SCHEDULING ORDER AND


ORDER ON PLAINTIFF’S MOTION TO COMPEL

On May 2, 2007, this court held a status conference pursuant to Fed. R. Civ. P.

16(a) and a hearing to consider oral argument on the “Plaintiff’s Motion to Compel

Production of Documents Pursuant to F. R. Civ. P. 37(a)” (Docket No. 40). After

reviewing the parties’ submissions and considering the parties’ arguments, this court

hereby ORDERS as follows:

1. The plaintiff’s motion to compel is DENIED WITHOUT PREJUDICE.


The parties are to confer, and plaintiff will file a supplemental motion to
compel if necessary.

2. The parties shall complete fact discovery by July 13, 2007.

3. The parties shall file any motions for summary judgment by August 31,
2007. Any oppositions to motions for summary judgment should be filed in
accordance with the applicable rules.

4. Any concise statement of material facts that is filed pursuant to Local Rule
56.1 in opposition to a motion for summary judgment shall include

numbered paragraphs admitting or denying, paragraph by paragraph, the


facts contained in the moving party’s concise statement of material facts.
