FOREWORD
ntellectual Property activities in 2010 were guided by the policy of the Party and the State on encouraging and promoting creation and innovation, and protection of IPRs in order to serve the national development. Especially, the Documents approved by the 11th National Congress of the Communist Party
of Vietnam in January 2011 clearly indicate the development direction of the socialist-oriented market
economy; accordingly, Vietnam aims at developing an advanced economy with a modern production force and
an advanced production relation - a knowledge-based market economy of the 21st century. The Development
Strategy also identified demands for strong development of scientific and technological market associated
with protection of intellectual property rights. Under the Socio-economic Development Plan in 2011-2015, with
high investment in developing economic tools, more investment would be made in intellectual property activities, particularly in protection and commercialization of intellectual property assets.
The National Office of Intellectual Property of Vietnam (NOIP), as an agency under the Ministry of Science and Technology responsible for overall state management of intellectual property and specialized in industrial property, has
been operating more effectively and significantly contributing to the national socio-economic development.
The visit of the Director General of the World Intellectual Property Organization (WIPO) to Vietnam where he
met leaders of the country and related agencies, including NOIP in early 2010, has showed that WIPO highly
valued the progress of Vietnam in the field of intellectual property, as well as the interest shown by the Party
and the State to intellectual property.
In 2010, the worlds financial crisis continued to create negative impact on the Vietnams economy, including IP
activities. NOIP continued playing a key role in developing IP activities in Vietnam. The national intellectual property system continued to be improved in all aspects, including IP legislation system, especially with regards to
implementing regulations for the revised IP Law; the receiving and processing industrial applications remained at
high rate; international cooperation activities were widely expanded; IP information, application of information
technology and training activities positively supported to the development of IP system; enterprises, research
institutions and universities paid more attention and received effective supports on creation and protection of IP
assets; enforcement of IPRs was promoted etc. Achievements made by NOIP have considerably contributed to the
technical creation, production and business and boosted foreign investment and technology transfer in order to
serve the socio-economic development and international economic integration of the country.
In the year of 2011 and coming years, there are both opportunities and challenges for IP activities. NOIP will keep
playing its core role in the countrys IP system, and, under the guidance of the leaders of the Ministry of Science
and Technology, it will endeavor to take advantage of the opportunities as well as to overcome challenges with a
view to promoting IP activities nationwide.

DIRECTOR GENERAL TO Vietnam
On January 19 and 20, 2010, at the invitation of the Minister of Science and Technology H.E. Hoang Van Phong, the
Director General of WIPO, Dr. Francis Gurry paid an official
visit to Vietnam. This was the second visit of WIPOs head
to Vietnam since 1986.
Director General Francis Gurry was well received by the leaders of the State and the Government of Vietnam. In the meeting with the Director General, President Nguyen Minh Triet
confirmed Vietnams commitment to protect intellectual
property and informed the progress in the development of
the national legislative and administrative frameworks. The
President called on WIPOs continued assistance to support
the countrys full integration of into the national development strategy to become a knowledge-based economy and
producer of high-end, value-added goods and services. The
Director General briefed the President about importance of
intellectual property (IP) in promoting innovation and boosting national economic development. Mr. Gurry pledged the
WIPOs continuing support in further enhancing Vietnams
national IP capacity to innovate and achieve sustainable
economic growth.
In a meeting with Director General Francis Gurry, Permanent Deputy Prime Minister Nguyen Sinh Hung stressed that
sustainable development of the national IP system in line
with international obligations is a priority of Vietnams government. He reiterated that continued support from WIPO
in further strengthening the national IP system would help
facilitate the countrys on-going economic transformation.
Director General Francis Gurry noted Vietnams impressive
rates of economic growth in recent years and its resilience to
the global financial crisis. He called Vietnam an exemplary
role model in exercising IP rights and said its commitment
to encouraging innovation helps to promote its image and
products abroad and attract investment. The Director General promised support for Vietnams ongoing modernization
of its national IP system and the training of IP specialists.
The aim, he said, is to help enable state-of-the-art services
to businesses, inventors and creators through the IP system.

During his visit, Director General Francis Gurry also held talks
with the Minister of Science and Technology Hoang Van
Phong and Deputy Minister of Foreign Affairs Doan Xuan
Hung. He met with senior officials from the National Office of
Intellectual Property of Vietnam (NOIP), the Copyright Office
of Vietnam (COV) and the Plant Varieties Office of Vietnam.
The Director General also had a talk with students of Vietnam
National University, Ha Noi; attended the WIPO Award Ceremony and the Launching Ceremony of Distance Learning
Program on Intellectual Property in Vietnamese language.
On this occasion, Minister of Science and Technology Hoang
Van Phong awarded a Commemorative Medal to Dr. Francis
Gurry to acknowledge his contribution to the development
of science and technology of Vietnam.

