andtheotherdisagree.

studentswillhavetostandbytheappropriatesign,basedonhowtheyfeelaboutthe

Abstraction:
TheteacherwilldiscusstheLocalGovernmentCodeof1991orthelawonLocal
GovernmentCodeofthePhilippinesspecificallyonthetopicofpassingofCity
Ordinances.Thatway,studentswilllearnabouttheimportanceofCityOrdinancesand
howitcanaffecttheirlivesandtheircommunity.
UnderChapter3,ontheLocalGovernmentCodeof1991,itstatesthatfollowing:

SEC.54.ApprovalofOrdinances.(a)Everyordinanceenactedbythesangguniang
panlalawigan,sangguniangpanlungsod,orsangguniangbayanshallbepresentedtothe
provincialgovernororcityormunicipalmayor,asthecasemaybe.Ifthelocalchief
executiveconcernedapprovesthesame,heshallaffixhissignatureoneachandevery
pagethereof;otherwise,heshallvetoitandreturnthesamewithhisobjectionstothe
sanggunian,whichmayproceedtoreconsiderthesame.Thesanggunianconcernedmay
overridethevetoofthelocalchiefexecutivebytwothirds(2/3)voteofallitsmembers,
therebymakingtheordinanceorresolutioneffectiveforalllegalintentsandpurposes.
(b)Thevetoshallbecommunicatedbythelocalchiefexecutiveconcernedtothe
sanggunianwithinfifteen(15)daysinthecaseofaprovince,andten(10)daysinthe
caseofacityoramunicipality;otherwise,theordinanceshallbedeemedapprovedasif
hehadsignedit.
(c)ordinancesenactedbythesangguniangbarangayshall,uponapprovalbythemajority
ofallitsmembers,besignedbythepunongbarangay.
SEC.55.VetoPoweroftheLocalChiefExecutive.(a)Thelocalchiefexecutivemay
vetoanyordinanceofthesangguniangpanlalawigan,sangguniangpanlungsod,or
sangguniangbayanonthegroundthatitisultraviresorprejudicialtothepublicwelfare,
statinghisreasonsthereforinwriting.
(b)Thelocalchiefexecutive,exceptthepunongbarangay,shallhavethepowertoveto
anyparticularitemoritemsofanappropriationsordinance,anordinanceorresolution
adoptingalocaldevelopmentplanandpublicinvestmentprogram,oranordinance
directingthepaymentofmoneyorcreatingliability.Insuchacase,thevetoshallnot
affecttheitemoritemswhicharenotobjectedto.Thevetoeditemoritemsshallnottake
effectunlessthesanggunianoverridesthevetointhemannerhereinprovided;otherwise,
theitemoritemsintheappropriationsordinanceofthepreviousyearcorrespondingto
thosevetoed,ifany,shallbedeemedreenacted.
(c)Thelocalchiefexecutivemayvetoanordinanceorresolutiononlyonce.The
sanggunianmayoverridethevetoofthelocalchiefexecutiveconcernedbytwothirds
(2/3)voteofallitsmembers,therebymakingtheordinanceeffectiveevenwithoutthe
approvalofthelocalchiefexecutiveconcerned.
SEC.56.ReviewofComponentCityandMunicipalOrdinancesorResolutionsbythe

SangguniangPanlalawigan.(a)Withinthree(3)daysafterapproval,thesecretaryto
thesanggunianpanlungsodorsangguniangbayanshallforwardtothesangguniang
panlalawiganforreview,copiesofapprovedordinancesandtheresolutionsapprovingthe
localdevelopmentplansandpublicinvestmentprogramsformulatedbythelocal
developmentcouncils.
(b)Withinthirty(30)daysafterreceiptofcopiesofsuchordinancesandresolutions,the
sangguniangpanlalawiganshallexaminethedocumentsortransmitthemtothe
provincialattorney,oriftherebenone,totheprovincialprosecutorforprompt
examination.Theprovincialattorneyorprovincialprosecutorshall,withinaperiodoften
(10)daysfromreceiptofthedocuments,informthesangguniangpanlalawiganinwriting
ofhiscommentsorrecommendations,whichmaybeconsideredbythesangguniang
panlalawiganinmakingitsdecision.
(c)Ifthesangguniangpanlalawiganfindsthatsuchanordinanceorresolutionisbeyond
thepowerconferreduponthesangguniangpanlungsodorsangguniangbayanconcerned,
itshalldeclaresuchordinanceorresolutioninvalidinwholeorinpart.Thesangguniang
panlalawiganshallenteritsactionintheminutesandshalladvisethecorrespondingcity
ormunicipalauthoritiesoftheactionithastaken.
(d)Ifnoactionhasbeentakenbythesangguniangpanlalawiganwithinthirty(30)days
aftersubmissionofsuchanordinanceorresolution,thesameshallbepresumed
consistentwithlawandthereforevalid.
SEC.57.ReviewofBarangayOrdinancesbythesangguniangpanlungsodor
sangguniangbayan.(a)Withinten(10)daysafteritsenactment,thesangguniang
barangayshallfurnishcopiesofallbarangayordinancestothesangguniangpanlungsod
orsangguniangbayanconcernedforreviewastowhethertheordinanceisconsistentwith
lawandcityormunicipalordinances.
(b)Ifthesangguniangpanlungsodorsangguniangbayan,asthecasemaybe,failstotake
actiononbarangayordinanceswithinthirty(30)daysfromreceiptthereof,thesameshall
bedeemedapproved.
(c)Ifthesangguniangpanlungsodorsangguniangbayan,asthecasemaybe,findsthe
barangayordinancesinconsistentwithlaworcityormunicipalordinances,the
sanggunianconcernedshall,withinthirty(30)daysfromreceiptthereof,returnthesame

