both companies that provide services to the pblic.

Plaintif paid +,-##,###.## to the Defendant for the said service.
.) Prsant to bein& hired for the ferr$in& of the Plaintif%s timber, the
Defendant proceeded to load timber valed at U"/1!,### from 'hi(an&a)a.
0) 1ven tho&h the said timber )as loaded, it )as not delivered to the
desi&nated destination, and to date its )hereabots are not (no)n.
2) The Plaintif proceeded to ta(e this matter to the Defendant, )ho
reimbrsed the Plaintif%s +,-##,###.## and &ave him a che3e in the sm of
,1,0.#,###.##. bein& the vale of the timber that disappeared in the
Defendant%s hands.
-) The Plaintif soon )as noti4ed that the same che3e )as referred to the
dra)er. The Plaintif had intended to se the sm of U"/1!,###.##. to
prchase cement in *ambia and resell it in +ala)i, thereb$ ma(in& a pro4t in

6) As a reslt of the above, the Plaintif has sfered loss and loss of pro4ts.
