SUBJECT:NAMINGOFFRUITBEVERAGES

Toavoidconfusingandmisleadingpresentationoffruitbeverages,thefollowing
definitionsshallserveastheguidelinesofnamingoffruitbeverages.

1.FruitJuiceconsistsoffermentablebutunfermentedjuiceobtained:

a.fromthefruitbyamechanicalprocesswhichshallcausetheremovalofseeds
and excess pulp, the finished product having the characteristic color, flavor
andaromaofthejuiceofthefruitfromwhichitwasobtained;or

b. from concentrated fruit juice by the replacement of water in the amount


necessarytoobtaintheorganoleptic(sensory)andchemicalpropertiesofthe
juiceobtainedbythesamemechanicalprocessmentionedabove.

Itmaycontainaddedsugar,providedthat,whenmorethan4%(w/w)sugarhas
been added the word "sweetened" or "with added sugar" shall appear
conspicuouslyonthemainpanelofthelabel.

2.ConcentratedFruitJuicecontainsonlyjuiceasdefinedabove,fromwhich
waterhasbeenremovedbyphysicalmeansreducingthevolumeofthejuice
byabout50%.

3. Fruit Juice Drink is a ready to drink beverage prepared by mixing water


withfruitjuiceconcentrateandintowhichsugarandcitricacidmaybeadded
to adjust the soluble solids content and acidity of the product. The main
ingredient which is the fruit juice concentrate is composed of fruit juice,
essentialoils,essencesorextracts,withorwithoutaddedsugar.

4. Fruit Drink Concentrate is a blend of fruit beverage base and syrup. The
fruitbeveragebaseismixtureoffruitflavors,essencesandcoloringmaterial.
Citricacidandpreservativesmaybepresentinthebaseormaybepresentin
thebaseormaybeaddedduringthepreparationoftheconcentrate.Eachpart
of the concentrate shall be diluted with not less than one part of water to
produceareadydrinkbeverage.

5. Fruit Nectar is a fermentable but unfermented product obtained by the


addition of water and sugar to concentrated fruit juice or fruit puree or a
mixtureoftheseproducts,withorwithoutaddedcitricacid.Itvariesfroma
nearlyclearliquidtoamixturehighinsuspendedsolidandcommonlyrefers
topulpyfruitbeveragesderivedfromfruitsotherthatcitrusfruits.

6.FruitDrinkMixisamixtureofdryoralmostdryingredients(fruitflavors,
sugar, citric acid, other additives) that are readily soluble in water. It may
containdehydratedfruitjuice.

Fruitbeverageswithlabelclaimsthatdonotconformwiththedefinitionsstated
hereinshallbeconsideredmisbrandedunderSection15(g)ofR.A.3720.

SUBJECT: Rules and regulations Governing the labeling of prepackaged


FoodProductsDistributedinthePhilippines

Pursuant to the provisions of Section 26 (a) of R.A. 3720, otherwise


knownastheFood,DrugandCosmeticAct,thefollowingrulesandregulations
onthelabelingofprepackagedfoodproducts,importedorlocallyproducedare
herebypromulgatedfortheinformationandguidanceofallconcerned:

Section1.DefinitionofTerms

Forthepurposeofthislabelingregulation,theterm:
1.1. Container means any form of packaging material which completely or
partially enclose the food (including wrappers). A container may enclose
the food as a single item or several units or types of prepackaged food
whensuchispresentedforsaletotheconsumer.

1.2. Food means any substance, whether processed, semiprocessed of raw


which is intended for human consumption and including beverages,

chewinggumandanysubstancewhichhasbeenusedasaningredientora
componentinthemanufacture,preparationortreatmentoffood.

1.3. Food Additives means any substance not normally consumed as food by
itselfandnotnormallyusedasatypicalingredientofthefood,whetheror
not it has nutritive value, the intentional addition of which to food for a
technological (including organoleptic) purpose in the manufacturing,
processing,preparation,treatment,packaging,transportforholdingofsuch
foodresults,ormaybereasonablyexpectedtoresult(directlyorindirectly)
initsoritsbyproductbecomingacomponentof(orotherwiseaffecting
thecharacteristicof)suchfood.

1.4.FoodStandardisaregulatoryguidelinethatdefinestheidentityofagiven
foodproduct(i.e.itsnameandtheingredientsusedforitspreparation)and
specifiestheminimumqualityfactorsand,whennecessary,therequiredfill
ofcontainer. Itmay also includespecificlabelingrequirementsotherthan
or in addition to the labeling requirements generally applicable to all
prepackagedfoods.

1.5. Ingredient means any substance, including a food additive, used as a


component in the manufacture or preparation of food and present in the
finalproduct(initsoriginalormodifiedform).

1.6. Label includes any tag, brand, mark, pictorial, or other descriptive matter,
written, printed, marked, embossed or impressed on or attached to a
containeroffood.

1.7.Labelingmeansanywritten,printedorgraphicmatter(1)uponanyarticle
oranyofitscontainerorwrappersor(2)accompanyingthepackagedfood.

1.8.Lotreferstoquantityoffoodproductsunderessentiallythesamecondition
duringaparticularproductionschedule.

1.9.NutritionInformationmeansanyrepresentationwhichstates,suggestsor
implies that a food has particular nutritional properties including but not
limited to the energy value and to the content of protein, fat and
carbohydrates,aswellasvitaminsandminerals.

1.10.Prepackagedmeanspackagedormadeupinadvanceinacontainer,ready
forsaletotheconsumer.

1.11.ProcessingAidmeansasubstanceormaterialnotincludingapparatusor
utensils, and not consumed as a food ingredient by itself, intentionally
usedintheprocessingoffoodtoachieveacertaintechnologicalpurpose
which may result in the nonintentional but unavoidable presence of
residuesorderivativesinthefinalproduct.

