    The Bureau of Customs (BOC) has released guidelines operationalizing some sections of the implementing rules and regulations (IRR) of the Foreign Ships Co-loading Act. Customs Memorandum Order (CMO) No. 16-2016, signed June 10 and which took effect immediately, operationalizes Sections 6, 7, and 8 of Joint Department Administrative Order (JDAO) No. 001-2016, which sets the IRR for Republic Act (RA) No. 10668 or “An Act Allowing Foreign Vessels to Transport and Co-Load Foreign Cargoes for Domestic Transshipment and for Other Purposes.” RA 10668 specifically allows foreign shipping lines to dock at multiple Philippine ports and co-load import and export cargoes cleared by the BOC.

    pen Sncitons MASTER COPY WNL ang 2016 cusroms MEMORANDUM ORDER secon SUBJECT: OPERATIONAL GUIDELINES IN THE IMPLEMENTATION OF REPUBLIC ACT. 10568, OTHERWISE KNOWN AS “AN ACT ALLOWING FOREIGN VESSELS TO TRANSPORT AND CO-LOAD FOREIGN CARGOES FOR DOMESTIC TRANSSHIPMENT AND FOR ‘OTHER PURPOSES” ___ OTHER PURPOSES ‘Pursuant to Republic Act 10668 and is Implementing Rules and Regulations, the feliowing rules are hereby promulgated: 1. OBJECTIVES 2. To operationalize Sections 6, 7 and 8 of Joint Department Administrative Order DAD) No. 001-2016: Implementing Fules and Reguations of Republic ‘het 10868, otherwise krown as "An Act Alowing Foreign vessels to Transport ‘nd Corlood Foreign Cargoes for Domestic Transshipment and for other urposes" “To lower the cost of shipping Export Cargoes from Philippine Ports of Entry to International ports and Import Cargoes from Intemational ports for the ‘benef ofthe consumers. 2. DEFINITION OF TERMS For purposes ofthis order, the following terms are defined as follows: 2, Covloading refers to the agreements between two (2) oF more Intemational Sen carrier bound for 3 specified destination agrees to Toad, transport, and Unload the contalner van or cargo of another carer bound for the same estination; b. COVERAGE “These rules shall apply In connection with Section 6 (Co-loading of Import Cargo), Section 7 (Coroading of Export Cargo) and Section 8 (Coroading of Empty Containers) (0f JDAO No, 001.2016. ; 4, OPERATIONAL PROVISIONS A. The Recipient vessel shall submit the corresponding e-1FM forthe co-oaded cargoes atthe final port of eischarge using Bil of lading nature code *23". ‘A Permit fr Co-oading 2.1 The foreign ship operator or agent ofthe foreign Recipient vessel shall request for a Permit fr Co-eading to the Office ofthe Deputy Colector for (Operations or equlvaent office atthe port concemed using te form attached as Annex B at least twelve (12) hours before arrival of the vessel, 2.2 The Permit for Cofoacing shal contin the folowing information as prescribed in the format annexed inthis Order: 2. Application Date and Time. 1b. A.3 of this Order ‘Approved Permit for Co-loading shal be sent via electronic mall and/or fx by the Office of the Deputy Collector or equivalent office at the Port of Discharge to the Office of the Deputy Collector or equivalent office at the Port of Final Destination immediately upon approval.
