URGENT EX-PARTE MOTION TO RESET

COUNSEL FOR THE PLAINTIFFS, unto this Honorable Court
most respectfully avers: THAT--1. This case was set for hearing by the counsel for defendants on
24 June 2011 at 8:30 AM for the consideration of their cautionary
answer with motion to dismiss (again). Plaintiffs have already filed their
reply and comments to the same.
2. However, undersigned counsel will be obligated to attend the
hearing of Election Case Nos. H-025 entitled Dr. Ma. Janice A. Lloren v.
Silvestre Lumarda before the Regional Trial Court, Branch 18,
Hilongos, Leyte as counsel for the protestee, on 24 June 2011,
evidenced by the Court Order dated 14 June 2011, and hereto attached
for the perusal of the Honorable Court.
3. It is undisputed that an election case takes precedence over
all other cases. Certainly, this is not an unnecessary or unmeritorious
postponement.
4. This motion is not intended to unduly delay the proceedings
but due to the aforecited reason.

WHEREFORE, premises considered, it is respectfully prayed of

this Honorable Court to reset the hearing on 24 June 2011 at 8:30 AM
to a date available to both parties and the court, preferably on 8 July
2011.
