RESOLUTION REGARDING THE DISCLOSURE AND SHARING OF
PRIVILEGED CORRESPONDENCE AND
‘THE USE OF NEGATIVE PERSONAL EPITHETS DURING COMMISSION MEETINGS
RESOLUTION NO. 15-03
At the regular meeting of the Charter Township of Oakland Parks and Recreation Commission held on Wednesday,
September 9th, 2015, the following Resolution was moved by Commissioner ‘and seconded by
Commissioner :
WHEREAS: The Charter Township of Oakland Parks and Recreation Commission periodically finds it nevessary to
seek legal advice and opinions from professional Legal counsel (Licensed Attorney) in his/her capacity as such;
WHEREAS; The Charter Towuiship of Oakland Parks and Recreation Commission periodically discusses strategies for
the acquisition of real property with the Commission's Authorized Real Estate Agent;
WHEREAS: Communications relating to these purposes are made in confidence between the client (the Charter
‘Township of Oakland Parks and Recreation Commission), employees authorized by the Commission, and the
Commission's legal counsel or real estate agent;
WHEREAS: Those communications are permanently protected ftom disclosure by the Client, or by an authorized
employee, legal counsel, or real estate agent, in the rightful expectation of ethical and honorable conduct by the
Commission members, employees, and professional consultants; except if the protection be explicitly waived by the
Client (Charter Township of Oakland Parks and Recreation Commission), for the benefit of the Client or in compliance
with the laws
WHEREAS: Communications made during Closed Session Meetings of the Charter Township of Oakland Parks and
Recreation Commission are considered confidential, privileged and protected from disclosure;
WHEREAS: The Charter Township of Oakland Parks and Recreation Commission views any unauthorized disclosure
of privileged and confidential communication to be a breach of the public trust;
WHEREAS: The public meetings of the Charter Township of Oakland Parks and Recreation Commission have been
repeatedly disrupted by a member's unethicel public use of negative descriptions and accusations directed at named
members of the Commission;WHEREAS: The Charter Township of Oakland Parks and Recreation Commission does hereby determine that based
upon the observetion of inappropriate use of negative epithets directed against named Commissioners during publie
meetings of the Commission, and based upon the materials reviewed, showing that there has been the inappropriate
release of confidential and/or attorney-client privileged communications, these behaviors are repudiated by the
Commission;
the Charter Township of Oakland Parks and Recreation Commission observes that the aforementioned
breaches of ethical and honorable conduct, which in the opinion of this Parks and Recreation Commission constitute
breaches of the public trust, have been carried out by a single individual Commissioner,
THEREFORE, BE IT RESOLVED: The Charter Township of Oakland Parks and Recreation Commission does
hereby censure Commissioner Ann Marie Rogers for the aforementioned breaches of ethical and honorable conduct.

Parks and Recreation Commission at their regular mecting held on Wednesday, September 9th, 2015, at 7:00pm in the
Oakland Township Hall, 4393 Collins Road, Rochester, Michigan, 48306, with a quorum present,