ON IN TELLECTUAL PROPERTY
Being considered as one of the key tasks in the State management of intellectual property, in 2010, the
National Office of Intellectual Property of Vietnam (NOIP) continuously implemented ranges of activities
focusing on completing and improving the intellectual property (IP) legislation and policy in order to support an effective establishment and protection of IP rights (IPR) in the country. The NOIP took a leading role
in preparing drafts and providing comments on various legal documents in the field of IP that guide and
implement the amended Intellectual Property Law 2009, as well as overcome shortcomings and meet real
and practical demands.
Further improvement of National

IP Legislation and Policy
With respect to the protection and enforcement of
IPRs, a number of legal papers were drafted and enacted in 2010, namely:
Decree No. 119/2010/ND-CP dated 31 December 2010
amending and supplementing some articles of Decree
No. 105/2006/ND-CP on guiding the implementation
of a number of articles of the Intellectual Property Law
on the Protection of Intellectual Property Rights and
on the State management of IP. This Decree amends
and supplements some provisions on determining of
infringing elements of rights to plant varieties, values
of infringed goods, procedures for dealing with requests for infringements settlement, assessment of
IPRs, mandates of the Ministry of Science and Technology for the State management of IP;
Decree No. 122/2010/ND-CP dated 31 December 2011
amends and supplements some articles of Decree No.
103/2006/ND-CP on guiding the implementation of
some articles of Intellectual Property Law on industrial
Property. The Decree amends and supplements some
provisions on secret invention, the state management
of geographical indications, professional requirements for practicing IP representative services;
Decree No. 97/2010/ND-CP dated 21 September 2010
replaces the Decree No. 106/2006/ND-CP on sanction
of administrative violations in the field of industrial
property;
Decree No. 43/2010/ND-CP dated 15 April 2010 on
business registration replacing Decree No. 88/2006/
ND-CP dated 29 August 2006 of business registration
(including provisions on companies names to avoid
infringing IPRs towards protected trademarks, trade

names and geographical indications);
Circular No. 13/2010/TT-BKHCN dated 30 July 2010
amends and supplements Circular No. 01/2007/TTBKHCN dated 14 February 2007 of the Minister of
Science and Technology on recordals, modification
and elimination of IP representative organizations;
procedures for cancellation/termination of validity of
protection titles; vouchers of payment of IP fees and
charges.
Besides, several draft legal documents in the field

of industrial property were prepared for approval,
namely:
The draft Decree on Innovation: The Decree provides details about requirements, procedures for recognition of innovation, rights of innovators and owners in registration, recognition, recordal, application
and transfer of innovation, measures for promoting
innovative activities and the state management of innovation. The Draft was submitted to the Government
for comments and approval;
The draft Directive of the Prime Minister on
strengthening the management and enforcement
of industrial property rights;
The Draft Circular to amend and supplement to Circular No. 01/2008/TT-BKHCN, which was revised by
the Circular No. 04/2009/TT-BKHCN, on industrial
property assessment: The Draft will be circulated to
seek comments of relevant agencies and to be enacted in 2011.

The Draft Circular to amend and supplement Circular No. 01/2007/TT-BKHCN dated 14 February 2007
of the Minister of Science and Technology guiding
the implementation of Decree No. 103/2006/NDCP: The draft is now in the final stage and will be circulated for comments by concerned agencies to enact
in 2011.
Also in 2010, under the framework of Project 30 on Administrative Reform, there were 31 procedures in the field of
industrial property, containing 29 central-level ones and 2
provincial-level ones, were reviewed, and27 procedures and
9 forms being proposed to be revised accordingly. These
changes were adopted by the Government by the Resolution
No. 25/NQ-CP dated 02 June 2010 and the Resolution No.
67/NQ-CP dated 23 December 2010. Amendments of 4 pilot
procedures in the field of intellectual property, as approved
by the Resolution No. 25/NQ-CP dated 06 February 2010 of
the Government, has been made in Circular No. 13/2010/
TT-BKHCN; Amendments of 23 remaining procedures on intellectual property as referred to in Resolution No. 67/NQ-CP
dated 23 December 2010 will be fulfilled in 2011.

