Potential Wording for Photography Agreement with a Rescue / Charity 1

[Name of Photographer] is pleased to support the work of [Name of Rescue or Charity]


through taking photos to promote the fostering or adoption of animals in their care. The
following is intended to clarify the respective responsibilities of photographer and
rescue/charity and how the resulting photographs will be used.
1. Copyright. Under the Copyright, Designs and Patents Act 1988, copyright
photographic images remains with the photographer. However, [Name of Photographer] will
grant license (i.e. give permission) for [Name of Rescue or Charity] to use the images
provided to raise awareness of animals awaiting adoption.
A. [Name of Photographer] gives permission for the rescue/charity to include images
on their website, social media channels, newsletters, information leaflets and
correspondence with potential adopters.
B. Images used must either retain the photographers watermark or include reference
to copyright somewhere near the image (e.g. [Name of Photographer] 2016 in
the caption or All images [Name of Photographer] 2016 if several are used.
C. Where images appear in digital media (e.g. social media, websites, emails, etc.)
they should ideally include a hyperlink to the [Name of Photographer] website (or
social media page or email, if they dont have a website.)
D. Images cannot be cropped, edited or altered in any other way without the
permission of [Name of Photographer.]
E. If the [rescue/charity] would like to use the images for any other purpose or in any
alternative form, they must first gain consent of [Name of Photographer.] 2
2. Waiver of Liability. [Name of Photographer] will take all reasonable steps to reduce
risks during photo sessions. However, [Name of Rescue or Charity] will be responsible for
the care and well-being of animals and health and safety of staff and volunteers during photo
sessions. [Name of Rescue or Charity] will release the photographer from all claims,
damages or liabilities that may result from accidents or incidents that occur during or after a
photo session. This includes waiver of any claim that may be a result of negligence.
3. Compensation. There will be no payment to [Name of Photographer] for the service,
other than for travel and subsistence if [Name of Rescue or Charity] chooses to provide this.
There will also be no compensation to [Name of Rescue or Charity] if they do not find the
resulting images to be acceptable for their purposes.
4. Photographers Use. [Name of Photographer] may include images from photo
sessions with [Name of Rescue or Charity] as examples of their work in portfolios, websites,
social media channels, displays and competitions. These will include reference to [Name of
Rescue or Charity] and include a hyperlink to the charitys website, social media channel or
email if appearing in digital media. [Name of Photographer] will not sell images from photo
sessions (e.g. as stock images, as art works, to news media, etc.) or for any other direct
commercial purposes without the agreement of [Name of Rescue or Charity].

This isnt a legally binding document just wording that can be adapted for terms of reference
for the relationship between photographer and rescue and how the resulting images will be used.

The examples under 1A are probably the most common way rescues will use images provided.
Other purposes can be added to the list, but it may be better to discuss and agree other purposes
with the rescue on an as and when basis. For example, many photographers would be happy for a
charity to use their photos on greeting cards to sell or posters promoting the rescue, but would want to
ensure these were of good quality so not to damage their brand. Rescues might wish to use images
in campaigns, but its probably good to discuss and agree this first, particularly if it involves a
controversial issue that may not be well-received by some of the photographers other clients.
