RIVANNA SOLID WASTE AUTHORITY


STATEMENT REGARDING PENDING LAWSUIT

Charlottesville, VA (Monday, June 1, 2009) –The Rivanna Solid Waste Authority (Authority)
released a statement today in response to a recent radio talk show appearance by Mr. Peter van
der Linde in which Mr. van der Linde was critical of the Authority’s currently pending lawsuit
against him. The statement explained why the Authority believes it is inappropriate to address
the allegations of the suit until the facts are made public in a court of law, and urged the public
not to pre-judge the case on the basis of Mr. van der Linde’s comments.
The prepared statement is as follows:
“Evidence obtained by the Authority to date supports a claim that Container Rentals and
Mr. van der Linde have deprived the Authority of revenue in the form of service
contribution fees lawfully due to it. When the Authority’s revenues fall short of its
expenses, the City and County have by contract agreed to make up the shortfall through
taxpayer funds. Therefore, the Authority believes it is entirely appropriate to enforce its
rights to revenue due it rather than resorting to taxpayer funds, and the Authority will
continue to press its claim.
“The Authority also wishes to clarify that contrary to statements made by Mr. van der
Linde, the lawsuit is in no way related to Mr. van der Linde’s decision to operate a
recycling facility in Zion Crossroads. The Authority has already stated publicly and
reaffirms that the Authority is pleased to see the new recycling facility operating in the
area as an opportunity for further recycling of solid waste. The lawsuit is strictly about
enforcing the Authority’s right to funds owed to it over the past several years.
“The Authority believes that when the facts of the lawsuit are available to the public, at a
time determined by the court, the public will see the issue in a much different way than is
currently being presented by Mr. van der Linde, and believes the public will realize that
the Authority is properly representing the taxpaying citizens of Albemarle County and the
City of Charlottesville.”