Activities to guide implementation of IP laws and regulations
were carried out regularly through providing interpretations
and responses to problems in the process of execution of IP
provisions by provincial Departments of Science and Technology, organizations and individuals, especially enterprises
such as: representation and power of attorney; identification of net price in IP license agreements; priority transfer;
infringements of trademarks; transfer of right to patents for
public works. These contributed to relieve difficulties in the
implementation of IP legal provisions in practical production, trading, and management activities.
Further improvement of IPR legislation and policy

framework for international integration
The development legislation and policy, and measures to
ensure the implementation of them for further international
integration in the field of intellectual property continues to
be paid much attention and widely implemented.
Provisions and commitments on intellectual property under international treaties of which Vietnam is a party, such
as TRIPS Agreement, Vietnam the United States Bilateral
Trade Agreement, Vietnam the U.S. Trade and Investment
Framework Agreement, Vietnam - Japan Economic Partnership Agreement (VJEPA), v.v. were duly implemented. Vietnam and Japan agreed to complete the Phase III of Vietnam
- Japan Joint Initiative with the acknowledgement of efforts
of both Parties in implementation of the Action Plan under
the Joint Initiative and agreed to prepare for the 4th Phase
of the Joint Initiative.
Many international treaties containing provisions on intellectual property were developed, negotiated and concluded
such as the Agreement between the Government of the Socialist Republic of Vietnam and the Government of the Russian Federation on mutual protection of rights to the results
of intellectual activities applied and obtained in the course
of military-technical cooperation; Vietnam - EU Partnership
and Cooperation Agreement (two sides initialed the Agreement and prepared for an official singing procedures); the
Trans-Pacific Strategic Economic Partnership Agreement
(TPP); and other Free Trade Agreements with other partners

INTELLECTUAL PROPERTY
The year of 2010 was recorded with many outstanding international cooperative activities in the field
of intellectual property. International cooperation activities were increasingly undertaken in terms of
quality, quantity and cooperation partners.
Multilateral Cooperation
Cooperation activities under the multilateral framework
were mainly conducted in the cooperation with World Trade
Organization (WTO), the Asia-Pacific Economic Cooperation
(APEC) Forum and the Association of Southeast Asian Nations (ASEAN).
In cooperation with WTO, the NOIP regularly followed, updated and handled issues relating to intellectual property,
actively and fully participated in TRIPS /WTOs sessions.
With APEC, the NOIP participated in the 30th and the 31st
meetings of the APECs Intellectual Property Experts Group
(IPEG), developed its National IP Action Program, together
with other APEC member economies to develop and implement collective actions of IPEG. Furthermore, the NOIP contributed to APECs papers such as Draft texts of APEC Submit
meeting, APEC Ministerial Conference, v.v.).
With ASEAN, the NOIP actively participated in the 33rd meeting of the ASEAN Working Group on Intellectual Property
Cooperation (AWGIPC) and successfully hosted the 34th
AWGIPC meeting in Da Nang City; cooperated with other
IPOs of ASEAN member states in implementing the ASEAN
Economic Community Blueprint; developed ASEAN IP Directory, implemented the Cooperative Program on Examination
of Patent application (ASPEC Project), v.v.; participated in development of ASEAN - Australia - New Zealand Cooperative
Program on IP; participated in the implementation of ASEAN
- China Memorandum of Understanding on Intellectual
Property Cooperation; coordinated to implemented a number of activities within the framework of the ASEAN Project
on the Protection of Intellectual Property Rights (ECAP III).

In cooperation with the WIPO, the NOIP successfully organized the official visit of Director General Francis Gurry of
WIPO to Vietnam; participated in important meetings of the
WIPO, including the 48th series meetings of General Assemblies of WIPO and meetings of its specialized committees.
With the assistance of WIPO, the NOIP has conducted many
activities relating to human resource development, namely,
implementation of the Distance Learning Program on Intellectual Property in Vietnamese language (DL 101), organization of the Seminar on IP for enterprises in Ha Noi and a
Study Visit on the use of IP for Vietnamese small and medium
enterprises to Korea. In addition, NOIP also cooperated with
WIPO in studying the possibility of developing a National
Strategy on IP and continued implementing the Project on
patent application search and examination and the project
of Patent Documents Digitization.
In addition, the NOIP continued to well maintain good cooperation ties with other partners through the implementation of the Memorandums of Understanding (MoU) with the
State Intellectual Property Office of the Peoples Republic of
China (SIPO) and with the Korean Intellectual Property Of-
fice (KIPO) and the Vietnamese - Swiss Project on Intellectual Property (SVIP Project) funded by the Swiss Government
(the Project was completed in late June 2010). The NOIP also
successfully implemented a range of cooperation activities
in various fields of intellectual property rights in cooperation
with ASEANs IP Offices, the European Patent Office (EPO),
the United States Patent and Trademark Office (USPTO), the
Korean Intellectual Property Office (KIPO), the Japan Patent
Office (JPO), and the Department of Intellectual Property,
Standardization and Metrology of Lao PDR, etc.
Cooperation ties were also established with new partners,
such as the Danish Patent and Trademark Office (DKPTO) and
the German Patent and Trademark Office (GPTO).
It could be said that international cooperation activities on
intellectual property in 2010 were actively implemented
by NOIP and obtained remarkable achievements that significantly supported and contributed to efforts of NOIP in
improvement and completion of the IP system, as well as
affirmed of the countrys position in the process of international economic integration.

