This action having been duly commenced by the filing of a

summons and complaint on July 30, 2004 with the Clerk of the

County of Suffolk, and the action having been trsinsferred to

Westchester County and continued under the verified Second

Amended Complaint dated May 12, 2005 and verified by Anthony

Dorsa, Vice President of plaintiff Apollo H.V.A.C. Corporation

on May 12, 2005 (attached as Exhibit A hereto) on the first cause

of action against defendant Halpern Construction,

breach of contract (Little Neck Project)

$153,779.10 plus interest; on the seventh cause of action against

defendant Halpern Construction, Inc., for breach of contract

(Boro Park Project) in the sum of $114,207.85 plus interest; on

the thirteenth cause of action against defendant Halpern
Construction, Inc., for abandonment of contract (Little Neck

Project) in the sum of $153,779.10 plus interest; on the

fourteenth cause of action.against defendcuit Halpern

Construction, Inc., for abandonment of contract (Boro Park
Project) in the sum of $114,207.85 plus interest; and the issues

having duly come on for trial at the central calendar part of

this Court on November 24, 2008 and the plaintiff Apollo H.V.A.C.
Corporation appearing by SteVenG. Rubin, Esq. for the firm of

Steven G. Rubin &Associates, P.C. and the defendant Halpern

Construction, Inc. having defaulted in appearance and its default
duly noted:

ADJUDGED AND DECREED, that the plaintiff Apollo H.V.A.C.
Corporation, 225 North Fehr Way, Bay Shore, New York 11706
recover of defendant Halpern Construction, Inc., 467 North

Avenue, New Rochelle, New York, the sum of $257,986.95 together

with interest from July 30, 2004 at the rate of 9% per annum to
the date of this judgment in the sum of $104,138.00, making a
total of $372,124.95 together with costs and disbursements in the.

sura of $200.00,. making a total of $372,324.95; and that plaintiff