Section2.GeneralProvisions

2.1Prepackagedfoodshallnotbedescribedorpresentedonanylabelorinany
labeling in a manner that is false, misleading or deceptive or is likely to
createerroneousimpressionregardingitscharacterinanyrespect.Itshall
not be described or presented on any label or in any labeling by words,
pictorialorotherdeviceswhichrefertooraresuggestiveeitherdirectlyor
indirectly,ofanyotherproductwithwhichsuchfoodmightbeconfused,or
insuchamannerastoleadthepurchaserorconsumertosupposethatthe
foodisconnectedwithsuchotherproduct.

2.2Foodpackagesshallhavelabelsthatcarrythenecessaryinformationabout
theproduct.

2.2.1 ThePrincipalDisplayPanelofthelabelshallbethatpartwhich,
eitherthroughdesignorgeneraluse,ispresentedorshowntothe
consumerundercustomaryconditionsofdisplayforretailsale.

2.2.2TheInformationPanelofthelabelshallbethatpartimmediately
continuous to the principal display panel and in the case of
rectangular,cylindricalorfoursided(tetrapak)containers,anyof
thesidesadjacenttotheprincipaldisplaypanelexceptthebottom
sidewhichservesasthebaseofpackage.

2.3Everyword,figureorstatementrequiredtoappearonthelabelorlabeling
shall beprintedlegibly withsuchconspicuousnessandinsuch termsasto
renderitlikelytobeunderstoodundercustomaryconditionofpurchaseand
use.Wherethelabelofafoodpackageissosmallthatitpreventtheuseof
letters of the prescribed size or where it concerns secondary or optional
information, letters or proportionately reduced size may be used provided
theprescribedparticularsarevisibleandlegiblyshownandthedesignated
labelspaceisproportionaltothesizeofthepackage.

Section3.MandatoryLabelInformation

Thelabelsofallprepackagedfoodsshallbearthefollowinginformation:
3.1.NameoftheFood

3.1.1. The name shall indicate the true nature of the food and shall
normallybespecifiedandnotgeneric.

a)
Where a name or names have been established for a particular
foodinaFoodStandard,anyoneofthesenamesshallbeused.

b)
Inothercases,acommonorusualname,orintheabsencethereof,
anappropriatedescriptivenameshallbeuse.

c)Acoinedorfancifulnamemaybeusedprovideditisnotmisleading
orconfusing.

3.1.2. For the consumers better understanding of the true nature and
condition of the food, there shall appear in the label either in
conjunction with, or in close proximity to the name of the food,
suchadditionalwordsorphrases,asnecessary,tostatethetypeof
packing medium, form or style, and the condition or type of
treatmentithasundergone(e.g.dried,freezedried,concentrated,
smoke, reconstituted, etc.). However, if the form (whole, slices,
diced, etc.) is visible through the container or is depicted by an
appropriate vignette, the particular form need not be included in
thestatementofthenameofthefood.

3.1.3.Thenameofthefoodshallbepresentedinboldtypelettersonthe
principaldisplaypanelandshallbeinasizereasonablyrelatedto
themostprominentprintedmatteronsuchpanel,e.g.,trademark
orbrandname.

3.2.ListofIngredients

3.2.1.Acompletelistofingredientsshallbedeclaredindescendingorder
ofproportiononeithertheprincipaldisplaypanelorinformation
panel except that when a food product is covered by a Food
Standard, only the optional ingredients shall be declared unless
otherwiserequiredbysuchregulation.

3.2.2. Added water shall be declared in the list of ingredients if such a


declarationwouldresultinabetterunderstandingoftheproducts
compositionbytheconsumerexceptwhenthewaterformspartof
aningredientsuchasbrine,syruporbrothanddeclaredassuchin
thelistofingredients.

3.2.3.Aspecificname,notacollective(generic)nameshallbeusedforan
ingredient except that spices, flavors and food colors other than
those sold as such, may be designated as spices, flavors and food
colorwithoutnamingthespecificmaterials.

3.2.3.1.Spicesshallrefertoanyaromaticvegetablesubstanceinthe
whole, broken, ground or any other form, except those
substanceswhichhavebeentraditionallyregardedasfood.

3.2.3.2. Flavors and flavoring substance are classified in the


followingcategories:

a)Naturalflavorsflavoringsubstancederivedthrough
appropriate physical processes from spices, herbs, fruits or
fruit juices, vegetable or vegetable juices, edible yeast, bark,
bud, root, leaf of plant materials, meat, fish, poultry, eggs,
dairyproductsorfermentationproductsthereof.

b) Nature identical flavoring substance substances


chemically derived from aromatic materials or obtained
synthetically, which are chemically identical to substances
present in natural products intended for human
consumption.

c) Artificial flavoring substances substances that impart


flavorbutwhichhavenotbeenidentifiedinnaturalproducts
ornaturalsourcesofflavorings.

3.2.3.3. Flavor as classified above shall be declared as Natural


Flavor(s), Nature identical flavor(s) or Flavor(s) for
(a), (b) and (c) respectively. In the case of combination of
Natural Flavors and Nature identical flavors it shall be
declaredassuchorsimplyFlavors.

3.2.3.4.Anypyroligneousacidorotherartificialsmokeflavorsused
as an ingredient in a food shall be declared as artificial
flavor or artificial smoke flavor. No representation may be
made, either directly or implied, that a food flavored with
pyroligneousacidorotherartificialsmokeflavorhasbeen
smoked or has a true smoke flavor, or that a seasoning
sauce or similar product containing pyroligneous acid or
other artificial smoke flavor and used to season or flavor
otherfoodwillresultinasmokedproductoronehavinga
truesmokedflavor.

3.2.3.5. Coloring substances shall be declared by their common


nameorasFoodColor(s)orColor(s)forthosethatare
derived from or identical with substances derived from
plantmaterials,andasArtificialColor(s)forcoaltardyes
orothersyntheticchemicalcompounds.

3.2.3.6.Thespecificnamesofvegetableoilusedshallbeindicated.In
the case of mixture of two or more vegetable oils the
declarationshallbeinthefollowingmannersvegetableoil
(nameofoilsindecreasingorderofproportion)orblendof
vegetableoil(nameofpossibleoilblends).

