Membership Rules and Regulations

CONDOMINIUM INFORMATION
To assist you in choosing the right Resort
Condominium for you and your family, here are some
descriptions of their primary features, these features
are to be considered a general rule for expectations
but are not a guarantee as each locations amenities
may differ:
Studio Units:
One large room with living accommodations for up to
four people, some may include a kitchenette, and
one bath.

Member Terms:
Membership in the Association is limited to a
maximum term of thirty (30) years, are on a month
to month basis, and may be cancelled at any time
with no further obligation . Privileges of Membership
provided will be on an as-requested basis, and must
be paid for at the time so provided. The initiation fee
paid at the time the Member(s) joined is not a fee for
future services or Association privileges or benefits,
rather it is a fee paid for the Members membership
in the Association.

One Bedroom Unit:


One Bedroom, a full kitchen, a living room, and one
bath. Accommodates four to six people with a
convertible couch in the living room.
Two Bedroom Unit:
Two full bedrooms, a full kitchen, a living room, and
one to two baths. Accommodates six to eight people
with a convertible couch in the living room.
Three Bedroom Units:
Three Bedrooms, a full kitchen, a living room, and
two full baths. Accommodates eight to ten people
with a convertible couch in the living room.
Keeping Your Vacation Cost Low:
With the added space and amenities, you have many
ways to make your vacation more affordable than
staying in a conventional hotel-based resort.
The condominiums are priced on a per-unit instead of
a per-person basis. It is therefore possible to split the
cost of a single unit between two eligible families so
long as such splitting is permitted by applicable
regulations and restrictions of the respective
condominium. The presence of kitchen facilities
allows you to prepare a meal or snack whenever you
wish, thereby helping to offset the cost of expensive
restaurant dining.
MEMBERSHIP RIGHTS & PRIVILEGES
Membership in Freedom Resort Club Travel
Association (Association) is limited to the
Member(s) named on the Membership Agreement
and those members of his/her/their immediate family.
Minor children may benefit from the Membership, but
may not utilize the Membership unless accompanied
by their Member parent or legal guardian. Adult
children may independently use any Association
Benefits (which are collectively defined in the
preceding sections of these Membership Rules and
Regulations), providing they meet such Benefits
minimum age requirements.

Association Board of Directors:


1. COMPOSITION
Management of the Association, will be under the
direction of an Association Board of Directors. The
Association Board will be comprised of Five (5)
Association Directors, appointed on July 1 of each
year by the Board of Directors of FRC to serve a term
of One (1) year. Two (2) Association Directors will be
Members appointed from the Membership
population. Three (3) Association Directors will be
appointed by FRC from FRCs Executive Staff.
2. MEETINGS
The Association Board of Directors must meet once
each year at a location to be determined by the Chief
Executive Officer of FRC. Members of the Association
Board of Directors may meet at other times during
the year if required by a simple majority vote of all
Association Directors.
3. RULES CHANGES
All changes to Association Rules and Regulations,
pricing and fees must be approved by the Association
Board of Directors. Approval of any such changes
requires a simple majority vote of all Association
Directors present and voting.
4. COMPENSATION
There will be no annual compensation for the position
of Association Director. Transportation, lodging, and
meal expenses incurred by Association Directors in
the course of their attendance at annual Association
Board meetings or other meetings authorized by the
Association Board of Directors will be reimbursed by
the Association or FRC to the Extent they are
reasonable and proper.
5. HOW MEMBERS MAY APPLY
FOR DIRECTORS POSITION

Any Member-in-good-standing of the Association may be


considered for appointment to the position of Association
Director. To be considered for appointment, a member
must submit a written request to FRC to this effect. This
request must be mailed to Freedom Resort Club, LLC. at
the address contained in these Rules and Regulations, or
any other address as may be from time to time provided
to Members. To be considered, these requests for
appointment must be received by FRC management not
later than June 1 of each year.
Membership Dues:
1. BILLING AND PAYMENT OF DUES
Members are obligated to pay monthly membership dues
to FRC for the entire term of their Membership. Payment
of these dues entitles the Member(s) to request and
receive Membership benefits and services. First months
dues must be paid in full before the Member may begin
to use any Membership Benefits. Thereafter, monthly
membership dues are paid by EFT by the Member on the
First (1st) day of each month. If the dues are not received
by FRC on or before the due date, all Membership rights
and privileges will be suspended until such time as all
dues in arrears are paid and received.
2. DUES AMOUNT AND CHANGES
The amount of dues to be paid each month will be set by
the Association Board of Directors at their annual
meeting. Dues may change annually. Should the
Association Board of Directors find it possible to decrease
the monthly dues, there will be no limit to the amount
these dues may be decreased. Should the Association
Board of Directors find it necessary to increase the
monthly dues, any such increases are limited to the
greater of ten (10%) percent, or the annual rate of
increase in the Consumer Price Index, as published each
year by an agency of the U.S. Government.

