The Context
We are working for an European car-maker. one of our supplier is in
bankruptcy and refuse to pay back his debt in money or by acquiring the
foundry molds. Our company decide to go to law.

An uneasy situation

The main problem is the absence of written contracts, as many of the

agreements Mr. F did with Fonderie la Thierache (FdT) were
transmitted orally.
Some guarantee should have been planned when the relation was put
in place.
Another problem is due to the fact that Mr. F decided to recover
FdT only when the situation were already risky. In fact, the risk was
very high as the car-maker absorbed 60% of FdT capacity.
The exit strategy should have been thought in advance and the
amount of credit in FdT decreased in order not to risk an important
amount of money.
The absence of the three previous things causes the situation to be
uneasy for the car-maker because we cant prove easily our properties
and rights on FdT (e.g.: the foundry molds).
