Area of Cooperation

A rea de cooperao inclui, sob consentimento

mtuo e condies apropriadas, qualquer
programa oferecido e proposto por qualquer
das partes como desejvel, executvel, e que
venha a contribuir para o fomento e o
desenvolvimento de relaes de cooperao
entre as duas partes convenentes.

The area of cooperation includes, subject to mutual

consent and appropriate conditions, any program
offered and proposed by either party as desirable,
feasible, and that shall contribute to the fostering
and development of the cooperative relationship
between the two covenant parties.

Second Clause
Methods

Todos os entendimentos estaro condicionados

disponibilidade de fundos e sano do Reitor
da Universidade Estadual do Maranho e do
Reitor da University _________________,
mediante as seguintes aes:

All understandings shall be subject to availability of

funds and the sanction of the Rector of the
Universidade Estadual do Maranho and that of the
Rector of the University _________________, by
means of the following actions:

graduao, ps-graduao, pesquisa e
formao permanente ou desenvolvimento

leave and other personnel development programs;

de redes, grupos de pesquisa e projetos de
cooperao em qualquer rea de interesse

groups and cooperation projects in any area of
shared interest;

Os termos de tal assistncia recproca e as

caractersticas de cada programa e atividade
devem ser mutuamente discutidos e
estabelecidos em acordo escrito especfico por
ambas as partes, antes do incio de atividades
ou programas especficos, mediante termos
aditivos ao presente acordo.

The terms of such mutual assistance and the

characteristics of each program and activity shall be
mutually discussed and agreed upon in specific
writing by both parties, prior to the initiation of the
particular activity or program, through additives to
the present agreement.

Poltica de Execuo do Acordo

Third Clause
Policy on the Execution of the Agreement

Cada parte deve responsabilizar-se por

assegurar completa conformidade de seus
participantes em programas ou atividades
quanto s leis e regulamentos dos respectivos
pases e instituies, incluindo seguros.

Each party shall be responsible for assuring full

compliance by its participants in programs or
activities with applicable laws and regulations in
force of the respective countries and
institutions, including insurance.

Nenhuma das partes dever fazer uso do nome

da outra em publicaes, anncios ou para
qualquer fim comercial, sem a prvia
concordncia por escrito da outra parte
envolvida.

Neither party shall use the name of the other in

any press release or product advertising or for
any other commercial purpose without the prior
written consent of the other.

Cada parte designar um executor responsvel

para coordenar atividades especficas ou
programas sob aprovao dos respectivos
representantes legais.

Each party will designate a representative to

coordinate specific activities or programs with
the approval of the respective competent
authorities.

Financiamento

Fourth Clause
Funding

Ambas as instituies signatrias deste acordo

procuraro obter financiamento para as
atividades que desenvolvero em colaborao, o
que pode incluir financiamento externo de seus
respectivos
governos,
de
organizaes
multilaterais, de fundos e bancos de
desenvolvimento internacional e de outras
agncias e organizaes internacionais.

Both institutions involved in this agreement

intend to find ways to fund their collaborative
activities. These funding sources may include
external funding from their respective
governments, from multilateral organizations,
international development banks and funds, and
other international organizations and agencies.

Nenhuma parte exigir taxa de matrcula dos

estudantes de intercmbio, excetuando-se as
taxas cobradas por prestao de servios
especiais.

Neither party to the agreement shall levy tuition

fees on interchange program student, except for
fees relative to special services.

Propriedade Intelectual

Fifth Clause
Intellectual Property

Quando qualquer ao de colaborao resultar

na gerao de propriedade intelectual, as partes
envolvidas
devem,
imediatamente,
por
intermdio de seus respectivos representantes
oficiais, estabelecer os direitos sobre tal
propriedade,
procurando-se,
neste
ato,
preservar a relao harmoniosa entre as
instituies, ressalvada a legislao especfica
em vigor no pas de cada partcipe.

Should any faculty collaboration result in

intellectual property, the parties shall
immediately
meet
through
designated
representatives and establish ownership of such
property, seeking to preserve the amicable
relationship between the institutions, subject to
the terms of the current specific legislation in
each country involved

Em todas as comunicaes e publicaes, que

resultem de projetos desenvolvidos no mbito
deste Acordo, tanto a Universidade Estadual do
Maranho
como
a
University
_________________ sero expressamente
indicadas nos crditos de tal produo.

In all forms of lecture and work publication

which result from projects developed within the
scope of the present Agreement, both the
Universidade Estadual do Maranho and the
University _________________ shall be placed
in the credits of that production.

Clusula Sexta
Vigncia e Resciso

Sixth Clause
Effective Term and Termination

Este Convnio ser vlido por 05 (cinco) anos,

a partir da data da sua assinatura. Qualquer
acrscimo, supresso ou modificao deste
Acordo requer aprovao por escrito do Reitor
da Universidade Estadual do Maranho e do
Reitor da University _________________ e
dever anexar-se a este documento. Terminado

of five years from the date of its signature. Any

Either party reserves the right to terminate this

agreement with no less than 6 (six) months
notice period.

Jurisdio

Seventh Clause
Jurisdiction

Eventuais litgios sero resolvidos pela

jurisdio onde o fato suceda e, se necessrio,
julgados pelos princpios legais adotados pelos
dois pases.

Any disputes shall be resolved by the

jurisdiction where the fact succeeds and, if
necessary, judged by the principles of law in
each country.

Clusula Oitava
Publicao do Convnio

Eighth Clause
Publication of the Agreement

Cada instituio participante far a publicao

oficial de um extrato do presente convnio, se
determinado pela legislao do respectivo pas.

Each participating institution shall publish

officially an extract of the present agreement, if
required by the legislation of the respective
country.

Estando acordados os interesses, as partes do

presente convnio assinam o documento escrito
em dois originais, em portugus e em ingls.

Being agreed to its terms, the parties to this

agreement hereby sign the two originals of this
agreement written in Portuguese and in English.