ESTABLISHMENT OF INDUSTRIAL PROPERTY RIGHTS

The receiving and handling of industrial property applications were well done to meet the demands on
establishment of industrial property rights by the public, businesses, research institutions and universities. This task in 2010 has gained following satisfactory achievements.
The receiving of industrial property

applications:
In 2010, NOIP received 62,982 applications of all types of
IP rights, equivalent to the number of last year. Among the
total number of applications, the IP applications accounted
for the majority with 33,616, including 3,582 for patents, 299
for utility solutions, 1,730 for industrial designs, 27,923 for
national trademarks, 4,236 for international trademark (excluding 2,508 for renewal of international registrations), 7 for
GIs, 2 for topography of integrated circuits and 5 for international patents and 72 for international trademarks whose
country of origin is Vietnam. The rest 21,744 were requests
for applications amendments (1,841), for assignments
(475), for re-granting of protection titles (533), for renewal
of protection titles (3,817), for amendment of protection
titles (4,225), for maintenance of protection titles (4,279), for
transfer of protection titles (1,510), for licensing of industrial
property related claims (1,007), for cancellation of protection
titles (222), for appeals (932), for searches (730), for opposition of granting protection titles (747), and for other matters
(1,451).
The handling of IP applications:

49,286 were the total applications of all types handled by
NOIP in 2010. Accordingly, 21,797 titles were granted to different IP subject matters, including international registration
of marks designating Vietnam. Specifically, protection titles
were granted to 822 patents, 58 utility solutions, 1,152 industrial designs, 16,520 national trademarks, 3,237 international trademarks, and 8 GIs. There were 6,269 applications,
including 999 for international trademarks that were refused
in the year. The formality examination of international applications originating from Vietnam was undertaken to
5 patent and 58 trademark applications. Moreover, NOIP
also handled 21,157 other requests, including requests for
amendments (495), for assignment of applications (121), for
re-granting of protection titles (562), for renewal of protection titles (3,654), for amendment of protection titles (3,982),
for maintenance of protection titles (4,233), for transfer of
protection titles (1,403), for licensing of IP rights including
amendment, renewal, and invalidation of protection titles
(856), for cancellation and invalidation of protection titles

In general, the IP filing trend in 2010 was still adversely affected by the world financial crisis. The recovery of the international and Vietnamese economies resulted in a slight
increase in numbers of applications filed with NOIP in comparison with 2009 but it seemed not yet to be stainable. The
number of patent and utility solution applications increased
considerably by 23.5% versus its decrease by 9% in 2009.
Meanwhile, applications for trademark and industrial design
registrations decreased by 2.6% and 8.9%, respectively. The
significant increase in patent applications showed a desirable transform in science and technology as well as in innovation activities and commercialization of research results in
Vietnam.
The receiving and handling of IP applications in 2010 were
well maintained that helped to promote IP activities in Vietnam, especially the use and exploitation of IP rights to serve
the socio-economic development and the integration into
the international economy. The number of protection titles
granted to patents and utility solutions rose remarkably by
14.3%. In 2011, NOIP plans to implement comprehensive
measures aimed at strengthening application-handling capacity, eliminating the backlog.

AWARENESS RAISING, RESEARCH

AND TRAINING ON IP
Together with improvement and completion of the IP legislation system to meet requirements for an
adequate and effective of the IP system, over the past few years, NOIP also paid a full attention to conduct awareness raising and training activities for different target audience groups, namely IP rights
owner, staff from IP management and enforcement agencies and the public in order to help them fully
understand the role of IP in the socio-economic development of the country. The year 2010 was marked
with positive changes in IP awareness raising and training activities in terms of forms of activities and
target stakeholders.
Professional education
and training on IP
For NOIPs staff

With a view to unceasingly enhancing the capacity of IP
system in terms of quantity and quality, in 2010, NOIP by
itself and/or in cooperation with the European Patent Office (EPO), the United States Patent and Trademark Office
(USPTO), the Korean Intellectual Property Office (KIPO) and
other partners organized trainings on different topics of IP
for 147 staff, including : a general training for 23 newly recruited staff, a training on patent search and classification
for 34 staff, a training on patent examination for 29 staff, a
training on trademark examination for 61 staff and a training on industrial design examination for 28 staff. Notably, a
training course on communication and teaching techniques
was held to improve capacity and sharpen teaching skills for
35 NOIPs staff.
For the public