Condominium Reservation
Procedures and Fees:
1. ENTITLEMENT TO REQUEST CONDOMINIUM WEEKS
Weeks of time in Resort Condominiums typically begin
and end on specific days of the week (usually Saturday
to Saturday). These days are set by each particular
resort, and are not under the control of, and may not be
altered by the Association or its Members. Check-in days
may not be altered, but Members may elect to check-out
early. Requests are made by location and not specific
resort sites.
The following areas exemplify areas frequently traveled
to by Members: the Southeastern United States,
including Florida, North Carolina, South Carolina and
Louisiana, the Western United States, including Nevada,
Hawaii, California and Arizona, New England, Aruba,
Cancun and other Caribbean locations. Vacations in
areas other than the above are available, although
availability may be limited and fulfillment more difficult
to achieve.

2. RESORT CONDOMINIUM SPACE ACCESS


Access to Resort Condominium space is limited to a
space-available, first-come, first-served basis. This
means that while the Reservation Staff will make all
reasonable and prudent efforts to secure requested
space for a Member, no guarantee of availability is either
expressed or implied. It is possible that the Association
may not be able to confirm all Member requests.
3. SUBMISSION OF RESERVATION REQUESTS
Members may submit Resort Condominium Week
Reservation Request no later than Twenty Four Hours
(24) prior to their desired travel date, and no earlier than
One (1) year in advance of their desired travel date. If
Members submit Reservation Requests outside of the
time frames specified in this paragraph, FRC will accept
the Requests and attempt to locate accommodations in
fulfillment of such requests. However, fulfillment will be
more difficult to achieve. Therefore, it is highly
recommended that Requests be submitted within the
time frames described in this paragraph.
4. WEEKLY UNIT RATES AND CHANGES
Weekly Resort Condominium rates are contained in a
Rate Schedule published by the Association Board of
Directors each year on August 1. Rates will vary based
on the size of the unit provided, and in the case of Prime
Season, the time of the year requested. Prime Season is
defined as the Three (3) weeks before, during and after
Easter, Memorial Day Week, Fourth of July Week, Labor
Day Week, and the Three (3) weeks before, during and
after Christmas Day.
The Association Board of Directors will be responsible for
setting the Weekly Resort Condominium unit rates and
fees each year.
Should the Board find it possible to reduce the rates from
those of the previous year, there will be no limit to the
amount of decrease. Should the Board find it necessary
to increase the rates, any increases will be limited to the
greater of ten (10) percent, or the annual rate of
increase in the Consumer Price Index as published each
year by an agency of the U.S. Government.
5. RESERVATION PROCESSING FEE
In addition to the weekly rate, FRC may charge a
Processing Fee for each week of Resort Condominium
space requested. This Processing fee, currently set at
$0.00, must also be detailed in the Rate Schedule
published each year by the Association Board, and is
subject to the same increase and decrease limitations as
described for membership Dues and Condominium
Rates.

6. PAYMENT OF CONDOMINIUM
AND PROCESSING FEES
Condominium Fees and Processing Fees must be paid by
the Member at the time they place their Reservation
Request. If the Association is unable to accommodate a
Members Resort Condominium Reservation Request,

both the Condominium Fee and Processing Fee will be


refunded to the Member.

7. CONFIRMED CONDOMINIUM
RESERVATIONS
Confirmations of Reservation Requests will be provided
to the Member in writing by the Reservations
Department. Once the Reservations Department
confirms a Request, and the Member accepts it, the
Condominium and Processing Fees become nonrefundable from that point forward.

1. NEGLIGENT RELATED DAMAGES


Should the Condominium Unit or any of its contents be
damaged or destroyed as a consequence of willful or
negligent behavior on the part of any Member or guest of
a Member, the Member will be responsible to the Resort
for the cost of the repair and/or replacement of the
damaged item(s)

8. CANCELLATIONSOF RESERVATIONS
Should a Member wish to cancel a confirmed and
accepted Condominium Week Reservation, the
Reservations Department will attempt to facilitate
occupancy during that canceled week to another
Member. If the Association is successful in that endeavor,
the Condominium and Processing Fee will be refunded to
the Member who wished to cancel the reservation. If the
attempt to rent the canceled space is unsuccessful, the
Condominium and Processing Fees are forfeited.
Cancellation of a confirmed Condominium Week and
subsequent forfeiture of the Condominium and
Processing Fee will not result in the loss of the Members
annual Resort Condominium Week Rental Entitlement.
The Member has the right to request the Association to
provide other resort Condominium Weeks at some other
time or location, up to the original limits of their
Membership.

2. MAID/CLEANING SERVICES
Condominium units are cleaned by the Resort before the
arrival and after the departure of the Member, Additional
maid or cleaning service during the Members stay will, if
the particular resort provides, be at the request of the
Member. Should the Member so request, any additional
fees charged by the Resort for this service will be the
responsibility of the Member.

