MONTHLY RETAINER The monthly retainer fee for retainer arrangements whereby the attorney is readily avaliable to render exclusive professional service to the retaining client on routine matters affecting the clients personal or business interests and legal affairs which may include notarial services, but excluding the drafting or preparation of documents and collection cases shall be at least P 5,000.00 per month, 12. EXPENSES AND DISBURSEMENTS. Al fees in this Schedule of Minimum Fees for Legal Services shall be exclusive of all expenses necessary or incidental to the fing and prosecution ofthe cause of the client or representing the interests of the client, Such expenses shall be borne or paid by the client separately from the fees forthe legal services rendered by the attorney. 13, ATTORNEY'S LIENS ‘An attorney shall have a lien upon the funds, documents, and papers of the client which have lawfully come into his possession and may retain the same unti his awful fees and disbursements shall have been paid. Subject to the rules of procedure and ethics, the attorney may apply such funds to the satisfaction of the fees and expenses to \which he is entitled and he shall have lien thereon pursuant to Rule 138, Section 37 of the Rules of Court ofthe Philippines. 14, REVISION The Schedule of Minimum Fees for Legal Services may be revised {rom time to ime as the Board of Officers ofthe Integrated Bar of the Philippines, lilo Chapter may deem just, proper, and desirable after giving due consideration to the changes in time, circumstances, and the rules of procedure or those that govern the practice of law and the conduct of lawyers. 15, EFFECTIVITY This Schedule of Minimum Fees for Legal Services shall be effective on January 1,2009. gr Bl in ce RESOLUTION APPROVING THE REVISIOl OF SCHEDULE OF MINIMU FEES FOR LEGAL SERVICE WHEREAS, the Schedule of Minimum fees for L Services of the IBP Iloilo Chapter was revised on Jani 11,2002; WHEREAS, the Schedule provides that it ma revised from time to time, considering the prevailing lation and the change in the effective purcha: power of mone} WHEREAS, the prevailing socio-economic condi requires a revision of the 2002 Schedule of Minin Fees for Legal Services; WHEREAS, Rule 2.04, Canon 2 of the Code Professional Responsibility promulgated by the Supr Court of the Philippines in June 21, 1988 provides the lawyer shall not charge rates rates lower than custom prescribed unless the circumstances so warrant.”; WHEREAS, the committee on Revision created by Board of Officers has filed its Report and submittec final draft of the 2009 REVISED SCHEDULE of MININ FEES FOR LEGAL SERVICES which the Board finds t fair, reasonable and just; NOW THEREFORE, be it resolved, as it is he resolved, that the 2009 REVISED SCHEDULE MINIMUM FEES FOR LEGAL SERVICES embo herein, be approved, as it is hereby APPROVED, and henceforth all member of this Chapter are enjoine follow this Schedule.
