with a flash point of less than 1$$ EF (&# E8)6 3ivision 2.1, >" . or ..6 or 3ivision 5.1, >" . or .., in an ./ or 0N portable tank that is e uipped with a bottom outlet as authorized in 8olumn (+) of the *1+!.1$1 %able of this subchapter by assi(nment of a % 8ode in the appropriate proper shippin( name entry, for unloadin( to a facility while it remains on a transport vehicle with the power unit attached unless; (i) %he tank outlets conform to *1+#.!+2(d)(&) of this subchapter6 or (ii) %he facility at which the ./ or 0N portable tank is to be unloaded conforms to the re uirements in *1++.#&7(o) of this subchapter. (i) #dditional requirements for portable tanks other than &' specification and () portable tanks. (1) %he burstin( stren(th of any pipin( and fittin(s must be at least four times the desi(n pressure of the tank, and at least four times the pressure to which, in any instance, it may be subDected in service by the action of a pump or other device (not includin( safety relief valves) that may subDect pipin( to pressures (reater than the desi(n pressure of the tank. (!) >ipe Doints must be threaded, welded or flan(ed. .f threaded pipe is used, the pipe and pipe fittin(s must not be li(hter than )chedule #$ wei(ht. 'here copper tubin( is permitted, Doints must be brazed or be of e ually stron(

metal union type. %he meltin( point of brazin( material may not be lower than 1,$$$ EF (2&+.# E8). %he method of Doinin( tubin( must not decrease the stren(th of the tubin( such as by the cuttin( of threads. (&) Non1malleable metals may not be used in the construction of valves or fittin(s. (7) )uitable provision must be made in every case to allow for expansion, contraction, Darrin( and vibration of all pipe. )lip Doints may not be used for this purpose. (2) >ipin( and fittin(s must be (rouped in the smallest practicable space and must be protected from dama(e as re uired by the specification. (5) ,ll pipin(, valves and fittin(s on every portable tank must be leaka(e tested with (as or air after installation and proved ti(ht at not less than the desi(n pressure of the portable tank on which they are used. .n the event of replacement, all such pipin(, valves, or fittin(s must be tested in accordance with the re uirements of this section before the portable tank is returned to transportation service. %he re uirements of this section apply to all hoses used on portable tanks, except that hoses may be tested either before or after installation on the portable tank. (+) ,ll materials used in the construction of portable tanks and their appurtenances may not be subDect to destructive attack by the contents of the portable tank. (#) No aluminum, copper, silver, zinc nor their alloys may be used. :razed Doints may not be used. ,ll parts of a portable tank and its appurtenances used for anhydrous ammonia must be steel. (<) Each outlet of a portable tank used for the transportation of non1refri(erated li uefied compressed (ases, except carbon dioxide, must be provided with a suitable automatic excess1flow valve (see definition in *1+#.&&+1 1(() of this subchapter). %he valve must be located inside the portable tank or at a point outside the portable tank where the line enters or leaves the portable tank. %he valve seat must be located inside the portable tank or may be located within a welded flan(e or its companion flan(e, or within a nozzle or within a couplin(. %he installation must be made in such a manner as to reasonably assure that any undue strain which causes failure re uirin( functionin( of the valve shall cause failure in such a manner that it will not impair the operation of the valve. (i) , safety device connection or li uid level (au(in( device that is constructed so that the outward flow of the tank contents will not exceed that passed by an openin( of $.1&<+ cm ($.$22$ inches) is not re uired to be e uipped with excess1flow valves. (ii) ,n excess1flow valve must close automatically if the flow reaches the rated flow of (as or li uid specified by the ori(inal valve manufacturer when pipin( mounted directly on the valve is sheared off before the first valve, pump, or fittin( downstream from the excess flow valve. (iii) ,n excess1flow valve may be desi(ned with a by1pass, not to exceed a $.1$15 cm ($.$7$ inches) diameter openin( to allow e ualization of pressure. (iv) Fillin( and dischar(e lines must be provided with manually operated shut1off valves located as close to the tank as practical. 0nless this valve is manually operable at the valve, the line must also have a manual shut1off valve. %he use of @)top18heckB valves to satisfy with one valve the re uirements of this section is forbidden. For portable tanks used for refri(erated li uefied (ases, a @stop checkB valve may be used on the vapor side of the pressure buildup circuit. (1$) Each portable tank used for carbon dioxide or nitrous oxide must be la((ed with a suitable insulation material of such thickness that the overall thermal conductance is not more than $.$# :tu per s uare foot per de(ree Fahrenheit differential in temperature per hour. %he conductance must be determined at 5$ EFahrenheit. .nsulation material used on portable tanks for nitrous oxide must be noncombustible. (11) 9efri(eratin( or heatin( coils must be installed in portable tanks used for carbon dioxide and nitrous oxide. )uch coils must be tested externally to at least the same pressure as the test pressure of the portable tank. %he coils must also be tested internally to at least twice the workin( pressure of the heatin( or refri(eratin( system to be used, but in no case less than the test pressure of the portable tank. )uch coils must be securely anchored. .n the event of leaka(e, the refri(erant or heatin( medium to be circulated throu(h the coil or coils must have no adverse chemical reaction with the portable tank or its contents. (1!) Excess flow valves are not re uired for portable tanks used for the transport of refri(erated li uefied (ases.
