IntheUnitedstatesofAmericaAfricanAmericanswereconsideredlowerclasscitizens,
everysincetheirwereemancipatedfromslaveryin1865.Eventhoughtheywerenolonger
slavestheystillhadtolivebyrules.Onerulewassegregationasystemofseparatingraceses.
IntheUnitedStatesofAmericasegregationwasapartofeverydaylifeandcamewithlaws.
TheselawswerecalledJimCrowlawsandhadbeenaroundsince1877.OnJune7,1892a
thirtyyearoldshoemakernamedHomerPlessy(aoneeighthblackman)satinawhiteon
railroadcartandidentifiedhimselfasblack.Hewasarrestedandchargedwithviolatingthe
separatecarAct.Plessyslawyer,AlbionW.Tourgeearguedthattheactviolatedthe13thand
14thamendment.Eventuallythecasemadeittothesupremecourtin1896.Thecourtupheld
traditionsonsegregationintheUnitedStatesandstatedthatsegregationdidnotViolatethe
13thand14thamendment.Aslongaseveryonewastreatedequalsegregationwaslegal.The
UnitedStatesofAmericafrom1877to1964wouldbeseparatebutequal.Therewerethree
factorsthatledtothedecisionmadebythesupremecourt.Thosefactorswereimportantevents
thatsetanexampleforfuturesimilaroccurrences,waysAfricanAmericanwereviewedatthat
time,andtheinterpretationsoftheconstitution.

LifeunderJimCrowimpactlifethefutureinAmerica.Eventhoughblackswerenot
slavestheystilllivedinaprejudicedsociety.IndocumentBThomasJefferson,Noteonthe
stateofVirginia,1787.Ittalksabouthowblackswereequaltowhitesbutnoteveryonefeltthat
way,sothatmadeithardtogainequality.itappearstome,thatinmemorytheyareequalto
whites.Thisunfortunatedifferenceofcolour,andperhapsoffaculty,isapowerfulobstacleto
theemancipationofthesepeople.Whatthisissayingthatbecausethedifferentraceshave
differentpoweritspossiblethatthisisthereasonitshardforblackstoearntheircivilrights.
Referringbacktothejudgesthisshowswhytheymadetheirdecision,becausetheirwasnot
enforcementonblackrights.AlsoindocumentI,theCivilRightsCases,1883,ittalksabout
howcongressprovidedvindicationoncases.Becausethedenialbystatetoanypersonsequal
protectionoflawsisprohibitedbytheamendment,thereforecongressmayestablishlawsfor
theirequalprotection.Thisshowshowduringthattimestatesdidntwantblackstohaveequal
rightssocongresshadtooverrulethestatesandprovidethatprotectionforthepeople.This
connecttothecasebecauseifpeoplealreadydidntwantblacktohavetheirway,itwasnt
goingtohappenwiththePlessyv.Fergusoncase.

Sinceblacksatthattimewereconsideredlowerclasscitizenssince1877theydidnt
havemuchendowment.AfricanAmericanequalityandrightswerenttakenintoconsideration
often,upuntilthePlessyv.Fergusoncasein1892.InthepassageJimcrowlawsandLife
underJimCrowittellsyouallthedaybydayrulesblackshadtolivebutandwhattheycouldnt
do.UnderJimCrow,AfricanAmericanswererelegatedtothestatusofsecondclasscitizens
andJImCrowrepresentedthelegitimizationofantiblackracism.Soduringthattimeracism

wasadailythingforAfricanAmericansandthejudgesjudgedthecaseoffthestatusofAfrican
Americansandhowtheywerealreadyviewedbyothers.InadditiontothatindocumentF
ArgumentofJohnQuincyAdams,Amistadcase,1841.Ittalksabouthowblackswereviewed
byAmericawhentheywereenslaved.TheConstitutionnowhererecognisedtheas
property..Slaves,therefore,intheConstitutionoftheUnitedStatesarerecognizedonlyas
person,enjoyingrightsandheldtotheperformanceofduties.Sothismeanconstitutionalwise
AfricanAmericanswereneverlookedataspeoplewhoareentitledtohumanrights,onlyhas
peoplebeingheldtowork.SoiftheywereonlylookeduponaspropertywhenthePlessyv.
Fergusoncasecameintoplay.TheJudgeshadtolooktotheconstitutionandamendmentsto
maketheirdecision.

Thesupremecourtalwaysusestheinterpretationoftheconstitutiontodistributepower
andbuildasystemforallmentofollow.INdocumentDThetenthamendment,1791,ittalks
abouttheUnitedstatesandpower.PowersnotdelegatedtotheUnitedStatesbythe
Constitution,norprohibitedbyittothestates.MeaningintheUnitedStatesConstitutionally
poweristhatgivenortakenaway.SoatthattimewhiteswereconsideredsuperiortoAfrican
Americansandthejudgeshadtotakethatintoconsideration.
