AFFIDAVIT OF DESISTANCE
I, JOSE O. DE GUZMAN, Filipino, of legal age, incumbent Chairman of
Barangay Socorro, Quezon City, after having been sworn in accordance with law
hereby depose and state, that:
1. This pertains to the crime charge, for Theft against Jefferson

Rodeadilla for alleged unlawful taking of government property,


particularly the car battery that was fixed in one of the Barangay
Halls vehicle;
2. That the above case, docketed as Criminal Case No. 37-15-12406, is

pending at the sala of Hon. Augutus C. Diaz, of Branch 37, MeTC of


Metro Manila, Quezon City;
3. That Mr. Rodeadilla was mistakenly accused of the crime charge,

considering the fact that he appeared accompanied by his father,


before our Barangay Office and return the subject government
property, and to shed light the incident;
4. It established, that Mr. Rodeadilla was not the one who took the

stolen car battery, but merely left to him for safekeeping whose full
identity and whereabouts is yet to be established;
5. In view of the factual circumstances above, it is most respectfully

request the Honorable Presiding Judge that the crime charged


against Mr. Jefferson Rodeadilla be dismissed as he was mistakenly
accused with the offense charge;
6. Further request the issuance of this Honorable Court the released

order in favor of the accused;


7. As such, I am executing this affidavit to attest to the truth of the

foregoing instrument and for any legal purposes this may serve.
