Los Angeles County Metropolitan Transportation Authority (Metro)

Federal Fiscal Year 2007 Disadvantaged Business Enterprise (DBE) Overall Goal

Metro in accordance with requirements of the U.S. Department of Transportation

(DOT) DBE Program Final Rule, 49 Code of Federal Regulation (CFR), Part 26, as
amended, hereby notifies the public that it is recommending the following DBE goal
for Metro Federal Transit Administration (FTA) – assisted contracts during the
Federal Fiscal Year (FFY) 2007. The overall proposed DBE goal for FFY2007 is 13%.
This overall goal is established to achieve a “level playing field” for DBEs to
participate in Metro’s FTA-assisted contracting opportunities.

Metro’s FFY2007 DBE FTA annual goal and methodology is available for inspection
during regular business hours for 30 days from August 1, 2006 – August 30, 2006.
Written comments on the proposed overall DBE goal will be accepted for 45 days
from August 1, 2006 – September 15, 2006. The public may inspect and/or submit
written comments at/to Metro Headquarters, Diversity & Economic Opportunity

In response to the United States Court of Appeals for the 9th Circuit decision on the
Western States Paving Co. v. United States & Washington State Department of
Transportation case and FTA guidance, Metro will utilize race-neutral measures to
achieve its FFY2007 overall DBE goal. Metro invites public participation and input
from certified DBE firms and individuals who will provide general comments
concerning the DBE goal and race-neutral measures and those who are willing to give
verbal and/or written statements regarding past and current discriminatory practices
and the continuing effect of such discrimination in Metro contracting. The public
hearing will be held on Wednesday, August 23, 2006 at 1:00pm – 4:00pm, Metro
Headquarters, 3rd Floor, Board Room, One Gateway Plaza, Los Angeles, CA 90012.
