Here, Dora reaches down to put a new Tort CD into her player and thus it can be inferred
she is not watching the road because to put a CD into her disc player she would have to
be looking at the slot to insert the disc. Paul will argue that Dora had intent because her
act of not looking at the road at an intersection which one can infer has a crosswalk
shows a substantial certainty that the results will occur since intersections are likely
spots for pedestrian crossing and not looking makes it substantially likey ones car would
swerve and thus swerve toward a pedestrian using the crosswalk. astly paul was
terrified because he saw Dora!s approaching car, which shows apprehension of
imminent hamful contract because the car was approaching and would likely soon hit
Paul and further being hit by a car is harmful.
Dora will argue she did not desire the touching and that she did not see him, however
intent is not only proven by desired results alone but also by knowledge of subtanital
certainty, and further the light is inferrably visible for a long distance, and was most likely
able to be seen prior to her reaching down and putting in the CD, thus she could have
anticipated the approaching intersection where pedestrians are likely to cross.
Dora is likely liable for assault.