9. CARRY OVER FROM YEAR-TO-YEAR


If a Member does not, or is not able to exercise their
entitlement to request Resort Condominium Weeks up to
the annual limits of their Membership, Members
entitlement will carry over into the next year of their
Membership.
10. RULES AND REGULATIONS OF
CONDOMINIUM
In addition to the Rules and Regulations contained
herein, Member(s) must abide by all rules and
procedures promulgated by the particular condominium
visited, including but not limited to the Condominium
Declaration, Bylaws and/or rules and regulations, if any.
The rules and regulations and Condominium Declaration
restrictions for each Condominium may differ.
Membership Referral Plan:
The Association anticipates providing for the existence
and support of a New Member Referral Program. The
compensation, benefits, rules and regulations of the
Referral Program will be established, published, and
periodically amended by the Association Board of
Directors. Any Member in good standing is entitled to
participate in the New Member Referral Program. Travel
credits obtained by virtue of the Referral Program as
described in the rules and regulations of such program,
will not be used at any time to offset Monthly Dues nor
are travel credits transferable, assignable or redeemable
for cash or compensation other than as stated above.
Members Liability-Resort Condominiums:
While Members and their guests (if any) are residing at
Resort Condominium Units provided to them on a rental

3. ADDITIONAL FEES CHARGED BY THE


RESORT
Some Resorts may have security deposits, utility
surcharges, or special service fees. If these fees exist,
they are the responsibility of the Member.
4. PERSONAL CHARGES AND EXPENSES
All charges of a personal nature such as telephone calls,
laundry and valet service, room service, food, recreation,
etc. are the responsibility of the Member.
Payment of Charges and Fees:
All services rendered to the Member by the Association
must, depending upon the specific terms of the service,
be paid for by the Member at the time the service is
either requested or rendered. It is expressly understood
by the Member that the Initiation Fee paid at the time
the Member joined the Association is in no way a fee for
any form or type of future services, privileges or benefit
but rather is payment for the Membership itself. All
payments made to Freedom Resort Club, LLC. must be in
U.S funds.
Disclosure and Responsibility:
Membership in the Association entitles a Member to seek
condominium occupancy by making a Request through
FRC. FRC seeks to facilitate fulfillment of such Request
for Condominium Unit occupancy. FRC receives no
compensation from respective Condominium Resorts or
other entities for arranging this service. FRC does not
represent that it owns or controls any of the vacation
properties available to the membership.
FRC does not assume responsibility for any of the
vacation properties to which our Members travel. It is
understood that variations in accommodations and
Resort amenities may be experienced by the Members.
It is understood that FRC may receive residual benefits in
arranging benefits provided to Members. It is thus
agreed that Members are to receive the benefits for the
paid fees and expenses contained herein and elsewhere
in the Membership documents with any residual benefits
arising from arranging of such benefits or services
belonging to FRC. It is expressly understood that FRC has
liability only to the extent of the Condominium and
Processing Fees paid with regard to the arranging of a
Resort Condominium Unit. It will not be responsible for
the costs of telephones, extra maid service, meal
transportation of any kind, and Member expenses of
personal nature.

Commercial Travel to Resort Condominiums:


Members understand that FRC will provide to them a
written confirmation of any Resort Condominium space
arranged through the Membership request procedure.
Members further understand that if Members incur any
penalties or fees resulting from the purchase of
commercial travel tickets (airline, rail, bus, ship or other
commercial conveyance) prior to receiving written
confirmation from FRC, such penalty is solely the
Members responsibility.
If FRC is unable to accommodate a Members Resort Unit
Reservation Request, FRC assumes no liability related to
loss of the cost of commercial travel purchased in
advance of a written confirmation being provided to the
Member.
Benefits Improvements:
From time to time, the Association Board of Directors
may decide to change or improve the benefits provided
to Members, although no representation, assurance or
guarantee of improved or enhanced Membership
benefits is made by FRC, the Association or any of its or
their representatives. Any material change, alteration or
improvement in benefits must be approved by a majority
vote of all Association Directors present and voting.
Should the Association Board of Directors authorize a
material change or improvement in Association Benefits,
this change will be provided to all preexisting
memberships. If the change requires an additional fee, it
will be provided to the existing Membership on an optionto-participate basis. If the change requires no additional
fee, it will be provided to the entire existing Membership.
There is no obligation to improve or change benefits nor
are any improved services deemed to be dependent
upon future membership participation. Improved or
changed benefits are solely the result of the
Associations Board review of benefits and a belief that
the same is in the best interest of Members.
Any Member may suggest changes to the benefit
structure of the Association. Such suggestions must be
presented, in writing to the Association Board of
Directors. Suggestions for benefit changes must be
mailed to FRC at the address provided earlier in this

document or at such other addresses as may be


provided in writing to the entire Membership base. Such
suggestions, to be considered for implementation in the
next Operating Year, must be received by the Association
Board of Directors a minimum of Sixty (60) days prior to
their regularly scheduled Annual Meeting.
These Membership Rules and Regulations are
published and established as of January 1, 2015
