NOTICE OF INTERLOCUTORY APPEAL

TO THE HONORABLE COURT:

Comes now Petitioner Caracas International Banking Corporation by and through

the undersigned attorneys and hereby appeals the Order to Show Cause issued on

November 5, 2009, Docket 6, the Order of November 6, 2009, Docket 12, and the Order of

November 6, Docket No. 15, which denied de facto the Bank’s request for injunctive relief.

Since the Court denied the TRO in its Order of November 6, 2009, Docket 15, and has

refused to schedule a hearing on the preliminary injunction, without giving any

consideration given to the requirements for granting such relief, including irreparable harm,

balance of potential harms, probability of success on the merits, and the public interest, an

immediate appeal is the only way to prevent further harm to the petitioner, which cannot

be remedied at law.
