MODEL SERVICE CONTRACT

KNOW ALL MEN BY THESE PRESENTS:
This Service Contract made this ___ day of _______________, by and

.- That the AGENCY shall provide the EMPLOYER with the /0alified and
competent 1asambahay re/0ired by the EMPLOYER(
2- That the AGENCY shall provide a pre3employment orientation briefing
to the EMPLOYER AND KASAMBAHAY abo0t their rights and
responsibilities in accordance with 4aragraph d, Section 5, (0le !!! of
the !mplementing (0les and (eg0lations of (ep0blic %ct "o- .657. or
89atas 1asambahay:;
5- That the AGENCY) within one (.) month from the day the
1asambahay reported for wor;, shall provide the EMPLOYER a
/0alified replacement at no additional cost if any of the following
gro0nds occ0rred,

(a) The 1asambahay is fo0nd to be s0ffering from an inc0rable
or contagio0s disease or mental illness as certified by a
competent or government physician;
(b) The 1asambahay abandons the <ob witho0t <0stifiable
ca0se, vol0ntarily resigns, commits theft or any of the
analogo0s acts pre<0dicial to the employer or his/her family;
(c) The 1asambahay is physically or mentally incapable of
discharging the minim0m re/0irements of the <ob, as specified
in the employment contract;
That the AGENCY shall ref0nd to the EMPLOYER seventyfive percent
(=>?) of the fees paid if the former failed to provide a /0alified
replacement after the lapse of one (.) month from receipt of the
re/0est for replacement;
The EMPLOYER shall be entitled to three (5) replacements d0ring the
entire period of this contract-
%ny re/0est for replacement after the first month shall be s0b<ected to
an additional minim0m service fee of twenty3five percent (2>?) of the
agreed service fee- @oreover, if the wor;er escapes, commits theft, or
any other acts pre<0dicial to the employer, the same facts or
circ0mstances shall be stated in an affidavit to be eAec0ted by the
employer and s0bmitted to the agency before any replacement shall
be provided by the agency-
B- That the AGENCY shall be <ointly and solidarily liable with the
EMPLOYER for payment of wages, wage related and other benefits,
incl0ding monthly contrib0tion for SSS, 4hilhealth and 4ag3!9!'
membership of the ;asambahay, in case the latter fails to comply with
the aforementioned obligations;
S0ch liability of the agency is co3termin0s with the eAistence of the d0ly
signed Service Contract between the agency and employer-

9- Duties and Respnsi!i"ities # t$e E*p"'e+
.- That the EMPLOYER, 0pon the commencement of this Contract, shall
ca0se the payment to the AGENCY of a service fee amo0nting to

deployment eApenses amo0nting to

incl0de cost of transportation, meals, comm0nication and other
incidental eApenses s0b<ect to presentation of receipts;

B- That the EMPLOYER shall pay the monthly salary of the 1asambahay
in cash at least once a month and all the benefits as provided for by
law;

monthly pay slip and copies of proof of remittances with the SSS, 4ag3

7- That the EMPLOYER shall provide the ;asambahay medical
assistance in the form of first aid medicines, in case of illness and
in<0ries s0stained d0ring the service witho0t loss of benefits; and

termination of employment, the EMPLOYER shall endorse the
1asambahay to the AGENCY for acco0nting of wage and other wage3
related benefits which may still be d0e and payable to the
1asambahay as well as the remittances with the SSS, 4ag3ibig, and
4hilhealth-
C- The terms and conditions of this CONTRACT shall not be modified or
amended by either party witho0t the conc0rrence of the other party-