withitscommentsandrecommendationstothesangguniangbarangayconcernedfor
adjustment,amendment,ormodification;inwhichcase,theeffectivityofthebarangay
ordinanceissuspendeduntilsuchtimeastherevisioncalledforiseffected.
SEC.58.EnforcementofDisapprovedordinancesorResolutions.Anyattemptto
enforceanyordinanceoranyresolutionapprovingthelocaldevelopmentplanandpublic
investmentprogram,afterthedisapprovalthereof,shallbesufficientgroundforthe
suspensionordismissaloftheofficialoremployeeconcerned.
SEC.59.EffectivityofOrdinancesorResolutions.(a)Unlessotherwisestatedinthe
ordinanceortheresolutionapprovingthelocaldevelopmentplanandpublicinvestment
program,thesameshalltakeeffectafterten(10)daysfromthedateacopythereofis
postedinabulletinboardattheentranceoftheprovincialcapitolorcity,municipal,or
barangayhall,asthecasemaybe,andinatleasttwo(2)otherconspicuousplacesinthe
localgovernmentunitconcerned.
(b)Thesecretarytothesanggunianconcernedshallcausethepostingofanordinanceor
resolutioninthebulletinboardattheentranceoftheprovincialcapitolandthecity,
municipal,orbarangayhallinatleasttwo(2)conspicuousplacesinthelocalgovernment
unitconcernednotlaterthanfive(5)daysafterapprovalthereof.Thetextofthe
ordinanceorresolutionshallbedisseminatedandpostedinFilipinoorEnglishandinthe
languageordialectunderstoodbythemajorityofthepeopleinthelocalgovernmentunit
concerned,andthesecretarytothesanggunianshallrecordsuchfactinabookkeptfor
thepurpose,statingthedatesofapprovalandposting.
(c)Thegistofallordinanceswithpenalsanctionsshallbepublishedinanewspaperof
generalcirculationwithintheprovincewherethelocallegislativebodyconcerned
belongs.Intheabsenceofanynewspaperofgeneralcirculationwithintheprovince,
postingofsuchordinancesshallbemadeinallmunicipalitiesandcitiesoftheprovince
wherethesanggunianoforiginissituated.
(d)Inthecaseofhighlyurbanizedcities,themainfeaturesoftheordinanceorresolution
dulyenactedoradoptedshall,inadditiontobeingposted,bepublishedonceinalocal
newspaperofgeneralcirculationwithinthecity:Provided,Thatintheabsencethereof
theordinanceorresolutionshallbepublishedinanynewspaperofgeneralcirculation.

II.HowtopassaCityOrdinanceinthePhilippines.

c. Whattheycansuggesttoimprovetheordinance

4.Makeareportontheirconductedstudyregardingtheoutcomeoftheir
interviewbasingonthefollowingquestions:
a.WhetherornottheCityOrdinanceisproperlyimplemented?
b.WhetherornottheCityOrdinanceisbeneficialtothecommunity?
c.WhetherornottheCityOrdinanceshouldbeimproved?

lawsaddressingtheirselectedissue.Informationwillbeavailablefromtheircitywebsite
ortheappropriatestateagencies.

needtoreinventthewheelhere;simplyfindasampleordinanceoranactualordinance
thathaspreviouslypassedinanotherlocality.
