Special Education Procedures

Determining Eligibility for Special Education and Related Services


When determining a students eligibility for special education services, the IEP team must follow the steps
outlined below.
Initial Eligibility
1. The LEA representative should assign roles at the on-set of the Eligibility Team meeting.
a. The recorder should complete the IEP/Staffing Meeting Summary form during the meeting. (See
the HCS IEP/Staffing Meeting Summary Procedure for further information on how to complete this
form)
b. The school psychologist should complete the Evaluation Results Summary and Eligibility
Determination form (P-1).
2. The IEP team members should each report/review the results of the evaluation components. The
school psychologist should check all areas reviewed in the first section of the P-1 form.
3. Following a discussion of the results, the IEP team then determines if the student meets the eligibility
criteria for special education and related services as outlined in the South Carolina Standards for
Evaluation and Eligibility Determination (SEED, 9/23/2011).
a. If the student does not meet the eligibility criteria for special education, the school psychologist
should check that box on the P-1. All participants should indicate their attendance by signing
page 2. Follow the process outlined in the IEP/Staffing Meeting Summary for providing prior
written notice to the parent of the decisions made at the meeting.
b. If the student meets the eligibility criteria for special education, the school psychologist/speech
clinician should check that box on the P-1 and check the box next to the area of disability
appropriate to the students eligibility. If determined eligible under the area of SLD, the school
psychologist will facilitate the discussion in the next section of the P-1 and document the
decisions.
c. If the student is eligible and an IEP will be developed, but not at this time, a meeting must be
reconvened within thirty (30) days.
d. If the student is eligible and an IEP will be developed at this time, the procedures for developing
an IEP and conducting an IEP meeting will be followed. Additionally:
i. The school psychologist/speech therapist should obtain the parents consent for the
students initial provision of special education on the Consent for Placement form
(Parcon-1).
ii. All participants should sign their attendance on the P-1 form, and
iii. The LEA representative will follow the process outlined in the IEP/Staffing Meeting
Summary Procedures for providing prior written notice to the parent of the decisions
made at the meeting.
e. If the student meets the eligibility criteria for special education and the parent refuses to consent
to the provision of special education and related services or the parent fails to respond to the
request, the District is not required to develop an IEP. (CFR 300.300 (b)(4)(i)(ii)). The parents
decision should be documented in the minutes of the meeting.
f. If the parent is not in attendance at the initial Eligibility Team meeting, IEP Services can not begin
until Consent for Placement (Parcon-1) is obtained.
4. The school psychologist should obtain the parents signature on the Medicaid Consent form (MC-1)
at this time if such consent is not already on file.
Reviewing the Results of a Reevaluation:

If additional evaluation information was determined necessary through a Reevaluation Review, follow
these steps for completing the form after the results have been obtained.
1. The IEP team members should each report/review the results of the evaluation components. The
school psychologist/speech therapist should check all areas reviewed in the first section of the P-1
form. Following a discussion of the results, the IEP team then determines if the student continues
to meet the eligibility criteria for special education and related services as outlined in the SEED
document.
a. If the student no longer meets the eligibility criteria for special education, the school
psychologist/speech therapist should check the box that the student does not meet eligibility
criteria.
b. All participants should indicate their attendance by signing the P-1. Follow the process
outlined in the IEP/Staffing Meeting Summary for providing written notice to the parent of
the decisions made at the meeting.
c. If the student continues to meet the eligibility criteria for special education, the school
psychologist/speech therapist should check that box and check the box next to the area of
disability appropriate to the students eligibility.
i. The special educator and related service provider(s), if appropriate, should then
revise the IEP in EXCENT as outlined in Chapter 3 of the IEP Process Manual. If a
Draft revised document has been developed, the special educator should review
each section with the team, making sure that the students evaluation results and the
educational implications therein are documented thoroughly and accurately as
presented in #2 above.
ii. All participants should sign their attendance on page 2.
iii. Follow the process outlined in the IEP/Staffing Meeting Summary for providing
written notice to the parent of the decisions made at the meeting.
