Photo Session Agreement

Tis contract sets forth the agreement between___________________________
(hereinafer referred to as Client)and Stephanie OConnell conducting business as OCon-
nell Occasions Photography(hereinafer referred to as Photographer), in the State of Indi-
ana, relating to photography services.
1. Sitting Fee, Payment Terms and Conditions: Te sitting fee will cover up to 2-hours of
service(also referred to as session). Te session time begins when the photographer arrives
at the location. A 50% non-refundable deposit is required to reserve the session date. Te
Client shall pay in full the remaining balance of $__________ sitting fee and any additional
services incurred by the day the photography services are rendered at the end of the photog-
raphy session. Payment must be made using CASH or PERSONAL CHECK(there is a $40
check recovery fee for all returned checks).

2. Cancellation Policy: Client understands that if the event is cancelled\postponed, the de-
posit is nonrefundable. Photographer will make every efort to accommodate postponements
as long as there are no scheduling conficts.
3. NOTICE OF COPYRIGHT and Reproduction: All images and copyrights are the property
of Stephanie OConnell. Stephanie OConnell retains the right to copy, display and/or publish
any/all images created under this agreement, to the general public, for any reason, including
but not limited to: advertising, marketing, sales, print competitions, educational seminars,
and monetary gain. Te mediums for display could include newspapers, magazines, books,
television, and the internet, but are not limited to only those mediums. Te photographer
retains these rights even if image fles are provided to the client.
4. Completion of Pictures: Client understands that under normal circumstances portrait
pictures should be available within 21 business days afer the date of photography session.
Te images will be given to the Client on CD. Te Client may choose where to order prints,
quality photos are best acquired through a professional print lab. Te Photographer is not
responsible for quality/result of prints.
5. Clients Usage: Te Client is obtaining prints for personal use only, and shall not sell said
prints or authorize any reproductions thereof by parties other than the Photographer. Te Cli-
ent will not edit or manipulate the photographs in any way. it is a violation of federal copyright
law to allow photographs created by Stephanie OConnell to be digitally reproduced, copied, or
scanned without written permission. Any use for general public or for monetary gain will be
considered copyright infringement. Te Client must obtain written permission from Stephanie
OConnell and compensate Stephanie OConnell prior to the Client or their friends and family
publishing or selling the photographs for proft.
6. Limited Liability: If the Photographer cannot perform this Agreement due to a fre or other
casualty, strike, act of nature or other cause beyond the control of the parties involved(including
inclement weather), or due to illness of Photographer, then any deposit will be returned to the
Client but the Photographer shall have no further liability with respect to the Agreement. If
the Client wishes, another sitting session can be scheduled. Tis limitation on liability shall also
apply in the event that photographic materials are damaged in processing, lost through camera
malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the
photographer. In such cases of outside circumstances, the Photographer is not liable and the
Client shall only be entitiled to a refund of thier deposit and sitting fee(if paid to the
Photographer).
7. Digital Files: Upon receipt of a photo CD, clients accepts all responsibility for archiving and
protecting the photographs. Te Photographer does not permanently archive image fles
(images are archived for 12-months only). Te Photographer is not responsible for the lifespan
of any digital media provided or for any future changes in digital technology or media readers
that might result in an inability to read discs provided. It is Clients responsibility to make sure
that digital fles are copied to new media as required.
8. Miscellaneous: Tis Agreement incorporates the entire understanding of the parties. Any
modifcations of this agreement must be in writing and signed by both parties. Any waiver of a
breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of
either the same provision or any other provision of this Agreement. Te laws of the state of In-
diana shall govern this Agreement. No changes may be made to this agreement without prior
authorization. All changes must be initialed and dated by both Stephanie OConnell and Client.
Te undersigned have read and agree to all the terms on all pages of this contract.
