    Order Granting James' Motion to Proceed on Appeal in Forma Pauperis in Civil Action File No. 09A11175-3, titled Heritage Bank v. James Stegeman, a Personal Property Foreclosure case. Although the Court granted Heritage Bank Writ of Possession, and foreclosed on the RV for which James co-signed, but for which beginning June 2002 John C Joyner became responsible for, and April 2003 Frank J Lillig, III became responsible for, and our accounts were illegally seized, accessed, and spent and there was more than enough $ to pay the RV off, James and I got stuck with paying it. Heritage Bank has failed to even come and look at the RV. The foreclosure was an act of bad faith. Heritage obviously had no intention of taking possession of the RV, one has to assume they figured that, having already had a judgment against James on the foreclosure, that a jury would grant Heritage Bank the relief requested in the action on note. What they fail to realize is that having been representing ourselves in Court for so many years, we have learned a whole hell of alot. One thing we learned is that under GA law, the fact that there was a foreclosure, and the suits were piggy-backed into the Court, the instant action has become unpursuable under the Doctrine of Res Judicata

    ORDER ON AFFIDAVIT OF POVERTY AND


    MOTION TO APPEAL IN FORMA PAUPERIS

    The pro se Appellant has filed an Affidavit of Poverty along with Motion to

    Proceed on Appeal in Forma Pauperis. This Court has reviewed the Affidavit

    and Motion with attachments pursuant to O.C.G.A. § 9-15-2(d).

    ~FFIDA VIT APPROVED AND MOTION GRANTED - It appears to the

    Court that Appellant\Petitioner is unable to pay the costs associated with an


    Appeal. Therefore the Appellant's\Petitioner's Motion to Proceed on Appeal in
    Forma Pauperis is GRANTED and he is relieved from paying the fees related to
    Appeals including the document copying costs.

    o AFFIDA VIT NOT APPROVED AND MOTION DENIED - It appears that

    the Appellant\Petitioner is able to pay the fees to Appeal; therefore the Affidavit is
    not approved and Motion to Appeal in Forma Pauperis is denied.
    So Ordered and filed this ~ day of October, 2009.
