Article III of our Constitution identifies every Rights of every Filipino Citizen

DUE PROCESS- is a law that hears before it condemns. It is the Right that doesn’t
let us be deprived of our life, liberty or property. It is the law that allows us to
defend ourselves. Nonetheless, he can be deprived of his life when he is proven
guilty for a crime he commited.

EQUAL PROTECTION OF THE LAW- It refers to the equality in the enjoyment of


similar rights and privileges granted by law. Basically, whatever your status in life
you’ll be treated equally before the law because no one is above the law.

RIGHT AGAINST UNREASONABLE SEARCHES AND SEIZURES- The right of the


people to be secure in their persons, houses, papers, and effects against
unreasonable searches and seizures of whatever nature and for any purpose shall
be inviolable, and no search warrant or warrant of arrest shall issue except upon
probable cause to be determined personally by the judge after examination under
oath or affirmation of the complainant and the witnesses he may produce, and
particularly describing the place to be searched and the persons or things to be
seized. It’s our right to our privacy. No police could search our home or car without
consent from the owner or a search warrant. A person can’t be arrested without an
arrest warrant except if he is an escaped prisoner or if the person to be arrested has
committed or committing or attempting to commit a crime.

FREEDOM OF SPEECH- its also known as freedom of expression. It can be


expressed through oral or written communication. This right is practice except when
it constitutes libel, slander, obscenity, sedition or criminal conduct. Its is considered
as an essential vitality of a democratic government.

A state can limit this freedom throught:

1. Dangerous Tendency Rule- The state can punish a person for a speech
encouraging people to engage illegal action or become disloyal to the state

2. Clear and Present Danger Rule- Freedom of speech isn’t an absolute right. A
government can punish a person for speech that presents clear and present
danger leading to illegal acts.

RIGHT OF ASSEMBLY-is the right on the part of the citizens to congregate


peacefully in a public meeting to discuss issues and matters of interest to them.

RIGHT OF PETITION- is the right of any citizen to ask any branch of the
government to take action on his complaint or grievance.
