Definitions For the purpose of these terms and conditions (“Terms”): + "ATM" means ATM which is used for transactions - cash, check and Value Added Services. “Cards” shall mean such variant of ICICI Bank Debit Card, which has been issued by the ICICI Bank Private Limited (ICICI Bank”) and are valid. “Card holder” will be such customer/s to whom a Card has been issued and who is authorized to hold a Card. “Construct of the Campaign” shall mean those customers who conduct maximum value of prepaid mobile recharge transactions during Day using any ICICI Bank ATM during the Offer Period, “Day” shall mean for a period of 24 hours starting 12:00AM and ending 11:59PM during the Offer Period. “Offer” shall mean the Debit Card holder/s win an Obi mobile daily or/and TATA Zest car as mega prize provided they use ICICI Bank ATM machines only during the said promo period. The prizes will be handed over to the winners in 2 categories + The daily prize winner: To win an Obi mobile the customer has to be the highest spender on pre-paid mobile recharge through ICICI Bank ATM + The mega prize winner: to win the TATA ZEST car the customer/s has to be the highest spender on pre-paid mobile recharge through ICICI Bank ATM machines during the promo period Itis important that the customer/s uses only ICICI Bank ATM machines during the promo period. Failing to do so will disqualify the customer in the said promo Prizes will be delivered to the customer/s within 45 days from the end of the offer period “Offer Period” shall mean the period from December 01, 2014 to January 29, 2015 (both days included). “Participant(s}” shall mean Card holders; except for ICICI Bank employees who are part of the ICICI Bank ATM business, ATM Marketing and BIU teams including family and friends of such employees. “Prize(s)” shall mean ‘Obi mobile phones’ and ‘TATA Zest car’. “Primary Terms and Conditions” shall mean the terms and conditions applicable to the customer in addition to the Terms. “Void Entry” shall mean any kind of transaction at any Non ICICI Bank ATM during the Offer Period. ‘Such transactions shall not be considered for this Offer. “Winner(s)” shall mean Participant(s) who are eligible to win Prize(s) as per Clause Ill of the Terms. I Offer Construct: + Participant(s) who conducts the maximum value of prepaid mobile recharge during each Day, at ICICI Bank ATMs, during the Offer Period shall be eligible for Prize(s).. Ifa Card holder/s use any other bank’s ATM for any transaction, during the Offer Period, shall not be eligible to avail this Offer, ‘The maximum limit per transaction of prepaid mobile recharge at any ICICI Bank ATM is Rs.10, 000, Participant(s) can do multiple transactions in a Day to win the Prize. Only successful prepaid mobile recharge transactions made using ICICI Bank ATMs shall be taken into consideration to declare the Winner. Participant is eligible to win only one Prize during the Offer Period subject to terms and condition mentioned under Clause Il Prize{s) shall be given on ‘as is where is’ basis. ICICI Bank will not be responsible for the delay in handing over the prize/s if the same has been delayed from the 3” party/partner for any reason pertaining to them, The Winner(s} shall be announced within 45 days from the end of the Offer Period. ‘The Winner(s) of the Prize(s) shall be informed through email on registered e-mail id and/or SMS on registered mobile number. ICICI Bank is not responsible for the goods/services provided by third parties. ICICI Banks shall not be liable in any manner whatsoever for loss/damage/claim that may arise out of use or otherwise of any goods/service availed by the customer/s under the Offer. ICICI Bank shall not in any way be deemed to be making any representation whatsoever about the usefulness, wortness and/or character of any Prize(s) and shall not be responsible in any way what so ever for the same. The existence of a dispute with respect to, if any, regarding the usefulness, worthiness, nature and/or quality of the Prize(s), shall not constitute a claim against ICICI Bank After the Prize(s) has been delivered to the Winner, ICICI Bank shall not be responsible for any loss, damage, theft of the same ICICI Bank reserves the right to modify/change all or any terms and conditions of the Offer without assigning any reason/s or without prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank will not be liable in any manner whatsoever for any loss/ damage /claim/injury that may arise due to withdrawal or change in the terms and conditions of the Offer. This Offer cannot be clubbed with any other offer that may be available to the customers of ICICI Bank Limited. ICICI Bank reserves the right to disqualify/exciude any merchant establishment or customer from the Offer if any fraud lent activity is identified as being carried out for the purpose of availing the benefits under the program, or otherwise by the use of Card. ICICI Bank will not be liable in any manner whatsoever for any loss/ damage /elaim/injury that may arise due to such disqualifications. All taxes, duties , levies or other statutory dues and charges payable in connection with the benefits accruing under the Offer shall be borne solely by the Card holder/s and ICICI Bank will not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues. ICICI Bank shall be entitled to deduct or set off the amount of taxes, ete, if any mentioned above from all amount payable by ICICI Bank to the Card holders. The Offer and Prize(s) are subject to applicable Indian laws and such other terms and conditions as may be stipulated by ICICI Bank, The Offer and Prize(s) are not available wherever prohibited and/or on merchandise/product/services for which such programs cannot be offered for any reason whatsoever. ‘Terms and conditions from Tata Motors General Terms + The Alliance Partner, under the Offer, shall be directly making available to the Customers the Zest Car (hereafter “Gift") upon their qualifying and achieving the parameters as decided by ICIC| Bank and communicated in writing and agreed upon by both the Parties in writing, The participation in the Offer by the Customer(s) is entirely voluntary and it is understood, that the par n by the Customer(s) shall be deemed to have been made on a voluntary basis. The Offer is non-transferable, non-binding and non-encashable. The Offer is not valid for void transactions. ‘The Gift winners shall be intimated within 60 days from the end of the Offer Period, through email and phone call on their registered email address and registered mobile number respectively. The winner list shall also be displayed on the ICICI Bank’s website. Acceptance of the Offer by the Customer(s) constitutes permission for ICICI Bank and its Affiliates to use the Customer(s) name, photograph, other details