GOVERNMENTS SUPPLEMENTAL RESPONSE TO DEFENDANTS SENTENCING

OBJECTIONS AND SENTENCING MEMORANDUM
COMES NOW, THE UNITED STATES OF AMERICA, by and through Douglas W.

Gardner, an Assistant United States Attorney for the United States District Court for the Western
District of Texas and submits this supplemental response to the Defendant Francisco Antonio
Colorado Cessas Objections to the Presentence Investigation and sentencing memorandum.
In further response to the Defendants objections claiming he was induced to commit this
offense and his objection to a leadership role, the Government directs the Courts attention to
Exhibit A.
Exhibit A is the transcripts of three Bastrop County recorded Jail Calls all occurring on
January 19, 2015. The first two calls occur between the Defendant and his son, co-defendant
Francisco Augustin Colorado Cebado. In these two calls, the Defendant berates his son for
failing to follow his instructions in bribing two Mexican senators from his home state of Vera
Cruz, (Hector Yunes and Jose (Pepe) Yunes)) and a Pemex official, Placido Reyes Reza to
obtain oil contracts for his company (ADT Petroservicios) through the Mexican National Oil
Company PEMEX. In the third call, between the Defendant and his other co-defendant, Ramon
Segura Flores, the Defendant admonishes FLORES for not listening and following the
Defendants directions in failing to secure the oil contracts through bribes and failing to take
actions to besmirch the reputation of the winning bidder in order to get the contract revoked.
These calls are both unabashed and unambiguous. The Defendant directs CEBADO to
take money to maintain the Defendants contacts (Senators Yunes and Yunes and Pemex
official Reyes Reza) in order to win bids. A simple internet search reveals that the two
senators are in fact PRI senators from the Defendants home state of Veracruz. See Exhibit B.
Exhibit C is the result of an internet search of the Pemex official Reyes Reza identified in the
calls. This Exhibit reflects that Reyes Reza is not only assigned to the State of Vera Cruz but
according to the attached news report was recently under investigation for bid rigging activity,
the same as discussed in the attached calls.
In addition to the Governments previous filing containing evidence of the Defendants
bribes to the media in exchange for favorable news coverage; evidence showing the payment of
bribes to Fidel Herrera, the governor of the State of Vera Cruz; evidence showing previous
bribes to other Pemex officials; and these calls all plainly demonstrate the Defendants
leadership role vis--vis his two co-defendants.
The Government is also prepared to present evidence at sentencing, should the Court
desire, that the Defendant and his co-conspirators, immediately following his conviction for
money laundering, began conducting a media campaign. This effort was a dual track to both
make a claim of innocence, or in the alternative mitigate his role in the money laundering
scheme. His efforts to influence the media include contacts with Mexican media outlets, major
United States Spanish language television networks and local print media which stem from mid2013 to present.
Also, once he was convicted of the money laundering offense he and his co-conspirators,
began developing a Plan A in an attempt to demonstrate that the money came from legitimate
sources and a Plan B which was the idea to assert a sentencing duress defense. Both of these
plans became evident through the Defendants presentation of evidence through the testimony of
FLORES and his sentencing allocution followed by the arrest of FLORES and CEBADO shortly
thereafter. See Exhibit D.
These efforts and his current bribes to Mexican politicians and Pemex officials stand in
direct contrast to the Defendants unfounded contentions that he was either subject to duress at
the hands of Los Zetas for his both original money laundering conviction or in regards to this
instant offense. Given the information before the Court, these claims border on the fantastical
lacking any connection to reality.
WHEREFORE PREMISES CONSIDERED, the Government respectfully requests the
Court to overrule the Defendants objections.