With support of the WIPO, a Distance Learning Program on
IP in Vietnamese language was launched to provide a new
learning tool for the public. So far, two training courses have
been organized with the participation of 502 subscribers
and Certificates were awarded to 169 learners.
The year 2010 has seen a big reform in IP trainings. Accordingly, the NOIP paid greater attention to curve training programs to make them suitable to target groups, taking practical demand into consideration, and provide more practical

Research on IP
With a view to strengthening support for IP activities, the
NOIP has been currently implementing a number of projects, namely Project of Training on IP (under the National IP
Asset Development Program), the Research on model and
operation of a Center for IP Asset Support Development
Center under the NOIP and the Study on the Enhancement
of consultation on IP of NOIP. Apart from these Projects and
researches, the NOIP also focused on conducting studies on
urgent and hot issues relating to IP that helps to handle professional tasks of the NOIP better, namely Research themes
on Strengthening searching capacity of WIPOs electronic
databases in the field of industrial design, Protection of
second use of patents and Registration of certification and
collective marks.
Public education and awareness

raising on IP
The public education and awareness raising on IP in 2010
were frequently conducted focusing on current issues of
great attention of the public, such as development, management, exploitation and evaluation of IP assets. As the result,
there were 635 people participating in 9 seminars on IP
asset management in SMEs, Brand valuation in economic
integration stage, IP in R&D and socio-economic development, IPRs in Vietnams economic integration into the
global economy, IP and innovation, creation and IP Asset
valuation and technology transfer, etc
The public awareness raising on IP on mass media was also
strengthened in terms of contents, time slot and frequency.
The weekly game show Flying with brand on VTV3 continued attracting a great attention from the public and has become one of the favorite TV programs of producers, traders
and consumers. Moreover, with financial assistance of the
Program 68, IP programs were also broadcasted regularly
and broadly over 23 provincial TV stations to disseminate
knowledge on IP to the public. Annually, the World IP Day
(26 April) with a various activities conducted on mass media
has become familiar to different circles in the society. Celebration meetings and IP talks were held on this occasion at
many places, such as NOIP, An Giang and Da Lat Universities,
with the participation of more than 500 lecturers and students. The Seminar on IP for mass media agencies attracted large attention of journalists from different mass media
agencies of Vietnam. Thus, there was an increase of quantity
and quality of articles and reports on IP on mass media in
the year of 2010.
With the support of the Program 68, NOIP coordinated with
Dat Viet Newspaper to conduct a comprehensive dissemination of IP on both electronic and paper pages of the Newspaper. Being available on the first page, the IP column attracted attention of many readers. Particularly, the NOIP in

Maintenance and improvement of NOIPs

is a key tool for disseminating and broadcasting NOIPs activities, as well as IP activities throughout the country. By
accessing to the website, IP polices and legislations can be
approached easily, and therefore, it has contributed to an
effective implementation of such policies and legislations.
Information available in the NOIPs website, such as Industrial Property Gazette, industrial property database, etc. that
are updated regularly, has become an useful information
source for individuals, organizations, institutions, universities and enterprises for promoting creative and innovative
creativities and commercialization of IP assets for the socioeconomic development.
Provision of industrial property information.

The NOIP provides directly industrial property information to users throughout the
country, upon requests. In 2010, the NOIP received
and handled 125 requests for patent searches; served numerous readers coming to NOIPs Reading Room for searching and references, provided printings of more than 3,000
pages of patent specifications. The NOIP not only provided
directly searches and information services upon request but
also participated actively in organization of on-the-job trainings to provide agencies, organizations and individuals concerned with guidance on how to search and exploit industrial property information, e.g. providing guidance on search
and use of industrial property information to enterprises
and universities in Ha Noi, Dong Nai and An Giang, training
courses for officials in charge of industrial property at the
Department of Science and Technology of Da Nang, training courses for enterprises within framework of the National
Program of Supporting Development of Enterprises IP Assets (Program 68), etc. In order to improve service capacity of
the Library, the NOIP had input of hundreds of book titles of

national and foreign authors on intellectual property rights.
Development of databases and improvement of IP searching tools. As the focal point in
IP, the NOIP has developed and improved, gradually, the

industrial property information system of Vietnam to serve
organizations and individuals interested in. This system
is kept updated and maintained regularly. By end of 2010,
864 Vietnamese patent specifications and 3,846,058 foreign
patent specifications, including 2,868,964 Japanese patent
specifications in 2,600 CD-ROMs, were added to the system
(most of them were backlog of previous years); 70 foreign
industrial property gazettes were received and exploited.
During this year, 12 monthly industrial property gazettes of
NOIP were published sufficiently and timely in both paper
and CD-ROM formats. In addition, NOIP continued implementing the Project on Digitalization of Vietnamese Patent
Documents to serve patent search activities throughout the
country. The Project is expected to complete in March 2011.
Application of information technology. Databases, searching tools and administration system of industrial property applications had been developed and improved
based on the wide application of information technology
(IT). One of NOIPs databases for searching and examining
applications was integrated in the Industrial Property Administration System (IPAS system). Information administered
by the IPAS system was so huge. For the year of 2010 only,
the IPAS undertook: (i) administration to 1,270 invention applications, 123 utility solution applications, 1,414 industrial
design applications, 23,065 trademark applications; (ii) drafted and sent 78,076 notifications and 18,552 protection titles.
In 2010, more than 300,000 applications were administered
by IPAS, and 259,000 applications of those were published
in the NOIPs IP Digital Library (IP Lib) for search purpose. As

