directingDefendantstomaintain(andnotterminate)theInternetservice,modemdeliveries,and
MotionisALLOWED:(seeOrder):Plaintiffshavedemonstratedastronglikelihoodof
successonthemerits.Thebalanceofharmsalsofavorsplaintiffs. ThisCourt'sintentistoput
plaintiffsinthatpositionthattheywouldoccupyundertheirexistingagreementswith
Clearwire. Itisnottoimposeaffirmativeobligationswhichcannotbefeasiblycompliedwith,
ortorequirethatSprint:a)reactivateanypartsoftheWiMAXservicewhichhavealreadybeen
shutdown,orb) provideservicewhichisbetterthanthatwhichClearWirewascontractually
obligated toprovide. AdetailedMemorandumofDecisionwillbeissuedassoonaspossible
toexplainfurthertheCourt'sreasoning.