3.2.4.DeclarationofFoodAdditives

3.2.4.1. Food additives shall be declared by their common name or


theirclassnamewhichindicatetheirfunctionalcategories.

The following class names may be used except when


otherwisestatedinafoodstandard.

3.2.4.2.VitaminsandMinerals
Alladdedvitaminsandmineralsshallbedeclaredindividuallyinthe
listofingredientsexceptthatwhenanutritioninformationtableis
presented in the label, the collective term Vitamins and Minerals
may be declared in the list of ingredients. Provided, however, that
when the nutrition information table declares other vitamins and
minerals which have not been added to the product, the added
vitamins and minerals shall be specified either in the list of
ingredientsorinthenutritioninformationtable.

3.2.4.3.Thefollowingsubstancesshallbedeclaredbytheircommon
name:

a)SodiumChlorite/Salt
b)SodiumNitrite
c)Sodium/PotassiumNitrite
d)MonosodiumGlutamate/MSG/Vetsin
e)Specificnamefornonnutritivesweeteners

3.2.4.4.Whentheacidulantusedisaceticacidorsodiumdiacetatein
thecaseofdehydratedfoodproducts,e.g.,soupmixes,they
may be declared as such or as acidulant(s) but in no case
shallthetermsvinegarorvinegarpowderbeusedtorefer
tothesesubstances.

3.2.4.5. Processing aids and food additives carried over into food
(fromanotherfoodthatwasusedasaningredient)atlevels
lessthanthoserequiredtoachievedtechnologicalfunction,
neednotbedeclaredinthelistofingredients.

3.3.NetContentsandDrainedWeight

3.3.1. The net content shall be declared using the metric system of
measurementorSI(InternationalSystemofUnits)oneitherthe
principal display panel or the information panel and in line
generallyparalleltothebaseofthepackage.TheDeclarationshall
bemadeinthefollowingmanner:

a)forliquidfoods,byvolume;

b)forsolidfoods,byweight,exceptthatwhensuchfoodsaresold
bynumber,adeclarationofcountmaybemade;

c)forsemisolidorviscousfoods,eitherbyweightorvolume.

3.3.2. Foods packed in a liquid medium normally discarded before


consumptionmaycarryadeclarationofdrainedweight.

3.3.3.Thedeclarationofcontentsshallappearinconspicuousandlegible
bold faceprintortypein distinctcontrasttoothermattersonthe
panelwhereitisdeclared.

3.3.4. The net contents declaration shall be in letters and numerals of a


type size established in relation to the height of the label of the
foodpackageandshallbeuniformforallpackagesofsubstantially
the same size by complying with the following type size
specifications:

a)Notlessthan2mminheightonpackagesnotmorethan60mm
orbottlesnotmorethan200mminheight.

b)Notlessthan2.5mminheightonpackagesmorethan80mmbut
not more than 160mm or bottles more than 200mm but not
morethan400mminheight.

c) Not less than 3.5mm in height on packages more than 160mm


but not more than 260mm or bottles more than 400 but not
morethan650mminheight.

d)Notlessthan5mminheightonpackagesmorethan260mmor
bottlesmorethan650mminheight.

3.3.5. For food packages with surface areas of less than 30cm2 the
minimumtypesizefordeclarationofnetcontentsshallbe1.5mm.

3.3.6. For multi unit retail packages, a statement of the quantity of

contents on the outside package shall include the number of

individual units, the net content of each individual unit, and in

parenthesisthetotalquantityofcontentsofthemultiunitpackage.

Amultiunitretailpackagemaythusbeproperlylabeled.

6x300mlbottles(1.8Lor1000ml)

However, the number of individual units in a multiunit retail


package may not be declared if the number of the units can be

clearly seen and easily counted without opening the


package.

3.4.NameandaddressofManufacturer,PackerandDistributor

3.4.1.Thenameandaddressofeitherthemanufacturer,packeror
distributorofthefoodshallbedeclaredonthelabel.
3.4.1.1.Thestreet,City/townandprovinceshallbeindicatedexcept
that the street address may be omitted if the companys
name, as declared on the label, is listed in a current
telephonedirectory.

3.4.1.2. If a manufacturer with corporate headquarters in Metro


Manila,hasplantinmanycitiesandtowns,thenameofthe
company as listed in a current telephone directory would
also suffice provided every food package has a code/mark
toidentifytheprocessingplantwhereitwasproduced.

3.4.2. If the food is not manufactured by the person or company whose


name appears on the label, the name must be qualified by
manufacturedfororPackedfororsimilarexpression.

3.4.3. The country of origin shall be indicated if the product is being


exportedorimported.

3.4.4. In the case of products carrying foreign brands or manufactured


under license by a foreign company, the name or name and
address of the foreign company, if declared shall be in letters of
typesizenotbiggerthanthoseusedforthelocalcompany.

3.4.5.Thenameandaddressoftheimporterorlocaldistributorshallbe
declared in the labels of imported products except for sole legal
distributors/importers.

3.5.LotIdentification

The lot identification code shall be embossed or otherwise permanently


markedonimmediateindividualpackagesorcontainers.

Section4.NutritionInformation

Nutrition information may be included on the label or in the labeling


provideditconformstotherequirementsofthissection.
4.1. The nutrition information shall be presented through the declaration of
protein,carbohydrate,fat,energyvaluevitaminandmineralcontentofthe
foodintabulatedform.

4.1.1. The declaration of nutrient quantities shall be on the basis of the


food as packaged. Another column of figures may be used to
declare the nutrient quantities on the basis of the food as
consumedaftercookingorotherpreparationprovidedthespecific
method of cooking or preparation shall be disclosed in a
prominentstatementfollowingtheinformation.
4.1.2.Allnutrientquantitiesshallbedeclaredinrelationtotheaverageor
usual serving in terms of slices, pieces or a specified weight or
volume.

4.1.3. Protein, Carbohydrate and fat content shall be expressed to the


nearest gram except that if a serving/portion contains less than
one gram, the statement contains less than one gram or less
thanonegrammaybeused.