from the filing date, the NOIPs IPAS was firmly under good
operation to serve the process of application handling, the
search system (IP-Sea) and the IP-Lib. In order to maximize
the role of IPAS, the NOIP has studied and prepared for an efiling system that is to be launched in 2011-2012 tentatively.
The NOIPs IP-Lib is available 24/7 and updated at least once
a month to serve the public.
Besides, the administration system of international trademark applications designating Vietnam has been initiated
and developed at NOIP, including software on administration, examination and publication in order to keep the process of handling of international applications of marks timely and accurately. In the coming time, in order to improve the
administration of applications, the development of databases, the NOIP was developing another system, namely IPAS.
NET. The new system is, now, on pilot process and scheduled
to be officially launched in 2011.

SUPPORTS FOR IP ASSETS DEVELOPMENT
Supporting and consultation activities

In 2010, the NOIP improved its activities to support and
advise in various forms upon requests of enterprises,
organizations and individuals, including the followings:
- Providing advices and guidance on establishment of industrial property rights to hundreds of organizations and
individuals;
- Providing guidance on patent drafting to Vietnamese
inventors (at the first sentence, 14 invention applications
were drafted and filed with NOIP); Providing guidance
and supports to scientists, businessmen in searching and
exploitation of patent information to serve their studies or
their application to manufacture and sales.
- Organizing and maintaining the operation of NOIPs
Standing Office in Hoa Lac High-Tech Park to provide supports and consultation to enterprises located in nearby
area, including: providing advices and guidance on preparing applications for industrial property rights or use of
patent information; organization of workshops/seminars

to provide information concerning supporting activities
provided by NOIP to organizations and individuals, etc.
In order to adapt needs of organizations and individuals
located inside or outside the Hoa Lac High-Tech Park, the
NOIP has made proposal for the establishment a Center
for IP Assets Support Development based on the existing NOIPs Standing Office in there. The Center will satisfy
various demands of local enterprises and the public on
supporting and consulting on IPR, including information
searching, industrial property registration and exploitation of IP assets.
In the coming time, the NOIP shall provide more supports
and consultation to meet needs of organizations and individuals, as well as universities, institutions and enterprises.
Implementation of the National Program for Supporting

Development of Enterprises IP Assets (the Program 68)
In 2010, the Program 68 (both implementation and administration perspectives) was implemented in promptly and time
progress with highlights as follow:
General activities of the Program

Dissemination activities of IPRs and the Program 68 were
organized regularly: the Programs website was maintained and updated; 16 outstanding IP and life programs
were broadcasted on local TV channels in 2010; Seminar on
Guiding establishment of a project under the Program
68 was organized; a reportage on IPR was set up and broadcasted in VTV1 channel; Column on IPRs in Dat Viet online
newspapers which contained 20 news, 20 reports and 1 online talk was established.
In addition, activities on encouraging invention filing were
also focused on, including translation of guidelines for international patent registration from foreign languages into
Vietnamese; providing supports for registration of 40 inventions of Vietnamese inventors in foreign countries.
Under the Program, some study visits were organized abroad

in order to enhance administration capacity of officials at
both central and local levels, including a Delegation to the
Seminar on One Village One Brand in Seoul, Korea and a
Delegation to the Training Course on Commercialization of
IPRs in Deajeon, Korea.
With significant achievements of the Program, by Decision
No. 2204/QD-TTg dated 6 December 2010, the extension to
period of 2011-2015 of the Program 68 was approved by the
Prime Minister.

In the coming time, the followings shall be implemented: improvement of legal framework and management
team for implementation of the Program, improvement
of administration mechanism of the Program in period of
2011-2015; improvement of activities on propaganda of
the Program; enhancing supports for exploitation and application of inventions to R&D, manufacture and trading;
ensuring administration activities (supervision, control,
checking and taking over, payment,) of the Program to
be undertaken legally and timely.
The administration activities under the Program 68 were

seriously implemented in accordance with prescribed
requirements and processes. Those activities included:
Guidance for making requests; Collection and building
up a list of projects under the Program for selection; Supervision and control of implementation of 21 projects
under the Program; Signing contracts and allocation of
funds for 58 projects (with total amount of 20,151.685
million VND); Checking and taking over 6 projects fulfilled under the Program and organizing a meeting on
assessing the implementation of 2 other projects which
have been completed.
Activities of management, propaganda, guidance and advertisement of the Program were organized regularly in
various forms, therefore, they attracted interests of many
localities. 21 provinces and cities approved their local program on supporting the development of IP assets; implementation of projects activities under the Program were
broadcasted in local TV channels throughout the country;
23 local TV channels broadcasted the Program on IPR and
the life and got some satisfactory results in the first step.

