INSANITY (JUNUN) DEFINITION : A disease which a man possess no intelligence to conduct an act weakness of the limb.

INSANITY is divided into two : 1) continuous (muthbiq) 2) intermittent (ghair muthbiq) EFFECT ON THE CAPACITY OF OBLIGATION (ahliyyah al-Wujub kamilah) - It does not effect the capacity of obligation - Acquires financial rights & bear responsibilities because the basis for this capacity is humanity EFFECT ON THE CAPACITY OF EXECUTION (ahliyyah al-Ada naqisah) - Islamic law considers an insane person is incapable of administering his property and not responsible for what he says. Based on hadith: The actions of three categories of person are not accounted,for that is a sleeper until he wakes up,a minor until he attains sexual maturity and an insane person until he regains his sanity - All transactions entered into by an insane person are void whether the transaction is beneficial/harmful to him and whether it is permitted by his guardian - Insanity removed the capacity of execution because the basis for this capacity is intelligence without

IN THE CASE OF INTERMITTENT INSANITY (sometimes insane,sometimes not) - Any transaction being made by him is valid when he is not in the state of insane,when he is conscious. DISPOSITION OF AN INSANE PERSON (not valid) - In the act of worship, it is not obligatory for them - they are not liable to punishment

IMBECILITY (ATAH) DEFINITION : A person being deranged in mind that his understanding is weak,his speech confused and his plan of action is bad. Sometimes his acts resembles a normal person and sometimes his acts resembles an insane person. EFFECT ON THE CAPACITY OF OBLIGATION (ahliyyah al-Wujub kamilah) - It does not effect the capacity of obligation - Acquires financial rights & bear responsibilities because the basis for this capacity is humanity. EFFECT ON THE CAPACITY OF EXECUTION (ahliyyah al-Ada naqisah) - Imbelicity reduced the ruling on the capacity of execution - The law of discerning child being applied which he can enters into this three types of transactions : 1) purely beneficial for him such as accepting hadiah (valid) even without the permission of the guardian. 2) purely harmful such as giving hadiah (not valid) even with the permission of the guardian 3) revolve between what is beneficial and harmful (not valid) unless there is a permission from the guardian.
