1. TheActintroducespoliciesthatnegate
andfrustratethefoundationalidealsand
aspirationsofthesovereignFilipino
peopleasenshrinedintheConstitution.
a. Everyprovisionofthe
Constitutionisanembodiment
ofanidealandaspirationofthe
sovereignFilipinopeople
becausethatisthepurposefor
whichtheConstitutionwas
promulgatedandratifiedbythe
Filipinopeoplethemselves.
b. Asregardsthevalueofhuman
lifeanditssustenance,the
Constitutionupholdstheideal
ofanunconditionalrespectfor
lifeandaspiresforthe
establishmentofpoliciesthat
createopportunitiestoharness
theeconomicpotentialofevery
Filipino.
c. Asregardsthevalueand
exceptionalstatusofthe
Filipinofamily,theConstitution
upholdstheidealofan
unconditionalrespectforits
inherentsanctityandautonomy
asagainsttheStateitself.
d. Asregardsthesovereignand
democraticnatureofthe
Philippinenationandits
Government,theConstitution
mandatestheestablishmentofa
governmentthatembodiesthe
idealsandaspirationsofthe
sovereignFilipinopeople.
e. TheConstitutionisaprotector
ofreligiousfreedomand
freedomofspeechinthought
andactionagainstany
substantialburdenof
governmentintrusion.
f. Thegrantofreproductiverights
asdescribedintheActcreates
doubtfulorspuriousrights.
2. TheActcannotbeimplementedwithout
exceedingtheboundariesofgovernment
actionasestablishedintheConstitution.
Petitionersclaimthattheprayerfortheissuance
ofatemporaryrestrainingorder/preliminary

injunctionisnotpremature,astheremedyis
availablebeforethecontemplatedillegalactis
done.Theystatethatitwillbetoolateforthe
daythelawbecomeseffectiveforbythenan
illegaldisbursementanduseofpublicfundscan
bemadebeforetheHonorableCourtcan
deliberateontheproprietyofissuingthe
preliminaryinjunctionagainstthedisbursement.