4.1.4. Energy value shall be expressed in terms of calorie, kilocalories


(Kcal),
joulesorkilojoules(kjoules).

4.1.5. Vitamin and Mineral content shall be expressed in terms of


percentageofRecommendedDailyallowances(RDA)orbyweight.
InternationalUnits(I.U.)shallbeusedforVitaminsA,DandE.

4.1.6.TheRDAvaluesshallbebasedonthePhilippineRDAexceptthatin
the absencethereofforcertainnutrients,theFAO/WHOorU.S.
RDA values may be cited and shall be specified. In the case of
importedproducts,RDAvaluesofthe
countryoforiginmaybe
indicated.

4.1.7.ThepercentageofRDAshallbeexpressedin2percentincrements
uptoandincludingthe10percentlevel,5percentincrements
above10percent anduptoandincludingthe50percentlevel,
and10percentincrementsabovethe50percentlevel.

4.1.8.Nutrientspresentinamountslessthan2percentoftheRDAshallbe
indicatedbyzero,orbythestatementcontainslessthan2%of
theRDAorby
anasteriskreferringtothisstatement,ornot
declaredatall.

4.1.9. Claims that a food product is enriched/fortified with vitamins


and/or minerals shall be made only when the amount of added
vitamin(s) and/or mineral(s) is in accordance with the level(s)
specified in the Food Fortification Guidelines and the nutrition
informationshallappearonthelabel.

4.1.10. Fatty acid composition cholesterol content and sodium content


mayalsobedeclared.

4.2. The added nutrients for fortification can be in the form of nature identical
nutrients or in the form of naturally occurring food containing large
amountsofthedesirednutrients.

4.3.Forthepurposeofcompliancewithnutrientlabeldeclarations.

a)Thenutrientcontentofafoodshallbeatleastequalto80percentofthe
valueforthatnutrientdeclaredonthelabelatanypointintimewithin
theexpected
shelflifeoftheproduct.Provided,thatnoregulatory
action will be based on a determination of a nutrient value which falls
belowthislevelbyafactorlessthan
the
variability
generally
recognized for the analytical method used in that food at the level
involved.
b)Thecarbohydrate,fatorenergyvalueshallnotexceed20percentofthe
value declaredonthelabel.

c)Thesamplefornutrientanalysisshallconsistofacompositeof12sub
samples(consumerunits)takenonefromeachof12differentrandomly
chosen shipping cases, to be representative of a lot. Composite shall be
analyzedby AOAC Methods where available or in the absence thereof,
byreliableandappropriateanalyticalprocedure.
4.4. A food labeled under the provision of this section shall be deemed to be
misbrandedifitslabelingrepresents,suggestorimplies:

4.4.1.Thatthefoodbecauseofthepresenceorabsenceofcertaindietary
properties, is adequate or effective in the prevention, cure,
mitigation or treatment of any diseases or symptoms when such
claimcannotbesubstantiated.

4.4.2. That a balanced diet of ordinary foods cannot supply adequate


amountofnutrients.

4.4.3.Thatthefoodhasdietarypropertieswhensuchpropertiesareofno
significant value or need in human nutrition. Ingredients or
substanceswhich have not been combined with vitamins
and/orminerals,addedtofoodlabeledin accordance with this
section,orotherwiseusedorrepresentedinanywaywhichstates
or implies nutritional benefit. Ingredients of this type may be

marketedasindividualproductsormixturesthereof;Provided,that
thepossibilityofnutritional,dietary, or therapeutic value is not
statedorimplied.

4.4.4.Thatanaturalvitamininafoodissuperiortoanaddedorsynthetic
vitamin, or to differentiate in any way between vitamins naturally
presentthoseadded.
Section5.LabelingofFoodAdditives

5.1. Food Additives, when packed in retail containers and sold either through
normal distribution channels (e.g., supermarkets, grocery stores) or
directly to food processors, shall be properly labeled, indicating the
informationrequiredinsubsection5.1.1.to5.1.7.

5.1.1.a) the name shall be specific preferably the name indicated in the
BFADsListofPermissibleFoodAdditivesoratrade/brandname
may be used which shall be accompanied by a descriptive
statementpertainingtothefunctionaluseoftheadditive.

b)Coloradditives,whensoldassuch,shallbereferredtoasFood
Colorand immediately below these words the component(s)
shallbeindicated.
5.1.2.ListingofAdditivescomponents
a) All substances present shall be listed in the order of decreasing
proportion. When one or more of the food additive(s) is subject to a
quantitativelimitationas
specified in the BFADs List of
Permissible Food Additives, the quantity or proportion of the
additive(s)shallbeindicatedinthelabel.

b) InthecaseofFlavorings,eachflavoringcomponentneednotbegiven.
The generic expression Flavor or Flavoring shall be used and
indicating the nature of the flavor by using the qualifying words,
natural,natureidentical,artificial
or a combination of
thesewords,asappropriate.

c) Whencompoundedadditiveorflavoringpreparationscontaincoloring
substancesthenameofeachcoloringsubstanceshallbeindicated.

5.1.3. The words For Food Use, Food Grade or a statement similar
theretoshallappearprominentlyontheprincipaldisplaypanelof
the label, except when the word food already appears as part of
thenameoftheproductasinFoodColor.

5.1.4.Adequateinformationshallbegivenaboutthemannerinwhichthe
foodadditiveistobeusedeitheronthelabelorapackageinsert.
Whenever there are specified restrictions for any of the

components, there shall be information pertaining thereto to


ensurecompliancewiththerestrictions.

5.1.5. Food additives with a limited shelflife shall carry an opendate


markwhichshallsignifythatbeyondthisdatetheeffectivityofthe
additive,foritsintendeduseisdiminished.

5.1.6. Storage instructions shall be indicated, particularly when the


stabilityoftheadditivedependsthereon.

5.2. For food additives that are packed in nonretail containers and/or solely
destined for further industrial processing, the required information, other
than those indicated in sub section 5.1.1. and 5.1.6. may be stated in a
brochure which shall be given to the buyer together with documents
relatingtoitssale.

