Theconsultationmaintainedafocusondomesticissues,howeverseekingasylumon
thebasisofsexualorientationwasraisedasanareaofconcern.Australiaisoneofan
increasingnumberofcountriesaroundtheworldthatrecognisesexualorientationand
genderidentityasvalidgroundstoclaimasylum.Whilethisispromising,alackof
consistencyindecisionmakingcombinedwithalackofresourcestoassistin
understandingtheuniqueidentitiesandexperiencesofsexualandgenderminorities
hasledtonumerousclaimsforasylumbeingimproperlydecidedorlitigated.1
Researchonalargedatasetofover600Australiancaseshaverevealedoverturnrates
ofapproximately30%forsexualorientationbasedclaimsincomparisontoarateof
approximately15%onotherclaims.2Basedonthisevidence,itiscleardepartmental
decisionmakingconcerningsexualitybasedclaimsrequiresimprovement.The
currentinconsistencyindepartmentalleveldecisionsonsexualorientationandgender
identitypresentanunnecessarycostburden,andfurtherinhibitsAustraliafrom
meetingitsobligationsunderinternationaltreatiesithasratified.3
ForexampletheRefugeeCouncilofAustraliasubmitted:Analysisofthelimited
informationavailablenamely,decisionrecordspublishedbytherefugeereview
tribunalandAustraliancourtssuggestthattherearesignificantshortcomingsin
Australiasprocessesforassessingsexualorientationbasedclaims.Keyissuesof
concernincludesignificantinconsistencesindecisionmaking;useofinappropriate
methodstoassesscredibility(suchasrelyingonstereotypes,failingtotakeinto
accountdifferencesinculturalnormsandaskinginvasivequestionsaboutthe
personssexualhistory);useofpoorqualityorunreliablecountryoforigin
information;andlackofunderstandingofthediversityofhumansexuality.4
Properlyassessingclaimsforasylumonthebasisofsexualorientationisparticularly
complexbecauseitisnotsuperficialorcannecessarilybeprovenbysexualactivity.
However,fortheintegrityoflegitimateLGBTIQasylumseekerapplications,rigorous
andobjectiveassessmentisnecessary.
