Final Complaint Decision

My Final Complaint Decision that Ive chosen takes place March 24, 2010 and
the parents made a complaint to the district about their childs services and what they are
receiving is fulfilled. It was alleged that the student wasnt receiving their reevaluation
over their OT needs in a timely manner. Also they said that they didnt provide special
education and other related services to the student related to the IEP. The student was
identified to have autism and, other health impairments, and speech/language
impairment. After receiving such information it is proven that the student is provided
with an IEP under IDEA. With a recent IEP meeting it was discussed that the students
behavior was interfering with their ability to learn. The student also had problems with a
regular attendance missing 134 class periods in the first semester and 109 in the second
semester. During this time the student had surgery that took time away from school and a
regular class attendance. They have a very thorough list of goals and benchmarks they
want the student to meet and if they have met these goals and what they have left to do.
After going over the IEP plan and goals they discussed the issues and how to
solve the complaint and problem. The OT was not provided for the student due to the
complaints proposal. The IEP also conducted that the student have a BIP and it said the
protocol was not implemented to the student at the right needs and times. There were
many letters written of notice that the students needs were not being given and that it
needed to be fixed. When given feed back of these letters it was said they wanted to try
and ease the stress of student. They were than told that the student would get an OT and
it would be given by an Occupational Therapist. The districted issued that the student be
given additional sensory supports and the team agreed and said an OT would be
necessary as soon as possible. There was then a written consent that the student will have

a reevaluation every three years, but the district recorded that the complaint did not offer
consent of this. The OT evaluation was given and the complaint participated in the
evaluation through completion of an interview.
For the conclusion they did conclude that the records showed the district
communicated regularly with the complaint about the students concerns and needs. They
concluded that the OT was necessary to gather more information on the student but the
complainant was not willing to make the time for the evaluation. The complainant were
the reasoning for such a long delay when trying to give the OT so therefore the parents
were the reasoning behind the five month delay. For the second issue the district
however was at fault, they did not report their academic goals of the student and her
progress in the fall of 2009. All in all both were in fault and needed to be more willing
and on task when working with the IEP. I feel both needed to comply and work together
to get results they needed from the student. The stress the student had I feel came from
frustrated parents not getting the answers they wanted and teachers trying to do things
that the student might not have been ready for. When working with students with such
learning disabilities it is important to take in to consideration the student and needs of
how to reach their goals. To fix these problems the districted needed to have written
information on what and when they have planned to do.
