    The Union rejects the company’s decision regarding grievances LAT-101609, Lind, and LAT-
    100809(B), Griffith, based on timeliness. The Union’s position is that the shift picks were
    ongoing at the time these grievances were filed on Thursday 10/08/09. The date used on the
    grievances is the date the new schedules were posted by management on 9/30/09. It is also
    viewed by the Union that these grievances were filed well in advance for the simple fact that the
    contract was further violated when changeover actually took place on 10/17/09.

    The Union therefore appeals your decision to reject these grievances. Please provide dates to
    meet for Step 3 regarding LAT-101609 Lind. The Union will proceed to Arbitration regarding
    LAT-100809 (B) Griffith.
