State of New York, in Letter Brief

Submitted to Court of Appeals in

this Case, August 19, 2011
In 2007, in response to Campaign for
Fiscal Equity v. State of New York . . .
the Legislature enacted . . . . increased
school aid, called Foundation Aid, to
all the school districts in the State
based on a funding formula that takes
into account the needs of the students
and districts. (p. 1)
*

[T]he long-term formulaic changes

embodied in the 2007 legislation . . .
were enacted to reflect the estimated
cost of providing a constitutionally
adequate education in this State (p. 8)

State of New York, in Brief

Submitted to Supreme Court in this
Case, January 25, 2016
Plaintiffs assertion that Foundation
Aid as originally enacted in 2007
represented the minimum spending
necessary for providing the opportunity
for a sound basic education . . . . is
severely flawed and should be
rejected (p. 10)
*

Foundation Aid as adopted by the

Legislature in 2007 was never intended
to represent the constitutional
definition of the resources necessary to
provide a sound basic education (p.
14)
