    This document is a Presidential Decree from March 20, 1978 that further amends previous decrees defining policies around expropriating private property for socialized housing. It allows the government or its authorized agencies, upon filing a petition for expropriation and depositing 10% of just compensation, to immediately take possession, control, and disposition of the private property and any improvements, even if issues are still pending in court.     WHEREAS,publicwelfarerequirestheimmediatetakingofpossessionanddevelopmentoftheprivateproperties
    soughttobeexpropriatedforsocializedhousing
    WHEREAS, doubts have also been expressed as to the extent of the power of the expropriating agency to take
    possession,controlanddispositionoftherealpropertyandtheimprovementthereon
    NOW,THEREFORE,I,FERDINANDE.MARCOS,PresidentofthePhilippines,doherebyorderanddeclarethat:
    Section1. Paragraph 3 of the Presidential Decree No. 1259 dated December 11, 1977 which amends the same
    paragraphinPresidentialDecreeNo.1224isherebyfurtheramendedasfollows:
    UponthefilingofthepetitionforexpropriationandthedepositinthePhilippineNationalBankatitsmainofficeor
    anyofitsbranchesoftheamountequivalenttotenpercent(10%)ofthejustcompensationprovidedforinSection2
    of Presidential Decree No. 1259, the government, or its authorized agency or entity, shall immediately have
    possession,controlanddispositionoftherealpropertyandtheimprovementsthereonwiththepowerofdemolition,
    ifnecessary,evenpendingresolutionoftheissuesthatmayberaisedwhetherbeforetheCourtofFirstInstance,
    CourtofAgrarianRelations,orthehigherCourts.
    Section2.Allacts,partsofacts,decrees,lettersofinstructions,ordersordinancesorrulesandregulationswhich
    areinconsistentherewithareherebyrepealed,amendedormodifiedaccordingly.
    DONEintheCityofManila,this20thdayofMarch,intheyearofOurLord,nineteenhundredandseventyeight.
