Address: Unit 101-106 Agapita Condo. 11832 Leon Guinto St, Malate Manila And Employee: Mir/Ms. ANTHONY JAY KELTRAN, nationality Filipino , born in LIMAY BATAAII 0n.22/10/1981with address at ORTON BATAAN PHILIPPINES 1) Employee's Position NO. CODE ROME:61231-00a The Employee shall be employed as SUPERVISOR _ exclusively a Koniambo site, New Caledonia 2) Duration and Place of Assignment According to Articles Lp. 621-1 and 621-2 of the New Caledonian labour code, the Employee will be temporarily transferred to New Caledonia and assigned to the construction site of the KONIAMEO NICKEL plant in New Caledonia, from date of arrival at KONIAMBO Project site and for a duration of 12 (Twelve) Months This assignment may be extended for a maximum period of six (6) Months at the discretion of the company and subject to the issue of an extension visa by the New Caledonian authority, Such extension is governed by the Visa requirements in New Caledonia whereby only a single visa extension of 6 months is available 3) Wages In remuneration for his work, the employee will receive, from the employment dato, a gross monthly wage of US$_2.400 before overtime. The current Project hous of work are Sbty (60) hours per week ‘This wage corresponds to a monthly one hundred sixty-nine (169) working hours. Hours beyond the thirty-ninth (39" of the week will be paid with a 25% overtime premium for the first eight (8) hours, and a50% overtime premium after eight (8) hours. tn case of @ varlance of the exchange rate of US$ versus the French CFP, and if the amount of the salary converted into French CFP is lesser than the amount in French CFP of the Mininium Guaranteed Salary as defined by the regulations as applicable in New Caledonia, the Employer will adjust the salary in order that the salary will not be less than the NC Minimum Guaranteed Salary. Benefits in kind, as defined in this contract, will be deducted from the gross wage, being précised that benefits in kind cannot represent more than one third (1/3) of the gross wage.