Section6.OtherRequirements

6.1.OpenDateMarking

Prepackaged food shall be open date marked in compliance with the


GuidelinesforOpenDatemarkingofprepackagedFoods.

6.2.AlcoholicBeverages

Inadditiontothelabelingrequirementsundersection3ofthisregulation,
thealcoholcontentintermsofpercentagesorproofunitsshallbeindicatedon
theprincipaldisplaypanelofthelabelofalcoholicbeverages.

6.3.Language
6.3.1. The language used for all information on the label shall be either
Englishor Filipino or any major dialect or a combination
thereof. For food products intended for export the language
acceptabletotheimportingcountryshallbeused.

6.3.2. In the case of imported food products, labels where in the


informationaredeclaredinaforeignlanguagemustalsocarrythe
corresponding English translation, otherwise such products shall
notbepermittedforlocaldistribution.

6.4.AdditionalInformation

Additionalinformationwhenstipulated inaFoodStandardoranyother
BFADregulationshallbeindicatedonthelabel.

Section7.MisleadingDeclarations/Representations

The situations described in this section are example of what have been
consideredmisleading.TheBFADreservesitsrighttoruleagainstotherformof
misleadingdeclaration/representations.

7.1.Anyrepresentationrelativetotheflavorofthefoodproductasdepictedon
thelabel,labelingoradvertisingmaterialwhichisinconsistentwithSections
3.2.3.2and3.2.3.3.

7.2.UseofPhotographsandGraphicRepresentations

7.2.1. Photographs of fruits, vegetables, poultry, fish, meat or eggs


whether fresh or cooked, whole or sliced shall not appear on the
labelunlesstheproduct contains such materials or substances
naturallyderivedfromthem.Ifflavoring substances have been
addedtoboostorreinforcethenaturalflavorofagivenmaterial,
the words Flavor Added or any statement to that effect shall
appearconspicuouslyandincloseproximitytothephotograph.

7.2.2. Graphic representations used to depict the above mentioned


materials(fruits,vegetables,etc.)areacceptableprovidedthesedo
notvividlyillustratetheactualappearanceofsuchmaterials.

7.2.3.Picturesoffoodpreparationsordishesmayappearonthelabelsof
productslikesaucemixesorothersimilarproductsthatareused
asingredient(s)
for the preparation of such food/dishes
providedthestatementServing Suggestion or any other
statementofsimilarimportappearwiththepicture.
7.3UseofNamesofPlaces
7.3.1Namesofplacesmaybeusedaspartofthenameoftheproduct(a)
ifthe productisproducedintheplacecitedor(b)iftheproduct
containsthe characterizing ingredient(s) and/or prepared in
exactlythesamemannerasthe
product identified with said
place.However,inthecaseof(b),iftheplacecitedis
in another
country, it shall be qualified by the word style except when
reference
to the place is accepted as a generic term for that
product.

7.3.2. Use of names of places as Brand Name is acceptable provided the


presentationisnotmisleading,i.e.,itdoesnotappearaspartofthe
nameoftheproduct.

Section8.Exemptions

8.1.Exemptionsfromthelabelingrequirementsshallbeallowedinthefollowing
situation:

a)Ashipmentorotherdeliveryofafoodwhichisinaccordancewiththe
practice of the trade, to be processed, labeled or repacked in
substantialquantityat establishment other than that where
originallyprocessedorpacked,shallbe
exemptfromcompliance
with labeling requirements during the time of introduction into the
movement in commerce and the time of holding in such

establishment.

b)Afood,whileheldforsale,shallbeexemptfromlabelingrequirements,
if said food, having been received in bulk containers at a retail
establishment,is accurately weighed, measured or counted either
withintheviewofthepurchaserorincompliancewiththepurchasers
order.

8.2Exemptionsfromanyspecificprovision(s)ofthislabelingregulationmaybe
grantedunderjustifiablecircumstances.Petitionforsuchexemptionsshould
besubmittedtotheBureauofFoodandDrugsforappropriateaction.

Section9.Anyarticleoffoodthatismisbrandedwhenintroducedintodomestic
commerce may be seized when the director of Bureau of Food and
Drugs or his duly authorized designate has probable cause to
believed from facts found by him or any official or employee of the
BureauofFoodandDrugsthatthemisbrandedarticleisdangerousto
health,orthatthelabelingofthemisbrandedarticleisfraudulentor
would be in material respect misleading to the injury or damage of
thepurchaserorconsumer.

Section 10. Any violation of the provision of this rules and regulation shall
renderthearticlemisbrandedandtheresponsiblepersonshallbe
subject to the penal provision of section 12 (a)of R.A. 3720. In
addition, administrative sanctions, such as suspensions or
revocationoflicensetooperate,finesorwrittennoticeofwarning,
may likewisebeimposedby theBureauofFoodandDrugs,inthe
discretionofitsDirector.

In case of the juridical person, the penalty arising out of the criminal
offense, shall be imposed upon the president, Manager or head and of the
members of the Board of Directors or governing body of the firm or
establishment.

Section11.Allorders,regulationorguidelinesorpartsthereofinconflictwith
theprovisionsofthisAdministrativeOrderareherebyrepealedor
modifiedaccordingly.

This regulation shall take effect immediately upon approval and publication in
theOfficialGazette.

There shall be a maximum period of 18 months from the date of effectivity to


modify and consume inventoriesof existing prepackaged food labels which are
violativeofthisregulation.InthecaseofgrossviolationtheBureauofFoodand
Drugsshallordercompliancewithinaperiodshorterthan18months.

