Box 1010 Middlebury, VT 05733 Via Electronic Mail RE: Access to Public Records Request for Good Point Recycling Dear Mr. Ingenthron: On September 27, 2013, you sent email correspondence to the Vermont Agency of Natural Resources (Agency), which included several requests for public records. Throughout the email were requests for documents pertaining to the Agencys evaluation and final determination of Good Point Recyclings (GPR) manufacturer opt-out individual plan proposal; documents and correspondence relating to the Agencys negotiations with Casella Waste Systems regarding the contract for implementation of the State Standard Plan (for recycling of electronic waste); and copies of the bids, submissions, and scoring documents for all the vendors who submitted proposals in response to the Agencys request for bid (RFP) for the upcoming ECycles program year. The Agency has determined that aforementioned documents request intend to seek records which are relevant to litigation to which the public agency is a party of record, and therefore, are exempt from public inspection and copying under 1 V.S.A. 317(c)(14). Specifically, the documents requested are relevant to the litigation commenced in part by GPR before the Vermont Superior Court, Washington Unit, of which the Agency is a party of record. You have a right to appeal this decision to withhold documents from public inspection and copying.