which are furnished to ICICI Bank, voice and comments for advertising and promotional purposes in any medium without being liable to pay any additional charges to the Customer(s), The Alliance Partner will not be responsible for any omissions on part of ICICI Bank in publishing Customers’ name, address, photographs or any other details. The names of eligible Customers will be announced at the end of the Offer Period on a date as may be decided by ICICI Bank and intimated to the Alliance Partner in writing. All charges relating to delivery, registration of the product, applicable taxes, insurance, incedentals etc., wherever necessary, shall be borne by the winner. For all Gifts (mentioned above) ex-show room price will be considered for the Offer. ICICI Bank shall be entitled to deduct or set off the amounts of taxes, etc, if any, mentioned above from all amounts payable by ICICI Bank to the Customer(s) and balance amount, if any, of cash back will be paid to the Customer(s) / credited to the account of the Customer's}. Winner cannot exchange this Gift with any other model or cash Pictures in the communication are representative and actual Gift may differ. Accessories shown may not be part of standard Gift and standard warranty norms will be applicable. ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the assured Gifts under the Offer provided by the Alliance Partner. Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the Customer(s) due to provision of the Offer, shall be to the sole account of the Customer(s). Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the Custome Allissues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to the Alliance Partner directly without any reference to ICICI Bank. The same shall be addressed by the Alliance Partner, only up to a period of 30 days after the date of transaction/purchase. ‘The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner. The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever. ICICI Bank/Alliance Partner reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever. Responsibility of the Alliance Partner is limited to delivering Gift and providing the warranty as per the policies of Gift The Alliance Partner will not be held responsible for any further deliverables which may have been communicated by ICICI Bank to Customer. Winner would be directed to ICICI Bank and the Alliance Partner will not be held responsible for any issues pertaining to Customer account, eligibility to participate in the contest, and for any other banking related acts. All issues / queries / complaints / grievances relating to the Customer account, transactions, if any, shall be addressed to ICICL Bank directly without any reference to the Alliance Partner. The same shall be addressed by ICICI Bank, only up to a period of 30 days after the date of transaction/purchase. I the Customer ceases to be an ICICI Bank Customer at any time during the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the Customer, In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects. The Alliance Partner would be informed in writing about any changes being made to the program. ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the Gift and services offered by the Alliance Partner, ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any Gifts and services availed of by the Customer/s under the Program. ICICI Bank reserves the right to disqualify any Alliance Partner or Customer/s from the benefits of the Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer or otherwise by use of the Card at an ICICI Bank terminal. ‘The Offer is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever. Process for claiming the Gifts 1) Winning Customer will be announced by ICICI Bank and the winner will approach the Alliance Partner with the original letter / communication received from ICICI Bank which will have the details of the Gift and charges/taxes required to be paid by the Customer for the same. Customer will have to provide proof of identity and confirm his/ her intention to claim said Gift 2) Such winning Customer will have to provide copy of Gift tax and prize intimation letter to the concerned official of the Alliance Partner (with a copy to ICICI Bank). The winner will have to undergo all the other formalities and the process laid down by ICICI Bank and the Alliance Partner. 3) The Gift will be supplied by the Alliance Partner within a period of 3 months from the date of submission of the original letter to the Alliance Partner by the Customer and subject to the payment of all applicable taxes, by the Customer. Terms of the Offer + The offer is valid for ICICI customers only who participate in the ICICI Bank ATM promotion program + The Offer is valid only for select set of ICICI Bank Net Banking User(s) and ICICI Bank Cardholders selected at the sole discretion of ICICI Bank and who have received communication about the Offer from ICIC| Bank, during the Offer Period Participation in the Offer by the ICICI Bank Net Banking User/s/Cardholders is on a voluntary basis, The ICICI Bank Net Banking User/s/Cardholders may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier The Offer is non-transferable, non-binding and non-encashable Ul. Ifthe ICICI Bank Net Banking User ceases to be a ICICI Bank Net Banking User at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User. I Conditions: In addition to the terms and conditions of such partners offering benefits to ICICI Bank Credit/Debit Cardholders, the following terms are applicable to the Offer: ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services or the assured vouchers offered by the Alliance Partner. Any dispute or claim regarding the goods, services and assured vouchers must be resolved by the Customers/Card Holder/s with the Alliance Partner directly without any reference to ICICI Bank. ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/services /assured gifts/ prizes availed by the Customers/ Card Holder/s under the Program offered by the Alliance Partner. ICICI Bank reserves the right to disqualify the Alliance Partner or Customers / Cardholder /s from the benefit s of the Program if any fraudulent activity is identified as being carried out for the purpose of availing the benofits under the Program or otherwise by use of the Card. The assured gifts are sponsored by the Alliance Partner and the Customers/Cardholder/s shall be bound by the terms and conditions stipulated by the Alliance Partner in this regard, ICICI Bank shall not be held liable for any delay or loss that may because d in delivery of the goods and services or the assured vouchers ‘The Program is not available wherever prohibited and/or on merchandise/products/services for which such programs cannot be offered for any reason whatsoever.