High temperature and humidity which is characteristic of tropical


conditions tend to affect the stability of food products, contributing to their
rapid deterioration. Hence, date marking of prepackaged foods is deemed
necessaryinordertoprovideinformationfortheprotectionoftheinterest
andhealthofconsumers.
12.0 Section 15(f) of the Food, Drug and Cosmetic Act provides that a food
shall be deemed to be misbranded if any word, statement of other
information required by or under authority of this Act to appear on the
label or labeling is not prominently placed thereon with such
conspicuousness and in such terms as to render it likely to be read and
understood by the ordinary individual under customary conditions of
purchaseanduse.UndertheauthorityofthisSectionandsection26(a)of
R.A.3720,thisOrderisherebyprescribed.
12.1AsusedinthisOrder,theterms:

(a)Prepackagedmeanspackagedormadeupinadvance,readyforretail

inanycontainer.
(b) Lot number, batch number or control number refer to any
combination of letters or numbers by which the history of the
manufacture, control, packaging and distribution of the product is
determined.

(c)"Consumebefore"dateistheperiodafterwhichthequalityofthe
product or any specifications (microbiological quality, nutritional value,

12.2Inadditiontothelot,batchorcontrolnumber,packagesofprocessedfoods
listed in Section 12.3 of this Order shall be embossed or otherwise
permanently marked with a "consume before" date which shall be
expressedintermsofmonthandyeare.g."consumebeforeMay1980."
12.3 The following processed foods shall carry a "consumer before" date and

I.Rationale

ItisapolicyoftheStateasembodiedinArticleII,Section15ofthe1987
Constitutiontoprotectandpromotetherighttohealthofthepeopleandinstill
health consciousness among them and in Section 12, Article XIII of the 1987
Constitution to establish and maintain an effective food and drug regulatory
systemandundertakeappropriatehealthmanpowerdevelopmentandresearch,
responsivetothecountryshealthneedsandproblems.

ItisfurtherdeclaredasapolicyoftheStateunderRepublicActNo.7394
ortheConsumerActofthePhilippinestoenforcecompulsorylabeling,andfair
packaging to enable the consumer to obtain accurate information as to the
nature, quality and quantity of the contents of consumer products and to
facilitatecomparisonofthevalueofsuchproducts.Itislikewisedeclaredtherein
that the State shall protect the consumer from misleading advertisements and
fraudulentsalespromotionpractices.

Intheimplementationoftheforegoingpolicies,Section15(2),Chapter4,
Title IX, Book IV of the Administrative Code of 1987 authorizes the Bureau of
Food and Drugs (BFAD) to act as the policy formulation and sector monitoring
arm of theSecretary of Health on matters pertaining tofood, drugs, traditional
medicines,cosmeticsandhouseholdproductscontaininghazardoussubstances,
and to formulate rules and regulations and standards in accordance with
Republic Act No. 3720, as amended by Executive Order No. 175 s. 1987, and
other pertinent laws for their proper enforcement. In addition, the BFAD is
empowered to prescribe general standards and guidelines with respect to the
veracityofnutritionalandmedicinalhealthclaimsintheadvertisementoffood,
drugsandcosmeticsinthevariousmediaandtomonitorsuchadvertisements.

Ontheotherhand,theJointDepartmentofAgricultureandDepartmentof

Health Administrative Order (DAAO No. 20050001 and DOHAO No. 2005
0028) expressly cited in its premises that Philippine accession to GATTWTO
and various bilateral and multilateral trade agreements requires compliance
with international trade regulations, including the harmonization of national
food standards with international food standardsetting body as the Codex
AlimentariusCommission.Theharmonizationofstandards,foodinparticular,is
generallyviewedasacontributoryfactortotheprotectionofconsumerhealth.

II.Guidance/Directive

Basedontheforegoingpremises,theBureauofFoodandDrugsunderthe
Department of Health, hereby adopts the Codex Alimentarius Commission
Guidelines for Use of Nutrition and Health Claims (CAC/GL 231997, Rev. 1
2004)intheevaluationoftheuseofnutritionandhealthclaimsinfoodlabeling
andintheadvertisementoffoodproducts.Theaboveguidelinesshallbeusedin
addition to, and in so far as it is consistent with, existing national laws on
labeling and advertisement of consumer products as well as the rules and
regulationsimplementingsuchlaws.

BUREAUOFPHILIPPINESTANDARDS(BPS)

The Bureau of Product Standards (BPS) is a governmental agency under the


DepartmentofTradeandIndustry(DTI).ItistheNationalStandardsBodyofthe
Philippines established by Republic Act No. 4109 (Philippine Standardization
Law)andExecutiveOrderNo.133.

As the National Standards Body, BPS is mandated to develop, implement, and


coordinatestandardizationactivitiesinthePhilippines.Itisprimarilyinvolvedin
standards
development,
product
certification,
and
standards
implementation/promotion to raise the quality and global competitiveness of
Philippineproductsatthesametimetoprotecttheinterests ofconsumersand
businesses.

Inordertodevelopreliableandmarketdrivenstandardsinallsectors,theBPS
focused its efforts on the implementation of the Philippine Standardization
Strategy(PSS),ablueprintofthestandardizationactivitiesofthecountry,which
intends to help strengthen Philippine competitiveness abroad, build upon
existingpublic/privatepartnershiptofurthergovernmentuseofstandardsand
toaddresskeyqualityoflifeissuessuchassafety,healthandtheenvironment.

Realizing the benefits of international standards to Philippine trade and


industrialdevelopment,theBPSensuresthatthePhilippineNationalStandards
(PNS) developed are at par with international standards. It has been actively
participating in international and regional standardization activities so as to
increase the competitiveness of Philippine products and services. The strategic
linkages of BPS includes its membership to the International Organization for
Standardization (ISO) and to regional bodies like the Asia Pacific Economic
Cooperation, SubCommittee on Standards and Conformance (APEC SCSC), and
theASEANConsultativeCommitteeforStandardsandQuality(ACCSQ).

TheBPS,throughitsProductCertificationScheme,makessurethatconformityin
standardsisstrictlyobservedbytheindustryinprovidingsafeandworldclass
products. Under the scheme, products that are covered by mandatory
certificationaresubjecttoinspectionsandtestsaccordingtotherequirementsof
a standard prior to selling and distribution. DTI issues the PS (Philippine
Standard)LicenseandtheImportCommodityClearance(ICC)tomanufacturers
andimporters,respectively,whichhavecompliedwiththescheme.

