Should the Privacy Act Apply to minors?

Center for Reproductive Rights. "Contraceptives Should Be Available to Teens Without Parental
Consent." Teens and Privacy. Ed. Nol Merino. Detroit: Greenhaven Press, 2011. Current
Controversies. Rpt. from "Parental Consent and Notice for Contraceptives Threatens Teen
Health and Constitutional Rights." 2006. Opposing Viewpoints in Context. Web. 6 Oct.
2014.

The article written by the Center for Reproductive Rights is saying teens have rights to their privacy
to some extent. The center ask why not let teens receive contraception without parental consent? It
is more danger in asking for parental consent by doing so they are violating the minors right to
privacy. Some teens receive non appropriate treatment or consequences from their guardians when
doing the smallest thing such as receiving contraceptive, parents tend to assume receiving
contraceptive means their child is or already have been sexually active.

The Center argues that minors have a right to privacy including contraception but more critical
things such as abortion should be discussed with parents. Teens receiving unusual punishment from
their parents may be too afraid to confront their parents resulting in them taking the safe way out
which really is not best and may hurt them in the worst way possible. By fear of their parents
minors are forced to make a decision of telling their parent and get the conception but with
additional punishments or do not use contraception at all which comes with its own set of
consequences. The Center states that eighty percent of pregnancies dealing with teenagers are
unplanned due to lack of contraception. This article give statics which helps you to grasp the big
picture which is not having parental consent and trusting your teens may have better results than
society thinks and it start with the relationship at home.

The reader is still debating on if the reader will or will not use this article in my next assignment. It
has given the reader some factual and maybe useful information the reader just feel as if in this

paragraph alone it didnt include enough information and facts to back up what point this author
was trying to get across. This article could have got more into the subject on teen privacy but the
reader feel as if it just touched the basis from a teens point of view.

Miller, Kevin. Parenting versus privacy: Maine Debates Access to Teen Medical Treatment.
Bangor Daily News (ME) 23 Mar.2011: Newspaper Source Plus. Web.6

In the article, Maine debates access to teen medical treatment, Maine is looking into increasing
teens rights to privacy. The article is debating rather teen privacy should be more important than
parents right to know about concerning issues with their teens. In the Legislature Judiciary
Committee states two sides to their decision one that disagrees and one that agrees. They have fears
that Maine will become restricted and the bill, their plan to increase teens rights to privacy may
backfire.

Miller is discussing Maine thoughts on increasing teens rights to privacy. On side states that
parental consent may keep teens from participating in sexual intercourse too early in life. But, there
are concerns with rather or not it will make matters worse or make teens fearful to get their health
concerns checked due to their parents being informed. Another side believes, that without parental
consent there are risk at an increase in behaviors we have been trying to prevent. They believe that
without consent it may possibility strengthen the foundation of families and result in less diseases
but of course that is a big if. Miller says that without consent it can go either one way or another
either it can increase risky behaviors or minors will do as taught; what they know is right. Parents
feel like giving teens this kind of power undermines their rights to know about their child sex life,
pregnancies, medical information and or drug addictions. There right now are not sure on rather
having privacy laws for teens will benefit or backfire. Nick, a father of three who supports both
sides say the solution to both issues is to just have parents prove that they are incapable of caring
for their children before taking away their right to know about important health issue, this maybe a
better solution to just assuming all parents are irresponsible.

This article did a good job at hitting all aspects and voices concerning this issue on teen privacy.
The reader will definitely use this article in my next assignment. The reader like that it is well
organized and also included quotes from parents and professionals on the issue. It gave lots of facts
that we should be aware of before choosing rather or not having teen privacy laws approved will be
a good decision to make.

Buchanan 3

This article is discussing the teen being able to seek medical treatment without parental consent. It
explain that there are some places now minors and go to get treated without parents permission.
Ms. Norris also continues by saying that the patients come for both serious and minor reasons as
well. With parents consent teens are driven to worst behaviors out of fear and who put themselves
at greater risk.

Amanda Norris believes that the bill should be passed for minors 13-18 to receive medical help
without the consent of a parent. She explains that it will help teen thrive and live more fulfilling
lives. Norris argues that minors are most of the time scared or too embarrassed to confront their
guardians on their own when dealing with mental issues or other problems. She also goes on by
saying that there are already some places and centers teen can arrive to for treatment on their own.
According to Ben minors go to the centers to get treated for all kinds of reasons it can be small
issues that their scared the will get a serious beating over like It could be that they have fallen and
cut their knee and were told by a parent not to run in school (Ben). The reader feel that this article
is taking the teens side on the issue and is discussing mostly in the concerns of the teen.

The reader may use this article due to the fact that it gave points that expresses a teens voice or
point of view and why they may think their privacy is important. This article states what concerns
we have with minors not having privacy now and the direction that maybe best to go when
considering minors feeling and consequences. They explain that the privacy act for minors is not
giving them a right to be more sneaky, but a right to come to seek help in embarrassing situations
as well that they may not be comfortable with their parents knowing that their time of confusion.

"Parental Consent Should Be a Requirement for Underage Abortion." Teen Pregnancy and
Parenting. Lisa Frohnapfel-Krueger. Detroit: Greenhaven Press, 2010. Current Controversies.
Rpt. from "Abortion Notification and Consent Laws Reduce Risky Teen Sex." Health &
Medicine Week (16 Oct. 2006). Opposing Viewpoints in Context. Web. 20 Oct. 2014.

In this article they found that there is a connection between parent consent and risky behaviors
in teens. Parental consent scares teen into taking the easy way out. An not having parental
consent either goes one or two way which causes tens to think they are free and act out or
follow the right ways parents teach. They compared the cases of gonorrhea to the teens
parent consent. They dont know if the rates have decline due to safer sex and condom use or
abstinence all together.

