TERMSANDCONDITIONSFORUSE
MercedUnionHighSchoolDistricts(District)ResponsibleUseofInternetandTechnologyResourcesContractfor
StudentsandParents(Contract)appliestostudentuseoftheInternetandTechnologyResources,including
computersandElectronicCommunicationDevices,providedbytheDistrict,usedonDistrictproperty,and/orusedoff
campusinconnectionwithDistrictactivityorattendance.Allsuchusemustberesponsible,proper,andsupportive
oftheinstructionalprogramfortheadvancementofstudentlearning.ElectronicCommunicationDevices(ECDs)
meansanyelectronicapparatuscapableofsending,receiving,reproducing,recording,storing,processing,
displaying,and/ortransmittingdata,voice,text,and/orvideo/photoimages.Thisgenerallyincludes,butisnot
limitedto,cellphones,laptops,netbooks,Chromebooks,Smartphones,tablets,MediaPlayers,memorysticks,and
othercurrentandfuturesimilardevices.
TheInternetoffersaccesstocomputersandpeopleacrosstheworldthrough,forexample,email,chatrooms,and
socialnetworkingsites.TheprotectionofstudentsisofparamountconcerntotheMercedUnionHighSchoolDistrict.
TheDistrictusesaCIPA(ChildInternetProtectionAct)compliantfilter,andschoolstaffmonitorandsupervise
studentuseoftheInternetandDistrictTechnologyResourcesprovidedbytheDistrictandusedonDistrictproperty.
However,itisimpossibletocontrolaccesstoallmaterial.Asaresult,users(andparentsofuserswhoarestudents)
mustunderstandthatneithertheMUHSDnoritsstaffmemberscontrolorcondonethecontentoftheinformation
availablethroughtheInternetorTechnologyResources.SomeoftheinformationavailablethroughtheInternetand
TechnologyResourcesiscontroversialandmaybeoffensive.
InternetandTechnologyResourcesmustbeusedinaresponsible,efficient,ethical,legal,andsafemanner.Care
ofelectronicdevicesdistributedbyMUHSDistheresponsibilityofthestudentandparent/guardiantowhichitis
assigned.Thisincludescostsassociatedwithdamagesandlossortheft.TheDistrictprovideseachstudentfree
InternetaccesswhileoncampusandaDistrictemailaccountforeducational/instructionalpurposes.Eachstudent
isresponsibleatalltimesfortheirproperuse.
SAFETYForthesafetyofthestudents,wesuggestthatusers:

Changepasswordsfrequentlyanddonotgivepasswordstoanyothers
Donotshareaccountnumbers,homeaddresses,lastnames,SocialSecuritynumbers,telephonenumbers,
oranyotheridentifiableinformation,unlessinstructedotherwisebyschoolpersonnel

Donotsharepasswordsoraccounts
NeverarrangeafacetofacemeetingwithsomeoneyoumeetontheInternet

IRRESPONSIBLEUSESInordertousetheInternetandTechnologyResourcesprovidedbytheDistrict,usedon
Districtproperty,and/orusedoffcampusinconnectionwithDistrictactivityorattendanceusersmustnotengagein
anyirresponsibleusesincluding,butnotlimitedto,thefollowing:
Anypracticesoractivityprohibitedbylaw,Boardpolicy,oradministrativeregulations
Accessing,posting,forwarding,texting,submitting,publishing,ordisplayinginappropriatematterthatis
threatening,obscene,libelous,slanderous,disruptive,unlawful,orsexuallyexplicitincitesstudentsto
commitunlawfulactsonschoolpremisesorthatcouldbeconstruedasharassment,discrimination,or
disparagementofothersbasedontheiractualorperceivedsex,gender,ethnicgroupidentification,race,
nationalorigin,religion,physicalormentaldisability,age,orsexualorientation
Engagingincyberbullying,sexting,orharassment
Engaginginuseforthepurposeofseekingfinancialorpersonalgain,engaginginpoliticalactivity,or
conductingcommercialactivity
Engaginginanyillegalactivityinviolationofstateorfederallawsorregulations

Encouragingtheuseofdrugs,alcohol,ortobacco
Promotingunethicalactivities,suchascheatingonassignmentsortests
Copyingcopyrightedmaterial,commercialsoftware,orfilesinviolationofcopyrightlaws
Intentionallyuploading,downloading,orcreatingcomputervirusesand/ormaliciouslyattemptingtoharmor
destroyDistrictequipmentormaterials,ormanipulatingthedataofanyotheruser,includingsocalled
hacking
Interferingwithotherusersabilitytosendorreceiveemail
Attemptingtoread,delete,copy,modify,oruseanotherindividualsidentityorprivateinformation
Usingotherspasswords
Trespassinginothersfolders,workorfiles
Impersonatinganotherpersonorfalsifyinglocation,identity,orcomputerinformation
Accessingsocialnetworkingsites,chatrooms,musicorvideo,unlessapprovedbyDistrict
InstantMessaging,unlessapprovedbyDistrict
Postingpersonalinformation(yoursorothers)forpurposesthatarenotacademicoreducational
Useofproxiesorothermeansofaccessingfilteredwebsites
Useofunauthorizedsoftware

TheMUHSDreservestherighttomonitorallInternetandTechnologyResourcesforimproperuse.Electronic
communicationsanddownloadedmaterial,includingfilesdeletedfromausersaccount,maybereviewedbyDistrict
officialstoensureproperuseofthesystem.Notethatsystemoperatorswillhaveaccesstoalluseraccounts,
includingemailsentwhileusingtheDistrictsInternetconnections.Wherelegalviolationshaveoccurred,law
enforcementwillbenotifiedandpotentialcriminalchargesfiled.
VIOLATIONS OF THIS CONTRACT: Theprincipal ordesignee shallmakealldecisionsregardingwhetherornota
student has violated this Contract. The decision of the principal shall be final. Irresponsible use may result in
cancellationof the students userprivileges,disciplinaryaction,and/orlegalactioninaccordancewithlawandBoard
policy.

Inconsiderationoftheabove,IagreetonotholdtheDistrictoranyDistrictstaffresponsibleforthefailureofany
technologyprotectionmeasures,violationsofcopyrightrestrictions,orusersmistakesornegligence.Ialsoagreeto
indemnifyandholdharmlesstheDistrictandDistrictpersonnelforanydamagesorcostsincurred.
