4StandardsandCriteria(specialexceptions)

A.Theproposeduseshallbeinharmonywithpurposes,goals,objectivesandstandardsofthe
TownshipComprehensivePlan,thisOrdinanceandallotherordinancesoftheTownship.(pp.2
through8)
B.Theproposalshallalsobeevaluatedastothedegreetowhichtheproposedlocationmaybe
particularlysuitableorunsuitablefortheproposeduseintermsofthephysicalcharacteristicsof
thesite.(p.8)
C.Theproposeduseattheproposedlocationshallnotresultinasubstantialorundueadverse
effectonadjacentproperty,thecharacteroftheneighborhood,trafficconditions,parking,
publicimprovements,publicsitesorrightsofway,adjacentpropertyvalues,orothermatters
affectingthepublichealth,safety,andgeneralwelfare,eitherastheynowexistorastheymay
inthefuturebedevelopedasaresultoftheimplementationofthisOrdinance,oranyother
plan,program,maporordinanceoftheTownshiporothergovernmentagencyhaving
jurisdictiontoguidegrowthanddevelopment.(pp.8through17)
D.Theproposeduseshallnotimposeanundueburdenonanyoftheimprovements,facilities,
utilities,andservicesoftheTownship,whethersuchservicesareprovidedbytheTownshipor
someotherentity.Theapplicantshallbewhollyresponsibleforprovidingsuchimprovements,
facilities,utilities,orservicesasmayberequiredtoadequatelyservetheproposedusewhen
thesamearenotavailableorareinadequatetoservetheproposeduseintheproposed
location.Aspartoftheapplicationandasaconditionofapprovaloftheproposedusethe
applicantshallberesponsibleforestablishingability,willingnessandbindingcommitment
toprovidesuchimprovements,facilities,utilitiesandservicesinsufficienttimeandinamanner
consistentwiththisandotherordinancesoftheTownship.Thepermitapprovalshallbeso
conditioned.(pp.17through18)
E.Inreviewinganapplication,thefollowingadditionalfactorsshallbeconsidered:
1.Location,arrangement,size,designandgeneralsitecompatibilityofbuildings,lightingand
signs.
2.Adequacyandarrangementofvehiculartrafficaccessandcirculation,including
intersections,roadwidths,pavementsurfaces,dividersandtrafficcontrols.
3.Location,arrangement,appearanceandsufficiencyofoffstreetparkingandloading.
4.Adequacyandarrangementofpedestriantrafficaccessandcirculation,walkwaystructures,
controlofintersectionswithvehiculartrafficandoverallpedestrianconvenience.
5.Adequacyofstormwateranddrainagefacilitiesstormwaterleavinganysiteshallnot
exceedpredevelopmentlevelsandfacilitiesshallbedesignedtoaccommodatea10year
storm.
6.Adequacyofwatersupplyandsewagedisposalfacilities.
7.Adequacy,typeandarrangementoftrees,shrubsandotherlandscapingconstitutinga
visualand/ornoisebufferbetweentheapplicant'sandadjoininglands,includingthe
maximumretentionofexistingvegetation.
8.Adequacyoffirelanesandotheremergencyzonesandtheprovisionoffirehydrants.
9.Specialattentiontotheadequacyandimpactofstructures,roadwaysandlandscapingin
areaswithsusceptibilitytoponding,floodingand/orerosion.

F.Noapplicationshallbeapprovedunlessitisfoundthat,inadditiontocomplyingwitheachof
thestandardsenumeratedabove,anyoftheapplicablestandardscontainedinthisOrdinance
shallbemet.

Ininstanceswherethesupplementalstandardscontainedhereindonotadequatelyprotectthe
generalhealth,safetyandwelfareofpartieseffected,allconditionsandsafeguardsdeemed
necessarybytheBoardtoprotectthegeneralhealth,safetyandwelfareandimplementthe
purposesofthisOrdinanceandthePennsylvaniaMunicipalitiesPlanningCodeshallbeimposed
asconditionsofapprovalinaccordwith912.1or913.2ofthePennsylvaniaMunicipalities
PlanningCode,asthecasemaybe.

Conditionswhichmightbeimposedshallinclude(butnotbelimitedto)provisionsforadditional
parking,trafficcontrol,submissionoflandscapingplansforscreening,setbacks,special
measuresaddressingsalesperiodactivities,environmentalcontrolsandothermeasureswhich
mitigateanypotentialadverseimpacttheusemayhaveonadjoininguses.
