Madrid v.

Spouses Martinez
Facts:
Martinez, the owner of a parcel of land in Sampaloc Manila, filed an
accion publiciana for recovery of possession against Miranda, Bernardo
and Madrid. The latter contended that they acquired the property by
oral sale from the original owner of the land. However, RTC ruled in
favor of Martinez upholding the torrens title on favor of such party.
Madrid appealed the decision to CA but to no avail. Hence, he brought
the case before the SC contending that the acquisition of Marinez of
such land was attended by fraud.
Issue:
WON the contention of Madrid is tenable
Held:
No.
In Herce Jr v. Municipality of Cabuyao, Laguna the Court uphold the
rule that registration of land inder the Torrens system renders the title
immune from collateral attack. There is collateral attack when in
another action to obtain a different relief and as an incident to the
present action, an attack is made against the judgment against the
title.
In this case, the original action is for accion publiciana, hence an
argument of fraud attendant to the acquisition of title is considered as
collateral attack.
