1. How do you propose to reduce the manpower, both in managerial and


workmen categories?
a. The existing workmen should be retrenched by giving one months
notice in writing indicating the reason for retrenchment or must be
paid the wages for the period of notice. (ID Act, Section 25F)
b. The managerial level employees can be directly terminated as they
are considered part of management.
2. And what counterbalancing measures do you propose to initiate?
a. Introduce payment of wages based on performance to enhance the
overall productivity of the employees.
b. Training of employees can be conducted to increase their efficiency.
3. What tools are available to you to handle contract labour indiscipline and
sabotage?
a. Absenteeism by contact labourers can be handled through
deduction of wages using Section 9 of Payment of Wages Act.
b. Sabotage by contact labourers can be handled using Section 10 of
Payment of Wages Act.
c. Inefficiency of contract labourers can be handled using Section 11
of Payment of Wages Act.
4. What are your plans to respond to the prosecution notice and public
interest litigation?
a. Initially deny any involvements with the mafia group as proper
proofs need to be presented to prove anything.
b. Stick to the point that the firm has always worked for the
betterment of employee conditions and also cut ties with the mafia
group.
c. Prepare for settlement out of court.
5. What do you propose to do in the face of a G.O to abolish contract labour
in certain employments?
a. Based on the terms and conditions of the labour contract, the
contract labourers can be retrenched.
b. Attempts can be made to accommodate the contact labourers as
permanent workforce.