Moreover, BPS acts as the Enquiry Point and Notification Authority relative to
the implementation of the World Trade Organization (WTO) Agreement on
Technical Barriers to Trade (TBT). It notifies WTO of all proposed technical
regulations,standardsandconformityassessmentproceduresinthePhilippines;
provides stakeholders with copies of proposed standards, technical regulations

and conformity assessment procedures issued by WTO Members; receives


comments on proposed standards/regulations; and responds to questions on
standards,technicalregulationsandconformityassessmentactivities.

PhilippineStandards(PS)CertificationScheme

Department Administrative Order No. 01, Series of 1997: Revised Rules and
Regulations concerning the Philippine Standard (PS) Quality and/or Safety
CertificationMarkScheme.
BPSoperatesaproductcertificationschemeunderwhichamanufacturerobtains
alicensetousethePhilippinesStandard(PS)Qualityand/orSafetyMarksforits
capability to consistently manufacture products in accordance with a specific
Philippine National Standard (PNS) or an internationally accepted foreign
standard.

BPS issues the PS License to a manufacturer whose product has successfully


passedtherequirementsofaPNS.Withthelicense,themanufactureraffixesthe
PSMarkonhisproductorproductpackage.

The PS Quality Mark can be found on locally manufactured products and some
foreignsuppliedproducts.Itassuresconsumersthattheproducttheyarebuying
conform to the specific Philippine National Standard or to an internationally
acceptedforeignstandard.

The PS Safety Mark, on the other hand, when found on a product, especially a
household appliance or electrical products, guarantees the products
conformancetorelevantsafetyrequirements.

a. Halal
HalalFoodProductionGuidelines:

1.ESTABLISHMENT/PLANT

Theestablishmentorplantshouldbecleanandrequired
by Islamic law and comply with industrial and other
relevantstandards.
Halal food production premises must be exclusively
separatedbywallsorsimilarbarrierssoastoavoidand
prevent from contamination with things that are not
Halal.
Domestic animals or nonHalal food stuff or things, as
well as drinks with alcohol which are prohibited
accordingtoIslamiclawshouldbekeptawayfromthe
Halalfoodproductionpremises.

2.RAWMATERIALS/FOODINGREDIENTS/STORAGE

Raw materials and food ingredients must be edible and


safe for human consumption. This complies with Halal
certificationguidelines.
Raw materials for Halal food production must be stored
in a clean place without the possibility of coming in
contactwithdomesticanimalsorinaplacethatdomestic
animalscanaccessto.
Raw materials used for Halal food production must be
stricklykeptseparatedfromnonHalalgoods.

3.HOWTOCLEANRAWMATERIALS

Halalfoodsrawmaterialsandmustbewashedorcleaned
with running water before use. Accordingly, raw
materialsoranythingusedontheproductionlineshould
notbewashedorcleanedusingsuchusedwater.
AllequipmentsusedfornonHalal foodproductionmust
be cleaned or washed in the prescribed Islamic manner
priortoHalalfoodproduction.
All equipments used in Halal food production must be
strictly kept separated from equipment used for non
Halalfoodproduction.

4.PERSONNEL

Personnel involved in Halal food production must not


comeincontactwithnonHalalitemsaccordingtoIslamic
lawincludingpork,alcoholetc,orcomeintocontactswith
dogsduringdowntimes.
It is important that these should be Muslim personnel
available at the establishment or plant producing Halal
food products, particularly in the purchasing and
productionsections.

5.STORAGE/TRANSPORTATION

Finishedproductsmustabsolutelyandphysicallybekept
awayfromnonHalalproducts.
Halalproductsmustbetransportedseparatelyfromnon
Halalproducts.

6.DISTRIBUTION

Halal food products must be distributed or displayed


separatelyfromnonHalalfoodproducts.
The institute for Halal Food Standards of Thailand must
be notified as soon as possible about distribution
arrangements without packaging or not in the form of
packaging and Muslim personnel should be assigned for
supervisionatallitems.
All type of equipments or facilities used in distribution
must be strictly separated from non Halal goods, the
equipment must be cleaned in the prescribed Islamic
mannerandmethod.

7.HALALFOODSERVICEFORRESTAURANT/HOTEL

Apartfromtheabovementioned,thefollowingmustbefulfilledto
meetHalalrequirements:

Entrepreneurs, food producers or persons in charge of


productionmustbeMuslim.

preparation and serving suggestions that produce distinct sensory
propertiesassociatedwithtraditionalrecipesorcookingstylesofaregion
orplace oftheir origin.Thesecanalsobeadaptedfrom foreignculinary
stylesthataremodifiedtosuitlocaltastes.

Since these products are different from most common food


commodities that other countries are familiar with, they are often
evaluated based on existing standards set for products whose
characteristics are closely associated with ethnic food products. This
practice often leads to inconsistencies contribute contentious technical
barriers to trade leading to poor acceptance and performance of ethnic
foodproductsintheexportmarkets.

To address these problems, technical guidelines are provided for


local processors to adopt to ensure the quality and safety of these food
products.Likewise,thesewillallowleverageagainsttechnicalbarriersto
trade in the liberalized global market, thus, ensuring better
competitiveness and market acceptance of our ethnic food products.
These standards are hereby promulgated in accordance with the
provisionsof:

(1)Section3(a)and(b)and26(a)ofRepublicAct3720,theFood,
Drug and Cosmetic Act, as amended by sections 4 and 19 of Executive
Order 175 (An Act to Ensure the Safety and Purity of Foods and
Cosmetics, and the Purity, Safety, Efficacy and Quality of Drugs and
Devices Being Made Available to the Public, Vesting the Bureau of Food

and Drugs with Authority to Administer and Enforce Laws Pertaining


Thereto,andforotherPurposes):and,

(2) Republic Act 7394, The Consumer Act of the Philippines,


(1992) mandating the Department of Health to adopt measures to
ensurepureandsafesupplyoffoodsandestablishstandardsandquality
measuresforfood.