The article have found a connection between the two parental consent and risky behaviors.
Lisa believes that if we get laws that requires parental consent that teens would participate or

Buchanan 4

be involved in less risky activities. They compared consent laws to the number of girls with
gonorrhea and found that there are less cases in white and teen girls due to consent of a
parent. They state that teens are therefore more likely to have protected sex and or abstinence.
This article states that the law should be passed it will only benefit parents and teens.

This article did not contain enough information on the connection between parent consent and
risky behaviors. This article may not be an article the reader will use for my next assignment.
Although this article have some very interesting statistics on the matter it was not valuable.
This article also felled to include its voices or the concerns of different groups such as parents,
teens, professional and lawmakers.

Spear, Scott J. "Confidential Health Care for Teens Is Good Policy." Teens and Privacy. Ed.
Nol Merino. Detroit: Greenhaven Press, 2011. Current Controversies. Rpt. from
"Protecting Confidentiality to Safeguard Adolescents' Health: Finding Common
Ground." Contraception 76.2 (Aug. 2007): 73-76. Opposing Viewpoints in Context.
Web. 6 Oct. 2014.

This article states that minors are not fully developed to take responsibility for themselves.
Giving teen that kind of confidenality can break them more than help them in their futures.
Teens avoid activities that they know is wrong when it is reported to their parents. When
issues arent reported to parents teens are more likely to run wild.
This article debates rather parents consent is necessary or not. Scott believes that
confidential health care is good for teens. Scott is worried that parent consent will only make
the child avoid services all together resulting in life concerning issues. Confidentially can help
teens to go in the right direction with sexual behavior. The privacy of teens may even reduce
the number of teen pregnancies, sexual diseases and other risky behaviors. The article written
by Scott, medical director of Planned Parenthood of central Texas says only one percent of
teens would stop having sex if parental notification were mandated for contraception. The
other will rely on the withdrawal method. Which is not as effective as using contraception or
abstinence. Although Scott has his believes health care professional argue that this
confidentially will hurt teens. Health care professional states that minors are not fully
developed to take responsibility for their selves and giving them this privacy will only put
more responsibility on the teen.
The reader will use this article in my next assignment because the reader like how it chose to
sides and debated the different issues. The reader think it gave factual information that will
benefit my next assignment. It showed some reason on why privacy is important and why
privacy may not be important in this specific situation.

"Teen mental health bill advances." Manassas Journal Messenger [Manassas, VA] 23 Jan.
2008. Opposing Viewpoints in Context. Web. 20 Oct. 2014.

This article states that there is no specific laws for or against the consent of parents yet. It
states the parents point of view concerning teens and why its important. Parents feel as if
they should be a participant in the healing process and they are not able to do so if they do not
know the specifics of what is going on with their child. Parents fear that this law may cause
their child to suffer in silent or may lead to suicide. Parents also feel that if they sit back and
allow the privacy it will only make matters worse for them, but mostly for their teens. Parents
feel as if teens do not know what is best for them at their age.

In the article, it states that parents are the mostly concerned about the consequence or
repercussion that may occur from giving their teens privacy. One parent reports that when
you tell parents that they do not have a right under Virgina law to be notified when their
children are getting counseling for suicidal tendencies, they look at you like you just arrived
from another planet. This article states that there is no specific laws for or against the consent
of parents yet. This article explains the parents point of view concerning teens. Parents argue
that they should be a participant in the healing process and they are not able to do so if they
do not know the specifics of what is going on with their child. The article was well written
and looked closely into the parents view on the issue.
The reader may use this in my next assignment as a parents point of view. It did explain the
feeling or concerns that parents may have with this law being passed. The reader feel as if this
article being used will benefit my next writing assignment. This article was well written and
easy to follow.

"Teens and Privacy." Opposing Viewpoints Online Collection. Detroit: Gale, 2014. Opposing
Viewpoints in Context. Web. 6 Oct. 2014.

The article states teens do not have the responsibilities that adults have so they should not
have confidentially with medical issues. Part of the parents responsibility is to keep their
child safe. It states that for the same reason teens must tell parents before an abortion is the
same reason why they should inform parents about potentially harmful issues. Teens are not
yet equipped to handle these kind of situations on their own.

This article argues that teen are incapable of making effective decision on their own without
any guidance. This article says the too invade teens privacy you must have a warrant or reason
for doing so before. They argue that there shouldnt be privacy for minor in fact they point out
that another area of concern with teens is the internet. It is unsafe for teens to post things,
important information on the internet.

Buchanan 6

The reader is not going to use this article in my next assignment. The reader dont think the
information is very useful. It does not give must detail on the situation. This article talks on
privacy but in different places, changing areas threw me off from the point they were trying to
get across.

Marshall, Patrick. "Online Privacy." CQ Researcher 6 Nov. 2009: 933-56. Web. 27 Oct.
2014.

This article Do Americans Need Better Protection? explains that Americans some times are in
danger even when they do not think they are. We are in danger in everyday activities and teen
are in the most danger because they share important information each day without even
knowing.
This article explains that everything we do in technology we leave something like DNA
behind we can be traced from our everyday searches and activities. Activates like shopping
online can be dangerous. The Internet saves information about us and social websites are the
worst when trying to stay private. People keep their lives in their computers such as photos,
air fight tickets and social websites.
The reader is going to use this in my next assignment it gives in depth details about concerns
Americans should pay attention to. It gives examples on why privacy is important and how
although most people may think they are private in reality they are not.