IPR ENFORCEMENT AND

APPEAL SETTLEMENT
Handling requests for appeal,

revocation and invalidation
In 2010, the NOIP received 927 appeals against Decisions
of the Office for various subject matters, 566 of which
were successfully settled.
The NOIP received and handled 180 requests for invalidation and 252 requests for terminating the validity of IP
protections titles
Cooperation in enforcement of IPRs

In its capacity, the NOIP received and provided expertise
consultations to enforcement agencies to support them
in accurately handling and settling IP rights infringements. 183 requests were received, consisting of 32 requests from the Police, 13 from the Inspectorate of Science and Technology, 121 from the Market Management
Office, 05 from Departments of Science and Technology
and 12 from the Customs, and among them 04 requests
relate to inventions/utility solutions, 90 requests to industrial designs and 89 to trademarks.
The NOIP cooperated with relevant agencies to draft legal documents on handling industrial property right infringment within its competence as well as gave lectures
on IPRs enforcement in training courses and seminars for
IPRs enforcement forces.

Organizational structure and human resources for the

States management of industrial property
Organizational structure and mechanism for the States
management of industrial property in local provinces in
2010 was not much different from that of 2009. However, the trend of setting up separate divisions responsible
for intellectual property issues in provinces has become
clearer and gradually happened in Departments of Science and Technology (DOSTs). So far, 10 DOSTs established independent divisions specialized on industrial
property (intellectual property division) and many other DOSTs made advancement by separating industrial
property field from general management or gave new
names relating to industrial property.
In terms of quantity, number of officials specialized industrial property issues in provinces has been increasing
over the past 5 years. At present, the number of such officials of all provinces are 84 in the total of 160 industrial property management officials (in 2009, this rate is
70/146)
Because industrial property administration officials have
been assigned to work in other areas in recent years, this
has caused adverse affects to the effectiveness of the
States industrial property administration activities in
some provinces.
The establishment and promulgation of legal documents,

policies and measures for industrial property management
In 2010, the number of enacted legal documents on industrial property at provincial level were higher than that
of 2009 (43 papers/19 provinces to 17 papers/15 provinces in 2009). The content of those papers mainly focused
on provisions and rules on guiding the protection and development of local specialities (e.g. Binh Thuan province
issued 9 documents guiding the management and exploitation of geographical indication Phan Thiet for fish
sauce, some papers of other provinces also concentrated
on providing guidance for the management, exploitation
of special products bearing geographical indications or
certification marks in localities such as Hai Phong with
Cat Hai fish sauce, Daklak with Buon Ma Thuot coffee, Tay
Ninh with Ba Den mangosteen, Thai Nguyen with Vo Tranh
tea and Pho Yen tea, etc.
Particularly, some provinces made great efforts to establish policies to directly facilitate the State management on industrial property, reflecting the resolution of
the provincial leadership in the development of industrial property in general, the highlight of which was the
construction by Da Nang City and Hoa Binh province of
the Regulations on the interdisciplinary cooperation between the Departments of Science and Technology and
enforcement agencies in the protection of intellectual
property, the Regulation on special treatment to attract
talents to participate creative activities, the Action Plan
on Strengthening the protection of IPRs, etc.

Dissemination of knowledge, policies

and legislation on industrial property
The dissemination of knowledge, policies and legislation
on industrial property was always a regular and periodical work, as well as an important task of high attention
in provinces.
In 2010, provinces in nationwide organized 55 seminars,
83 dissemination activities and 143 training courses on
industrial property. The locality rated number 1 in terms
of quantity was Ho Chi Minh City with 22 seminars and
training courses on industrial property, which was followed by Binh Thuan province with 19, Da Nang City
16, Dong Nai 13 and Lai Chau 8.