II.SCOPE

This standard prescribes quality requirements and specifications


for ETHNIC FOOD PRODUCTS, specifically for 1.) Dry Base Mixes for
SoupsandSauces,and2.)SweetPreserves.

III.GENERALOBJECTIVES

1. To ensure food safety and harmonize with international food


control laws, rules and regulations in ensuring better access to
domesticandexportmarkets.

2. TodevelopandpromulgatestandardsforEthnicFoodProductsin
line with the governments efforts to upgrade the quality of such
productsinordertoimproveitsacceptanceintheexportmarket.

3. Tostrengtheninteragencylinkagesinordertomaximizetheuse
ofEthnicFoodProducts.

4. Topromotetheadoptiontheadoptionofstandardsincooperation
withconcernedgovernmentagencies.

IV.DEFINITIONOFTERMS

Forthepurposeofthisstandard,thefollowingtermsshallmean:

Container means any form of packaging material, which completely or


partiallyenclosesthefood(includingwrappers).Acontainermayenclose
the food as a single item or several units or types of prepackaged food
whensuchispresentedforsaletocustomer.

Contaminants are any biological or chemical agent, foreign matter, or


other substances that are not intentionally added to food, which may
compromisefoodsafetyorsustainability.
Food is any substance, whether processed or semiprocessed or raw
which is intended for human consumption and including beverages,
chewinggumandanysubstance,whichhasbeenusedasaningredientin
themanufacture,preparationortreatmentoffood.

Food Additives means any substance not normally consumed as a food


byitselfandnotnormallyusedasatypicalingredientofthefood,either

ornotithasnutritivevalue,theintentionaladditionofwhichfoodfora
technological (including organoleptic) purpose in the manufacturing,
processing,preparation,treatment, packaging,transportorholdingsuch
food results or maybe reasonably expected to result (directly or
indirectly) in its or its by product becoming a component of (or
otherwiseaffectingthecharacteristicof)suchfood.

Food Standard is a regulatory guideline that defines the identity of a


given food product (i.e. its name and the ingredients used for its
preparation) and specifies the minimum quality factors and, when
necessary, the required fill of container. It may also include specific
labeling requirements other than or in addition to the labeling
requirementsgenerallyapplicabletoallprepackagedfoods.

Good Manufacturing Practices (GMP) is a quality assurance system


aimed at ensuring that products are consistently manufactured, packed,
repackedorheldtoaqualityappropriatefortheintendeduse.Itisthus
concernedwithbothmanufacturingandqualitycontrolprocedures.

Hazard Analysis and Critical Control Points (HACCP) is a preventive


foodqualitymanagementsystem,whichidentifies,evaluatesandcontrols
thehazardssignificanttofoodsafetyspecifictoaproduct.

Heat processed food is anyfoodprocessedby heat toan extent, which


resultsinaproductthatissafeandwillnotspoilundernormallyexpected
temperatureofnonrefrigeratedstorageandtransportation.

Hermetically sealed containers are containers, which are sealed to


protectthecontentsagainsttheentryofmicroorganismsduringandafter
heatprocessing.

Ingredientisanysubstanceincluding,foodadditiveusedasacomponent
in the manufacture or preparation of a food and present in the final
productinitsoriginalormodifiedform.

Labeling means any written, printed or graphic matter (1) upon any
article or any of its container or wrappers or (2) accompanying the
packagedfood.

Lotisfoodproducedduringaperiodoftimeandundermoreorlessthe
samemanufacturingconditionindicatedbyaspecificcode.

Lowacidfoodisanyfood,otherthanalcoholicbeverages,withpHabove
4.6andawateractivity(aw)greaterthan0.85.
Packaging is the process of packing that is part of the production cycle
applied to a bulk product to obtain the finished product. Any material,
including painted material, employed in the packaging of a product
including any outer packaging used for transportation of shipment.

Packaging materials referred to as primary or secondary according


whetherornottheyareintendedtobeindirectcontactwiththeproduct.

ProcessedFoodreferstofoodthathasbeensubjectedtosomedegreeof
processing (e.g. milling, drying, concentration and canning, etc.), which
partially or completely change the physiochemical and/or sensory
characteristicsoftherawmaterial.

Pasteurization is the heating of food at 100oC or below at a specified


time.

pHistheintensityordegreeofacidityofafoodmaterial.

Processing the part of production cycle starting from weighing of raw


materialstotheobtainingofbulkproduct.
V.GENERALGUIDELINES
1. AllingredientsofEthnicFoodProductsshallbeclean,ofoptimum
qualityandfitforhumanconsumption.(QualityRequirements)

2. Food Additives, when used shall be prepared in accordance with


theBFADregulations

3. All products covered by this standard shall be prepared in


accordance with the BFAD regulations on Current Good
ManufacturingPractice(cGMP), or the General PrinciplesofFood
Hygiene,orotherprinciplesofothercodesofhygienicpracticeas
recommendedbyCodexAlimentariusCommission.

4. TotheextentpossibleinGoodManufacturingPractice,theproduct
shallbefreefromobjectionablematter.

5. When tested by appropriate methods of sampling and


examination, the product: shall be free from microorganisms in
numbers, which may represent a hazard to health, shall be free
fromparasites, whichmayrepresent ahazardtohealth,shallnot
contain any substance originating from microorganisms in
amounts,whichmayrepresentahealthhazard.

6. Theproductsshallbepackedinsuitablepackagingmaterials.

7. Each container shall be labeled and marked in accordance with


BFADlabelingregulations.

8. AmanualcontainingthedetailedguidelinesonALLspecificethnic
food products such as Dry Base Mixes for Soups and Sauces and
SweetPreservesshallbeavailableattheBureauofFoodandDrugs
(BFAD)forallconcerned/interestedparties.

VI.REPEALINGCLAUSE

All other administrative issuances or parts thereof, inconsistent


with the provisions of this Order are hereby amended, repealed or
modifiedaccordingly.