Consultation on the establishment

and enforcement of industrial property rights
With development of the market economy, demands on
industrial property registration has been constantly rising up. DOSTs have been playing a more and more important role in providing consultations and supports to
organizations and individuals in this field with one third
of total number of provinces have provided consultation on the establishment and enforcement of indus-
trial property rights in the whole country (18/63 cities

and provinces). Apart from Ha Noi and Ho Chi Minh City
which always take the prime, other provinces such as
An Giang, Ben Tre, Ca Mau, Nam Dinh, Quang Binh, Ninh
Thuan, etc. have also obtained considerable achievements in this field.
Supporting to development
of enterprises IP assets
In addition to regular assistance activities such as providing consultation and guidance on the establishment and
enforcement of rights and promulgating documents to
encourage the development of IP assets in enterprises,
other direct assistances were positively implemented
through the National Program on Supporting the Development of IP assets (the Program 68) by provinces and
cities. However, activites implemented under the Program mainly supported the establishment and registration of industrial property rights for certification marks,
geographical indications and dissemination of industrial
property knowledge.
The Program on Supporting the development of IP assets for the period 2011-2015 is targeted to the satisfaction of 70% of requests by localities for supporting local
special products and 50% of requests for supporting IPRs

registration for strategic and potentially export products
in main markets. This is a firm ground for provinces in the
continuous implementation of projects for construction,
management and development of special products in localities as well as for the assistance of enterprises in the
construction, exploitation and development of IP assets
in the coming time.

Handling industrial property rights infringment

The handling of industrial property rights infringement
mainly focuses on trademark and industrial design cases,
which are easy to approach and the objects of the antifake goods, counterfeit goods and low-quality goods annual programs of enforcement agencies.
According to reports of provinces, in 2010, IPRs enforcement forces in localities nationwide settled 1,632 trademark infringement cases, approximately equal to that
number of 2009, with the total fine of 4,592,000,000
VND. The number of design infringement cases was 215,
increasing by 40.5% over 2009 (153 cases). The number
of cases relating to unfair competition was 11 cases, with
the total fine of 68,500,000VND.
Creative and innovative promotion

Creative and innovative promotion has been continuously and strongly implemented in provinces in forms of
competitions, presenting ceremonies for technological
creations in the local areas. Some leading provinces in
this activity were An Giang, Da Nang, Phu Yen, etc. However, in order to put those activities in an effective order, the renovation of organizational mechanism for this
type of activity should be urgently carried out. Therefore,

Regulations on Innovation paralleling with the promulgation of a Governmental Decree should be issued soon.

Cng tc cp Chng ch hnh ngh v Giy chng nhn
iu kin hnh ngh dch v i din SHCN vn c
thc hin thng xuyn. Nm 2010, Cc ghi nhn 10
t chc dch v i din SHCN, xa tn 1 t chc, sa i
thng tin v a ch/tn giao dch ca 11 t chc; ghi
nhn sa i t cch i din cho t chc dch v i
din SHCN (10 ngi i din); Cp 37 Chng ch hnh
ngh dch v i din SHCN (trong cp mi cho 34
c nhn, cp li cho 3 c nhn). Hin c nc c 113
t chc c ghi nhn iu kin hnh ngh dch v

i din SHCN v 272 c nhn c cp Chng ch hnh
ngh dch v i din SHCN.
Cng trong nm nay, Cc SHTT tip nhn, xem xt h
s yu cu x l 1 trng hp vi phm php lut v i
din SHCN (theo n t co), pht hin v nhc nh 2 t
chc qung co sai s tht v quyn kinh doanh dch v
i din SHCN.
C th ni, vic tng cng cng tc qun l hot ng
dch v SHCN ca Cc SHTT bo m cho cc t chc
dch v i din SHCN hot ng theo ng cc chun
mc o c ngh nghip, nng cao cht lng ca dch
v i din SHCN.
industrial property agents activities
In 2010, NOIP paid more attention to an examination for

industrial property agent profession. This was the biggest examination so far and was organized on January
15-17, 2010. In preparation for the event, the NOIPs
Director General issued an Examination Guideline; the
Minister of Science and Technology issued a list professional experts to join in Examination Board. The questions were mostly about applications of laws and regulations to certain situations, thus, the examination could
chose eligible examinees who wished to become industrial property agent. There were 35/221 examinees pass
the examination.
Granting Certificates of right to exercise as industrial
property agent and Certificates on eligibility to exercise as industrial property agency was made regularly.
In 2010, the NOIP recorded 10 industrial property agencies, eliminated 01 industrial property agency, recorded
the amendment of address/trade name of 11 industrial
property agencies; recorded amendment to industrial
property agency status (10 agents); issued 37 certificate
of right to exercise as industrial property agents (issued
34 new certificates and re-issued 3 ones). To present, 113
are eligible to exercise as industrial property agencies

and 272 qualified for exercise industrial property agents.
This year, the NOIP also handled one agent violating
regulations on industrial property agents activities
(base on the letter of denunciation), detected and sent
warning notices to two organizations misinforming their
rights to execute as industrial property agencies.
In conclusion, the strengthening of management by the
NOIP made industrial property agencies operate in compliance with professional etiquette and their services
quality improved.
